3 A RESOLUTION TO AUTHORIZE THE MAYOR AND CITY CLERK TO
4 EXECUTE A TEMPORARY CONSTRUCTION EASEMENT WITH THE
5 ARKANSAS STATE HIGHWAY COMMISSION FOR PROPERTY
6 DESCRIBED AS TRACT E-1 FOR ARDOT JOB NO. 061331, FOR
7 IMPROVEMENTS TO HIGHWAY 10 (CANTRELL ROAD), FROM
8 INTERSTATE 430 TO SAM PECK ROAD; AND FOR OTHER PURPOSES.

10 WHEREAS,the Arkansas State Highway Commission is undertaking a project to improve Highway 10
II (Cantrell Road),from Interstate 430 to Sam Peck Road; and,
12 WHEREAS,these road improvements necessitate that the Arkansas Department of Transportation acquire
13 a Temporary Construction Easement more particularly described as Tract E- I for Job No. 061331;and,
14 WHEREAS,the City Board of Directors have determined that it is in the best interest of the City to sell
15 the Temporary Construction Easement to the Arkansas State Highway Commission for the road improvements
16 to Highway 10(Cantrell Road).
17 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
18 LITTLE ROCK,ARKANSAS:
19 Section 1. That the Mayor and City Clerk are hereby authorized to execute,in a form approved by the City
20 Attorney,any sales contracts and documents required to convey to the Arkansas State Highway Commission a
21 Temporary Construction Easement more particularly described as Tract E-I for Job No. 061331.
22 Section 2. Severability. In the event any section,subsection,subdivision,paragraph,subparagraph,item,
23 sentence,clause, phrase,or word of this resolution is declared or adjudged to be invalid or unconstitutional,
24 such declaration or adjudication shall not affect the remaining provisions of this resolution,as if such invalid
25 or unconstitutional provision was not originally a part of this resolution.
26 Section 3. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this
27 resolution are hereby repealed to the extent of such inconsistency.
