3 AN ORDINANCE TO DISSOLVE HEATHERBRAE PROPERTY
4 OWNERS' IMPROVEMENT DISTRICT NO. 5 OF LITTLE ROCK,
5 ARKANSAS; AND FOR OTHER PURPOSES.

7 WHEREAS, by Ordinance No. 17,400 (February 18, 1997), the Little Rock Board
8 of Directors established the Heatherbrae Property Owners' Municipal Improvement
9 District No. 5 of Little Rock, Arkansas, and
10 WHEREAS, the commissioners of the district, by unanimous vote, have
11 determined that the district should be dissolved and, in furtherance thereof, have filed
12 with the City Clerk their resolution acknowledging the following:
13 A. Their decision is unanimous among the district's board of commissioners;
14 B. There is no longer a need for the district;
15 C. There are no debts or other claims against the district;
16 D. There are no assessments levied against the lands in the district;
17 E. There are no funds or other assets belonging to the district;
18 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
19 OF THE CITY OF LITTLE ROCK ARKANSAS:
20 Section 1. Dissolution. The Heatherbrae Property Owners' Municipal
21 Improvement District No. 5 of Little Rock, Arkansas, incorporating the real property
22 described as follows:
23 Part of the E 1 /2, NE 1/4, Section 24, Township 2 North, Range 14 West,
24 City of Little Rock, Pulaski County, Arkansas, more particularly described
25 as follows:
26 Beginning at the SW corner, E 1/2, NE 1/4, NE 1/4, Section 24, Township 2
27 North, Range 14 West; thence S 02 0741" W for a distance of 540.67 feet;

1 thence N 87 37'14" E for a distance of 219.34 feet; thence N 18 29'43" E for
2 a distance of 81.61 feet; thence N 54 57'13" E for a distance of 114.70 feet;
3 thence N 4124'08" W for a distance of 76.21 feet; thence N 22 51'10" E for
4 a distance of 115.26 feet to a point of the South R/W line of Glenn Valley;
5 thence N 66 27'39" W along the chord of a curve to the left for a distance
6 of 58.28 feet; thence N 15 41'41" E for a distance of 203.42 feet; thence S 89
7 05'52" W for a distance of 19.0 feet; thence N 013728" E for a distance of
8 751.32 feet; thence N 83 25'34" W for a distance of 299.49 feet; thence S 01
9 43'43" W for a distance of 781.20 feet to the Point of Beginning.
10 And
11 Lots 18, 19, 20, 21, 22 & 23 of Heatherbrae Subdivision Phase 2 to the
12 City of Little Rock, Pulaski County, Arkansas,
13 is hereby dissolved and its board of commissioners discharged from further
14 responsibility as commissioners.
15 Section 3. Severability. In the event any portion of this ordinance is declared or
16 adjudged to be invalid or unconstitutional, such declaration or adjudication shall not
17 affect the remaining portions of this ordinance, which shall remain in full force and
18 effect as if the portion so declared or adjudged invalid or unconstitutional was not
19 originally a part of this ordinance.
20 Section 4. Repealer. All ordinances and resolutions, and parts thereof, which
21 are in conflict with any provision of this ordinance are hereby repealed to the extent of
22 such conflict.
23 Section 5. Emergency Clause. There is hereby declared to be an existing
24 emergency in that there is an immediate need for the dissolution of the district to secure
25 the health, safety and welfare of citizens of Little Rock, Arkansas; therefore, this
26 ordinance shall be in full force and effect from and after its passage.
