Brian, I just returned from the DRC with Page. It was made known that his application was going to come before the HDC
because of Piazza’s order to remand (attached) and that the only directive was that Page submit a new application. I
indicated that the only issue at trial was the siding. Ted wanted a copy of the order and I think it’s appropriate to include
it in the package you send the Commission members. Page insisted that no one could talk about the litigation but there’s
no confidentiality mandate. The order only says that the Commission can’t consider what it or the circuit court did in the
past. I would limit discussion on these topics so the Committee isn’t influenced but it’s not forbidden to talk about.
Provision of the order may be sufficient. This application is so anomalous everyone is struggling with it. As the order only
directs Page to submit a new application but the only issue is siding I’d suggest letting the Committee know, as briefly as
possible, what happened and let the members decide if they want to consider all of the factors or only those relating to
exterior walls. We’ll talk about this before the next HDC meeting. Yours, Sherri
