ORDER
The above captioned administrative appeal came on for hearing on September 27, 2017.
Plaintiffs appeared in person, and through their counsel, Philip Kaplan and Allison Gladden, of
Williams & Anderson PLC. Present on behalf of the Little Rock Historic District Commission was
Brian Minyard, represented by Little Rock Deputy City Attorney, Sherri Latimer. Based upon the
record, statements and agreements of counsel, and other matters properly before it, the Court finds
and orders as follows:
1. On March 10, 2014, the Little Rock Historic District Commission (“Commission”)
granted a Certificate of Appropriateness to Plaintiffs for a mixed-use new construction project at
1001 McMath Avenue, in the MacArthur Park Historic District (“Project”), that called for the
installation of cement fiberboard lap siding.
2. On July 7, 2015, Plaintiffs submitted an application for a Certificate of
Appropriateness for the use of horizontal metal siding, instead of the cement fiberboard, which
was considered and denied at the August 10, 2015, meeting of the Commission.
3. Based on the record of the proceedings before the Commission, this Court orders
this matter to be remanded to the Commission.

4. Plaintiffs shall, within a reasonable time from the entry of this order, submit a new
application to the Commission for a Certificate of Appropriateness for the Project (“New
Application”).
5. For purposes of the New Application, neither of the parties shall be entitled to rely
upon prior proceedings before the Commission, or the proceedings before this Court.
6. This Court retains jurisdiction to ensure compliance with its order.
