HomeMy WebLinkAboutland swap resolutionsS 1 9 RESOLUTION NO. 11, 099 2 3 A RESOLUTION OF INTENT TO OFFER A PORTION OF 4 ONE OR MORE CITY PARK AREAS, INCLUDING 5 PROPERITIES WITHIN THE FOURCHE CREEK 6 WATERSHED, FOR LEASE TO A PRIVATE PERSON OR 7 ORGANIZATION WILLING AND ABLE TO CREATE A 8 NATURE CENTER; AND FOR OTHER PURPOSES. 9 10 WHEREAS, the City engaged in the development of a comprehensive master plan that 11 calls for the development of a nature center and related nature study areas within city park 12 properties, and 13 WHEREAS, various City park properties such as Fourche Creek, Gillam Park, or other 14 environmentally programmed properties are appropriate for the location of such a nature center, 15 and 16 WHEREAS, the creation, construction and maintenance of a nature center within a 17 public park is anticipated by the City, particularly since many park properties are extremely rich 18 in wildlife and plant species, and 19 WHEREAS, such a use is consistent with the City's proposed Master Parks Plan, and 20 with suggestions that have been discussed by the Vision -Little Rock process, and 21 WHEREAS, the Audubon Society of Arkansas, the state office of the National Audubon 22 Society, has already expressed an interest in the development of a nature study center within the 23 boundaries of Little Rock, that could be built and operated by the Audubon Arkansas, and 24 WHEREAS, consistent with Arkansas law the City shall use a competitive selection 25 process to make park property available to private users, but the desire to move forward with 26 such a process is definitely enhanced by the expressed interest of the National Audubon Society, 27 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF 28 THE CITY OF LITTLE ROCK, ARKANSAS: . 29 Section 1. The City notes its intent to undergo a competitive selection process to 30 offer for lease any or all of the area within, Fourche Creek, Gillam Park or any other 31 environmentally programmed city park property or facility, to any person(s) or organization(s) PAGE I OF 1 1 willing and able to construct, operate, or maintain a nature study center that fulfills the vision of 2 the City's Master Parks Plan, and the goals of the Vision -Little Rock process. 3 Section 2. The City Manager, and the Director of Parks & Recreation, are directed to 4 work with the City Attorney to develop a competitive selection process with which to submit to 5 public for the creation and operation of such a nature center, and to proceed with this process as 6 expeditiously as possible with the hopes that the selection of such an entity can be completed 7 before October 31, 2001. 8 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, 9 phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such 10 declaration or adjudication shall not affect the remaining portions of the ordinance which shall 11 remain in full force and effect as if the portion so declared or adjudged invalid or 12 unconstitutional was not originally a part of the ordinance. 13 Section 5. Repealer. Carpenter, City A rney 24 25 26 27 // 28 // 29 30 31 // 32 // 33 // PAGE 2 OF 2 1 RESOLUTION NO. 11,190 2 3 A RESOLUTION TO AUTHORIZE AN AGREEMENT WITH AUDUBON 4 ARKANSAS TO DEVELOP A NATURE CENTER ON CITY PARK 5 PROPERTY LOCATED WITHIN THE FOURCHE CREEK DRAINAGE 6 AREA CONSISTENT WITH THE LITTLE ROCK PARKS & 7 RECREATION MASTER PLAN; AND FOR OTHER PURPOSES. s 9 WHEREAS, the Little Rock Department of Parks & Recreation Master Plan, 10 approved in Little Rock, Ark., Ordinance No. 18,528 (July 17, 2001), stated that one of the 11 goals of the City is to conserve open space and promote biodiversity, particularly in areas 12 with unique and sensitive natural features, and 13 WHEREAS, one of the proposed methods to meet this goal was to utilize the 14 wetlands area of Fourche Creek, one of the largest urban wetlands in America, as a natural 15 area with educational and recreational uses, and 16 WHEREAS, in Little Rock, Ark., Resolution No. 11,099 (August 7, 2001), the City 17 authorized the issuance of requests for proposals to lease portions of City parks to some 18 entity to develop nature centers that would promote this goal and vision of the Little Rock 19 Parks & Recreation Master Plan, and 20 WHEREAS, in response to RFP No. 01319, which was opened on November 30, 21 2001, Audubon Arkansas was determined to have a responsible and responsive bid and, 22 therefore, was determined to be qualified to receive this bid to create a nature center, and 23 WHEREAS, the response of Audubon Arkansas proposes to construct, operate and 24 endow a nature center with kiosks, exhibits, trails, and landscaping, [PAGE 1 of 31 Resolution Audubon Arkansas Nature Center 0 • 1 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF 2 THE CITY OF LITTLE ROCK, ARKANSAS: 3 Section 1. The City Manager is authorized to enter into a lease agreement with 4 Audubon Arkansas to develop a nature center on City park property within the Fourche s Creek drainage basin in order to provide conservation, educational, and recreational uses 6 within this Center. 7 Section 2. The City accepts the bid of Audubon Arkansas and the proposal to 8 construct, operate and endow this nature center in accordance with its bid proposal; 9 further, the City understands that the estimated costs for construct a 10,000 to 15,000 10 square foot nature center, provide exhibits, provide equipment, create landscaping, kiosks 11 and trails, operate, and to endow the facility, will require approximately eight and one 12 half to ten million dollars ($8.5 to $10 million) to be provided from Audubon Arkansas; 13 further, as a result of this capital outlay for this lease, the City will only require a nominal 14 annual rental payment of one dollar ($1.00) per year in exchange for the construction and 1s operation of the nature. center in accordance with the response to the City's request for 16 proposals. 17 Section 3. Severability. In the event any title, section, paragraph, item, sentence, 18 clause, phrase, or word of this resolution is declared or adjudged to be invalid or 19 unconstitutional, such declaration or adjudication shall not affect the remaining portions 20 of the resolution which shall remain in full force and effect as if the portion so declared or 21 adjudged invalid or unconstitutional was not originally a part of the resolution. 22 Section 4. Repealer. Carpenter, Ci Attorney 9 // 1 o // 11 // 12 // 13 // 14 // 15 // 16 // 17 // 18 // 19 20 21 // 22 // 23 // 24 // 25 [PAGE 3 OF 3] Resolution Audubon Arkansas Nature Center • APPROVED: v Ji Dailey, Mayor I RESOLUTION NO. 13,330 2 3 A RESOLUTION TO AUTHORIZE AN EXCHANGE OF PROPERTY 4 BETWEEN THE CITY OF LITTLE ROCK, ARKANSAS, AND 5 McGEORGE CONTRACTORS; TO AUTHORIZE ANY NECESSARY 6 AMENDMENT TO A LEASE AGREEMENT BETWEEN THE CITY AND 7 AUDUBON ARKANSAS FOR PROPERTY LEASED TO IT FOR A NA - 8 TURE CENTER; AND FOR OTHER PURPOSES. 9 10 WHEREAS, pursuant to Little Rock, Ark., Resolution No. 11,190 (December 11, 2001) ("LRR 11 11,190"), the City of Little Rock, Arkansas ("the City") authorized a lease agreement with Audubon Ar - 12 kansas ("Audubon") for properties located in the Gillam Park area, with the properties to be used to estab- 13 lish a nature center; and 14 WHEREAS, after entry into that lease agreement the City learned that there may be interest in the 15 alienation of certain property included in the lease which could, among other possibilities, have been ac - 16 complished through an exchange of property which would otherwise enhance the Gilliam Park area; and, 17 WHEREAS, pursuant to RFP No. 0267, this park property was offered for alienation, and on Octo- 1s ber 25, 2010, it was determined that McGeorge Contractor, provided an acceptable proposals; and, 19 WHEREAS, on December 8, 2010, the Little Rock Parks Commission recommended that the ex - 20 change of property occur; and, 21 WHEREAS, Audubon Arkansas, and its affiliates with the national organization, have approved the 22 exchange of property and any necessary amendment to the lease agreement authorized in LRR 11,190; 23 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 24 OF LITTLE ROCK, ARKANSAS: 25 Section 1. The Mayor, City Manager, and City Clerk, are authorized to enter into an agreement, and 26 to execute any necessary documents with McGeorge Contracting to exchange property outside the Gillam 27 Park area for property within the Gillam Park area pursuant to the response given to RFP 0267; the exact 28 land descriptions are contained in Exhibits A and B to this resolution. 29 Section 2. The Mayor, City Manager, and City Clerk, are authorized to execute any necessary 30 amendments to a lease agreement, authorized pursuant to LRR 11,190, between the City and Audubon 31 Arkansas for the location and creation of a nature center to the extent that the property identified in the 32 agreement is impacted by this resolution.
