This property is within the MacArthur Park Local Ordinance Historic District and is subject to all rules and regulations of that district. On May 11, 2015, a COA was approved for a three foot fence along Capitol Avenue in conjunction with a COA that was filed for 507 Rock Street. A six foot fence was installed. On December 12, 2016, a COA for the six foot fence was denied and you were informed via a letter dated December 22, 2016 that the six foot fence was to be removed. That fence has not been removed as of the writing of this letter. Please accept this letter as formal notice that construction activity at 401 East Capitol Avenue was also carried out in violation of state law requiring that a Certificate of Appropriateness (“COA”) be obtained prior to making alterations to a structure located in a local ordinance historic district. Our records indicate that a six foot fence was installed in violation of this COA requirement. To bring your property into compliance with state law, you must remove the fence. You may install the originally approved three foot tall fence. Failure to comply with this letter will result in referral of this matter to the Zoning Enforcement Division of the City of Little Rock Planning and Development Department for enforcement proceedings in the City of Little Rock Municipal Court.
