3 A RESOLUTION TO AUTHORIZE THE MAYOR AND CITY CLERK TO
4 EXECUTE A CONTRACT WITH THE ARKANSAS STATE HIGHWAY
5 COMMISSION TO SELL APPROXIMATELY 0.07 ACRES OF PROPERTY
6 LOCATED IN PART OF THE SOUTHWEST QUARTER OF THE
7 NORTHEAST QUARTER OF SECTION 21,TOWNSHIP 2 NORTH,RANGE
8 13 WEST, PULASKI COUNTY, ARKANSAS, FOR IMPROVEMENTS TO
9 HIGHWAY 10 (CANTRELL ROAD), FROM INTERSTATE 430 TO SAM
10 PECK ROAD; AND FOR OTHER PURPOSES.

12 WHEREAS,the Arkansas State Highway Commission is undertaking a project to improve Highway 10
13 (Cantrell Road),from Interstate 430 to Sam Peck Road to alleviate traffic congestion and make traveling along
14 Cantrell Road safer,quicker and more efficient;and,
15 WHEREAS, these road improvements necessitate that the Arkansas Department of Transportation
16 (ArDOT) acquire approximately 0.07 acres, more or less, as described and shown on plans prepared by
17 ArDOT and referenced as Job No. 061331 and located in part of the Southwest Quarter of the Northeast
18 Quarter of Section 21,Township 2 North, Range 13 West, Pulaski County, Arkansas; and,
19 WHEREAS,the City Board of Directors have determined that it is in the best interests of the City to sell
20 the property to the Arkansas State Highway Commission for the road improvements to Highway 10(Cantrell
21 Road).
22 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
23 LITTLE ROCK,ARKANSAS:
24 Section 1. That the Mayor and City Clerk are hereby authorized to execute,in a form approved by the City
25 Attorney,any sales contracts and documents required to convey to the Arkansas State Highway Commission
26 the real property described as follows:
27 Part of the Northwest Quarter of Section 21, Township 2 North, Range 13 West, Pulaski
28 County, Arkansas, more particularly described as follows: Commencing at a 1-inch
29 aluminum right-of-way monument, said point being on the northerly right-of-way line of
30 Arkansas State Highway 10(Cantrell Road)as established by 60290;thence South 37°54'45"
31 east along said right-of-way line a distance of 49.30 feet to a point;thence South 75°50'45"
32 east along said right-of-way line a distance of 68.76 feet to the POINT OF BEGINNING;

1 thence North 01°57'25"East a distance of 62.70 feet to a point on the northeasterly right-of-
2 way line of Arkansas State Highway 10 (Cantrell Road) as established by ArDOT Job No.
3 061331;thence South 81°18'40"East along said right-of-way line a distance of 56.00 feet to
4 a point; thence South 17°29'46" West a distance of 66.73 feet to a point on the northerly
5 right-of-way line of Arkansas State Highway 10 (Cantrell Road) as established by 60290;
6 thence North 75°50'36"West along said right-of-way line a distance of 15.66 feet a point;
7 thence North 75°50'45"West along said right-of-way line a distance of 22.94 feet to the point
8 of beginning and containing 0.07 acres, more or less, as shown on plans prepared by the
9 ArDOT and referenced as Job No. 061331.
10 Section 2. Severability. In the event any title,section,paragraph,item,sentence,clause,phrase,or word
11 of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication
12 shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the
13 portion so declared or adjudged invalid or unconstitutional were not originally a part of the resolution.
14 Section 3. Repealer. All laws,ordinances,resolutions,or parts of the same,that are inconsistent with the
15 provisions of this resolution,are hereby repealed to the extent of such inconsistency.
