3 A RESOLUTION TO AUTHORIZE THE USE OF EMINENT DOMAIN
4 FOR THE PURPOSE OF ACQUIRING THREE (3) SEPARATE
5 PROPERTIES FOR THE EXPANSION AND IMPROVEMENTS TO
6 CRUMP PARK; AND FOR OTHER PURPOSES.

8 WHEREAS,the City of Little Rock is expanding and making improvements to Crump Park; and,
9 WHEREAS,Julia Brooks,the property owner of all three(3)parcels,is deceased,and staff's attempts
10 to locate the property owner's heirs have been unsuccessful;and,
11 WHEREAS,pursuant to Ark. Code Ann. § 18-15-201(West Supp. 2019)the right of eminent domain
12 is granted to municipal corporations to condemn property for the purpose of parks, boulevards and public
13 buildings.
14 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
15 OF LITTLE ROCK,ARKANSAS:
16 Section 1.The City Manager and City Attorney are hereby authorized to use eminent domain to expand
17 and improve Crump Park and condemn the three(3)parcels,more particularly described as:
18 1) Lot 1,Block 10, Woodlawn Addition to the City of Little Rock,Pulaski County,Arkansas,
19 West 33rd Street-Parcel No. 34L2790008400; and,
20 2) Lot 2,Block 10,Woodlawn Addition to the City of Little Rock,Pulaski County,Arkansas,
21 West 33'Street-Parcel No. 34L2790008500; and,
22 3) Lot 3,Block 10,Woodlawn Addition to the City of Little Rock Pulaski County,Arkansas,
23 West 33'Street-Parcel Number 34L2790008600.
24 Section 2.Funding for this project is available from the 3/8-Cent Sales Tax that provided One Million
25 Dollars($1,000,000.00)for Crump Park improvements and other authorized expenditures.
26 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
27 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
28 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
29 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
30 resolution.
31 Section 4. Repealer.All laws, ordinances,resolutions, or parts of the same,that are inconsistent with
32 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
