I received notice today that Frank Lyon has decided to dismiss his lawsuit against the City. The
order dismissing the case should be filed either tomorrow or early next week. Let me know if you have

Plaintiff, Frank Lyon, Jr. ("Plaintiff'), by and through his attorneys, Rose Law Firm, a
Professional Association, and for his Motion for Voluntary Dismissal Without Prejudice, states
as follows:
1. On November 20, 2008, Plaintiff filed the above -captioned lawsuit against the
City of Little Rock and Mark Stodola, in his official capacity as Little Rock Mayor
("Defendants")
2. Plaintiff respectfully moves this Court, pursuant to Rule 41(a) of the Arkansas
Rules of Civil Procedure, to dismiss without prejudice his Complaint against Defendants.
WHEREFORE, Plaintiff prays that the Court grant his Motion for Voluntary Dismissal
Without Prejudice, and that his claims filed herein against Defendants be dismissed without
prejudice.
