Brian, after dealing with the demo last night I think the HDC should have a procedure in place to notice people with a
property interest, especially if it’s an emergency like this was. The following proposal is based on Arkansas Rule of Civil
Procedure 4 which deals with service of process. My thinking is, if this will be sufficient for a court for the service of a
complaint, it should suffice for notice of a demo. You can do whatever you normally do to notice the people in the
required notice area.
1. Mail notice via regular and certified mail to all persons with a property interest (or potential interest in the case
of potential heirs as we had in 1019 Rock St.);
2. Publication in a newspaper having general circulation in Pulaski County weekly for two consecutive weeks;
3. Post the notice on the property.
I know you do most of this anyway but there may be some gaps to cover. I’ve cc’d Shawn as this is his area so he can
correct me as needed. And as we discussed, given the unusual circumstances of this demo, Shawn suggested we send
out notices via regular and certified mail to the (potential) heirs regarding the outcome of last night’s meeting. I’d send a
courtesy copy to Ms. Bird too. If you need me to talk to Jamie or Rick or anyone about this just let me know. Thanks,
