Firstly, and most importantly, your property has a conservation easement. The State of Arkansas Department of Parks, Heritage, and Tourism holds that easement on your property. I am copying Paul Porter on this email. He is the Easement Coordinator with the State. I read your conservation easement that was attached. I cannot offer legal advice, please talk with Paul on what is involved. We have other properties that are in the MacArthur Park Local ordinance District that have conservation easements on them. He and I work well together to get things approved. Secondly, this is a local ordinance historic district. The Guidelines include copies of the state and local laws. All exterior changes to the site and the building need to be approved by Staff and or the Commission. The HDC does not review interior changes to the structure as long as they do not affect the exteriors. Thirdly, your property is governed by basic zoning laws. This is zoned R-4A which is single family or two family houses. A conditional use permit may be requested to have a quiet office or quite commercial use on the property. This would have to go through the Historic District Commission and then the Planning Commission. Your conservation easement may cover this point. All work on the house that is a retail value of $500 or more needs a building permit. The deck, fence and lattice is probably something that Paul, you, and I could work out to repair or replace under maintenance guidelines. Usually we visit on site, take photos of what needs to be done, etc. This may be a bit to digest, but please email me back or call me with any other questions. My husband and I are interested in 623 Rock St. that has just come on the market, but we have some questions about historic homes and the rules for properties in the specific districts. Is there some place that I can find the complete rules for the districts? This is in the MacArthur district. Mainly we are curious about rules on the interior of the house. We were given the following attachment about the historic preservation easement for the property, but we have some questions in plain language. Originally (from some basic searches on Google), we were under the impression that we could do things to the inside of properties as long as the outside was kept as stated in the zoning guidelines, but that might not be the case since there was some grant money involved with this house at some point in time? I don't know if this pertains to the interior or not. How would we find out? Do any changes to the inside like paint and kitchen remodel have to go through historic board approval in order to get permits? Do we have to keep the interior with colors from the period? Can we be our own contractors?
