The Plaintiffs, William Page Wilson and paul page Dwellings, LLC appear by and ttrough their attomey, Phillip Kaplan, Williams & Anderson, and the Defendant, Little Rock Historic District Commission ("HDC"), appears by and through its counsel, Thomas M. Carpenter, City Attorney, and Sherri L. Latimer, Assistant City Attorney, and as evidence representing signatures hereon, the pleadings herein and other matters brought before this Court, the Court finds and orders as follows: plaintiffs, Wiiliam Page Wilson and Paul Page Dwellings, LLC, may install Hardieboard cement fiber board lap plank siding as approved by the Little Rock Historic Dishict Commission to the exterior of the building on the real property located at 1001 McMath, Little Rock, Arkansas 72202pending this action and until further orders of this court. plaintiffs, appeal of the HDC's decision regarding the denial of Plaintiffs' application for steel siding for the exterior of said building is still pending before &is Court' plaintiffs shall be allowed to apply for a temporary certificate of occupancy. The Building Code Division of the Department of Planning and Development of the City of Little Rock (,Building Code Division") shall issue a temporary certificate of occupancy to Plaintiffs upon appropriate application by Plaintiffs provided all uiteria are met pursuant to federal, state, and ELECTRONICALLY FILED Pulaski County Circuit Court Larry Crane, Circuit/County Clerk 2016-Apr-15 16:40:36 60CV-15-4202 C06D12 : 3 Pages and loeal law and provided Building Code Division believes the issuance of a temporary certificate of cccupancy is appropriats forthe building at 1001 McMath, Little Rock, Arkansas. The parties recognize and the Court agrees that the Building Code Division is not a party to this suit and this Court does not have jurisdiction to order this division to issue permits. Pursuant to the parties' agreement, any temporary certificate of occupancy issued to Plaintiffs for the building at 1001 McMath, Liftle Rock, Arkansas wiit be in effect until a finai order has been entered in this matter. At that time, Plaintiffs may apply for a permanent certificate of occupancy as appropriate. IT IS SO ORDERED.
