The commissioners have been asking about the fence and the enforcement of it. The letter's template was written by Debra Weldon of the city attorney's office. They were approved with a 3' fence. They were under enforcement and came back to the Commission to ask forgiveness for the 6' fence. They appeared at the commission and were denied to keep the fence as is. 0 ayes, 5 noes and 1 recusal. Quotes from the minutes: Ray Nolan, of Moses Tucker, stated that it was an oversight on their part that the fence was installed incorrectly. He asked for the Commission to allow them to keep the fence. Chair BJ Bowen stated that a 3 foot fence had been approved but that a six foot fence had been installed. He asked them why they did not contact Staff about the change as required. Jimmy Moses stated that it was just a mistake and was unsure how it happened. He knows that it is not in compliance. He explained that the project was to be developed in another way, but that the plans had changed. He asked the Commission for forgiveness. He stated that there was a variety of fences and does not believe that this fence is out of character. Filing deadline is this Friday. If they want to come back, I guess they can. Brian, given the threatening nature of this correspondence and our disbelief that you & the Historic District continue to harass us regarding the removal of a $10,000 decorative, metal fence installed just 3 years ago ( photos enclosed ) , I suggest it might be a good idea for us to reappear before the Commission to discuss this matter , again. There are examples of numerous types & sizes of fences throughout the neighborhood....some are wooden, some are metal, some old some new, some in a state of total disrepair others like ours, in perfect condition and the heights of these fences vary from roughly 3 feet to 8-10 feet. On the stretch of Capitol Avenue between Rock & Sherman the fences vary in height from 3-6 feet .The fence on Capitol Avenue in front of Rainwater Apartments is 6 feet tall, decorative metal: the same is true for Rainwater Flats fence: the fence in front of Trapnell Hall is metal 3-4 feet tall but 2 where it turns onto the alley , adjacent to our fence, it rises to approximately 5 feet in height. You will also get a copy via registered mail via USPS. I have also attached the minutes of the item when it was last heard at the HDC. This fence needs to be removed as soon as possible. Please contact me as to your schedule for removal. You have approval to install the three foot fence as initially requested.
