CODE §28-25 4 (1988), TO ESTABLISH THE LANDFILL FEES FOR THE SANITARY 5 LANDFILL;TO DECLARE AND EMERGENCY;AND,FOR OTHER PUR- 6 POSES. 7 8 WHEREAS, the City of Little Rock, Arkansas, operates a Sanitary Landfill which accepts waste 9 products from the City and other areas; and, 10 WHEREAS,on September 17, 2019,the City amended certain portions of the Code of Ordinances to 11 deal with issues as to solid waste,and also to establish certain fees and costs;and, 12 WHEREAS, it is important to have appropriate landfill fees in place as recommended by the study 13 completed for the City, and to collect these fees starting January 1, 2020, the beginning of the next fiscal 14 year; 15 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF'11-1E CITY 16 OF LITTLE ROCK,ARKANSAS: 17 Section 1. Little Rock,Ark.,Rev. Code § 28-25 is hereby amended to read as follows: 18 (a) The following Tipping Fees shall be charged for disposal of approved solid waste at the City 19 Landfill facility: 20 (1) Class I Waste: Each ton of waste, Thirty-Three Dollars ($33.00), with a minimum 21 charge of Twenty-Five Dollars($25.00)per load. 22 (2) Class IV Waste: Each ton of waste, Thirty Dollars ($30.00), with a minimum charge 23 of Twenty Dollars($20.00)per load. 24 (3) Yard Waste: Each ton of waste,Thirty-Three Dollars($33.00),with a minimum charge 25 of Twenty Dollars ($20.00)per load. 26 (4) Asbestos: Each ton of waste, One Hundred Fifty-Eight Dollars ($158.00), with a 27 minimum charge of One Hundred Dollars($100.00)per load. 28 (b) The Mayor is hereby authorized to negotiate volume discount agreements with City Landfill 29 customers.All volume discount agreements and amounts shall be approved in advance by the 30 Board of Directors. 31 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 32 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 33 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and [Page 1 of 2] 1 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 2 ordinance. 3 Section 3. Repealer. All laws,ordinances,resolutions,or parts of the same that are inconsistent with 4 the provisions of this ordinance are hereby repealed to the extent of such inconsistency. 5 Section 4. Emergency Clause. In order to meet requirement under State and Federal Law to the 6 Pulaski County Regional Solid Waste Management District("the District"), and to assure that payment of 7 all financial obligations necessary to fulfill those requirements, the City employed the firm of Burns & 8 McDonald to perform a Solid Waste Rate Study("the study')pursuant to Little Rock,Ark, Resolution No. 9 14,821 (July 17, 2018), which suggested increases to Landfill Fees as set forth above;the ability to provide 10 such service to the citizens is essential to the public health, safety, and welfare, and it is essential that the 11 recommendations of the study are in effect on January 1, 2020, with other modifications approved in Little 12 Rock,Ark, 21,780 (September 17, 2019), to meet the environmental and public safety requirements of the 13 City; an emergency is, therefore, declared to exist, and this ordinance shall be in full force and effect from 14 and after January 1, 2020. 15 PASSED: December 17,2019 16 dim • __.
