Brian From: Weldon, Debra Sent: Tuesday, June 19, 2018 1:58 PM To: Minyard, Brian; Latimer, Sherri; Malone, Walter Subject: RE: DRC this week Brian, I visited with Tom about the teleconference request. He indicated that the HDC bylaws would have to authorize members to participate in meetings via teleconference call. Since the bylaws do not address teleconference calls for commissioners, an amendment to the bylaws would be required before a commissioner could participate in the design review meeting by teleconference call. My only concern would be possible due process issues – if documents, photos, petitions, or material samples were presented at the meeting and the conference-call commissioner was not able to view and include that information in the rationale for their guidelines recommendation (design review) or COA decision (public hearing). I will let Jeremiah know. Brian From: Minyard, Brian Sent: Monday, June 18, 2018 12:43 PM To: Latimer, Sherri; Weldon, Debra; Malone, Walter Subject: RE: DRC this week Jeremiah (one of the DRC members) called immediately after he got my email. He will not be able to attend, but wanted to know if he could be teleconferenced in. I told him that I would pose the question to Debra and that we would email him a response. I believe that is why we have an alternate on the committee. I will defer this decision to our legal staff. I will put Rob (the alternate) on notice and will ask for RSVPs on the other two. Brian From: Minyard, Brian Sent: Monday, June 18, 2018 11:22 AM To: Latimer, Sherri; Weldon, Debra; Malone, Walter Subject: DRC this week Debra and Sherri, Page Wilson filed an application for the DRC on Friday afternoon on the structure at 1001 McMath. He submitted all of the required documents. I will notify the committee that they will be meeting on Friday, June 22 at 2:00 pm upstairs in our main conference room. Within the application, on page three, there is the “Design Review Committee Comment Sheet”. Since he is just asking about the siding on an existing building, in my opinion some of the design factors do not apply. For example: 1 – Siting, 2 – Height, 3 – Proportion, 4 – Rhythm, 5 - Scale, 6 – Massing, 7 – Entrance Area, 9 – Roof Areas, and 11 - Detailing. I think that 8 – Wall areas and 10 – Façade are the most applicable factors. He received approval for the building at the HDC and the only factor is the siding that he installed without HDC approval. Therefore, I think they should only discuss the factors that relate to the siding. I will ask you two to verify my thoughts on the Design Factors that are not relevant to the discussion. I will be out of the office that day of the meeting. Walter has agreed to sit in on the meeting for me. I will advise him on the statement that is to be read at the first of the meeting (all of page two in the application). Will one of you make a statement that only certain design factors will be discussed in the meeting (assuming that you agree with my premise)? Debra, at the first DRC meeting for 407 E Daisy Bates, the application stated the property owner, the designer/contractor and other representative. Everybody that attended the meeting was listed on the application. On 1001 McMath, the only name listed is “William Wilson” as property owner. On the Designer/contractor space, he put “same as above”. What will we do if he shows up with an entourage? In the new Guidelines, I am sure he will reference page 49 Exceptions under Façade: It states: The HDC, strictly on a case by case basis, will consider materials generally deemed appropriate if: There is sufficient evidence to show another more appropriate material would not satisfy code requirements; There is sufficient evidence to show the material being proposed is superior in durability and longevity to more appropriate materials. 3 You also may wish to inform him that Sheri is no longer representing us on the case. I don’t want him to feel that he is being ganged-up upon, but also that we are doing anything wrong either. I was told that this was Caleb’s first day back, we may want to wait to hit him with this later. I believe that it will be difficult to hold him to 30 minutes. We were pretty good at holding the last one to thirty minutes though we started late.
