RE: The Ranch/Amendment to Land Use Plan LU -99-20-01
Dear Jim:
On September 2, 1999, Ranch Properties, Inc., FCC Tract D Partnership and Financial
Centre Corporation and John D. McCracken (collectively the "Owners"), filed an
Application to Amend the Land Use Plan applicable to their Iands situated at The Ranch
from Commercial and Office to MOC. The City agreed to support the proposed
amendment on the condition that the Owners and City reached an agreement as to
commercial zoning and that the same be reflected in the Ordinance to be adopted by the
Board of Directors.
This letter is intended to memorialize the agreement between the Owners and the City
concerning the Ordinance (the, "Ordinance") to be adopted by the Board of Directors, a
copy of which is attached hereto and made a part hereof. The City and the Owners agree
that the Ordinance be interpreted and construed as follows:
Agreement:
1. that Ordinance 14,809 zoned 63.2516 acres of land at The Ranch C-2;
2. that since passage of Ordinance 14,809, 24.35 acres of that C-2 zoned land
were down zoned to 0-2 and that of the lands originally zoned C-2 by Ordinance 14,809
only 38.90 acres of that land remains zoned C-2;
3. that the 38.90 acres of C-2 zoned lands (hereinafter referred to as the
"38.90 Acre Parcel") is presently situated between Katillus Road on the East, Ranch
Boulevard on the West and Highway 10 to the South;

4. that there are 42.20 acres of lands presently zoned 0-2 situated between
Patrick Road on the West, Ranch Boulevard on the East and North of Highway 10
(hereinafter referred to as the 42.20 Acre Parcel);
5. that the Owners of the 42.20 Acre Parcel may develop the 42.20 Acre
Parcel for an office use without rezoning;
6. that the Owners of the 38.90 Acre Parcel may develop the 38.90 Acre
Parcel for a commercial use without rezoning; and
7. that the Owners of the 42.20 Acre Parcel may rezone up to 24.35 acres of
the 42.20 Acre Parcel for a C-2 use and may rezone more than that 24.35 acres of the
42.20 Acre Parcel for a C-2 use but only if for that number of acres exceeding 24.35 acres
of the 42.20 Acre Parcel an equal number of acres of C-2 zoned land in the 38.90 Acre
Parcel is down zoned.
Jim, I understand that a copy of this letter will be placed in and be a part of the City's
permanent files on this matter. Please indicate your approval hereof by signing your name
at the conclusion hereof where your signature block appears.
