For him, the switch from.Transition to Suburban Office is an academic discussion. His zoning of PDO does not change. What would change is the long term plan, what we call the Future Land Use Plan,. which would be=,changed to more adequately reflect the current and what we thinkwillbe the long term use of the land (office). His block is diagonally hatched east of Sam Peck. He is welcome to attend the public meeting, but is not required to do so. We do televise it starting at 6:00 pm on the local access channel on Comcast cable. As you noted, this property has been designated "Transitional" for more than a decade ever since the Winson Road / Hwy 10 intersection was designated a "Node" for commercial development. We were opposed at first, because this has been our primary residence for almost 30 years. None of the current businesses were there when we first moved in, and we have continued to live here watching more and more commercialization take place in spite of our objections. We have now given upon the idea of preserving the residential nature of our property. We are currently surrounded on the East, South, and West with Banks, Hardware, Restaurant, Shops, and soon-to-be Pharmacy/drug store with six additional shops, two additional banks, and some type of remodeled market directly across Hwy 10. Our children are now grown and have left home, our old horse has died, I have retired from my work and am hoping to sell my home for commercial development sometime in the near future to provide my retirement income. It seems to me that a more appropriate designation from your list of land use categories would be "Mixed Use"(MX) or "Mixed Use Urban" (MXII) or "Node" if the definitions are accurate. We request a designation to facilitate our possible sale of our home for a commercial use and since we were told at a planning board meeting years ago that HiasonlHwy 10 was a "Node". We are not developers and have no hidden agenda, but we are hoping for a favorable designation for possible resale. The parcel in question is approximately 7.2 acres plus or minus in size and lies directly behind Caper's Restaurant and continues westward approximately 6631.f. to the northwest corner of the Springway Addition that contains the shopping area for Fuller & Son, etc. Two maps are attached for your review of this parcel of property. I would also like to direct your attention to the floodway easement that serves as this parcel's northern and eastern boundary. This easement, which can never be developed, has a width that varies from a minimum of 100' to 200' in width, and serves as a continuous and perpetual buffer to the Pinnacle Valley Road area and any single family homes. The property owner listed above is opposed to any land use plan that removes this parcel from Transition and places it in Single Family. The Highway 10 Land Use Plan was developed years ago to provide for an orderly growth westward that would maintain and preserve residential areas while promoting the obvious expansion of commercial and office development into areas that would be suitable for such developments. This parcel was designated "Transition" specifically because of its location at or near an existing "commercial" node or area which has the shopping center referenced above, Kroger's, Caper's, and several banks in this area. Page 2 Transition areas were developed to provide an orderly transition between residential uses and other more intense uses. The more intense use referred to here is the commercial development referenced above which serves as this property's southern boundary. Some form of development other than single family residential is far more appropriate directly adjacent to commercial uses. Compatible uses that may be considered are low-density multi -family residential uses as well as office uses that are compatible with the quality of life in nearby residential areas. I would submit to you that there are no current nearby residential areas that are not well buffered by the floodway easement listed above. Because of this properties' location adjacent to commercial usage on the south, and buffered easements on the east and north, we believe a more suitable land use designation would be for a mixed use development of offices and commercial (MOC). Recently, the Planning Commission approved a development that adjoins this properties' southwestern corner for the construction of a Walgreen's Drug Store. The two parcels involved in the WalGreen Development were Zoned C-3 and R-2. The land use plan had a very small portion of the C-3 property as Commercial with the balance located in the Transition area of the land use plan (more than 80%). We see no reason that the property owned by the Converse's should not be afforded the same treatment and request a land use plan amendment change to MOC. We strongly disagree that the Suburban Office category is more appropriate for the subject property and request that the current Transition Zone classification for the property be retained. The proposed Suburban Office change would adversely affect the longer-term uses forthe property envisioned in our 1994 POD zoning process. I have personally talked with a number of other property owners along Cantrell Road from Rummel Road east to near the proposed Walgreen's site at Taylor Loop Road. Several have expressed the same concern that the proposed changes will result in additional development restrictions and limit future uses as compared to the current classification. By copy of this letter, I am urging other affected property owners to contact you at 371-4790 to express any concerns they may have on the proposed Land Use Plan change and, further, to consider attending the Planning Commission meeting on January 9th to further input on the proposed change. As I understand it, the Department of Planning and Development recommends the changing of our property description from Transition to Public Imitutiumd. One of our companies, Independent Air Conditioning, N a residential and commercial treating and air conditioning service company that has been located at 12417 Cantrell location since July 1976. It has operated in that capacit;/ since then. it is strictly a quiet commercial use of the property, and I feel, after re iciving the categories you sent, that it should be described as "C" Commercial not Public Institutional. It is not a "public and quasi -public" facility but is described as " retail and wholesale ofproducts, personal and professional services, and general business activides." I very much object to the suggestion that the "more appropriate Land Use" category should be Public Institutional. That doesn't fvyis at all. It should be "C" Commercial. For several months, the Lusk family has contemplated a potential development plan for the property.. They have engaged the services of a real estate firm and civil engineer. As you may know, there is an abundant amount of undeveloped office -zoned property, particularly along the Highway 10 corridor. In summary, on behalf of the ownership, we strongly oppose any change in the current Land Use Plan and see no reason to modify it at this time. I am writing in regard to this matter for two reasons: 1. I strongly support the Staff's position which is in opposition to the changes for Areas 3, 4, 6, 7, 10, 15, 16, 19, 22, and 26. The proposed changes should not be made for these areas for many reasons including those expressed in the subject memorandum. 2. 1 am disappointed in the process that has been followed here. It seems to me that any proposed changes in the Master Land Use Plan should be the product of a more widespread and comprehensive process than has been utilized in this instance. I understand various neighborhood groups, in part, instigated these changes. However, in spite of the routine notification process, property owners whose values are materially affected by these changes have had limited opportunity to provide input regarding the proposed changes. My strong suggestion is that any future wholesale changes to a Master Land Use Plan be part of a much broader process where there is involvement at the outset from property owners as well as neighborhood associations. I would appreciate your help in making these views known to the Planning Commission and the balance of the Staff. Sincerely, James E. It seems to me that when you look at a piece of land you would take into account what use that land has had in the past. Our land has been commercial property for more than 50 years. Before there was a land use plan, our property was commercial. It originally was a furniture store. For a few years it was a church and since we have owned the land it had been an antique store owned by us and then rented by Hogan's Antiques and is currently rented by Caper's Restaurant. I realize that it is currently in a transition zone and we currently have a PCD for Caper's, but it makes more sense that if you are going to redo a plan that you look at it's past history. Also, in keeping with the land around us to the west and south, it has all been made commercial beginning with Springer Plaza and not continuing with Walgreen's. I am definitely in favor of a land use plan so that Hwy. 10 does not become another Rodney Parham but why would you take a piece of land that has been residential always and make it commercial and then take another piece of land that has always been commercial and make it suburban office? I would suggest you take another look at the new proposed land use. If it could not be changed to commercial, then I would be in favor of leaving it the way it is. Specifically, we own a tract of land of about 4.1 acres located immediately West of the existing commercial building owned by Vogel Enterprises located at Highway 10 at East Taylor Loop Road, and fronting onto the South side of Highway 10. Your letter indicated that the City is considering a revision to the land use category from its current classification as Transition Zone to the Suburban Office planning classification. We strongly oppose the proposed change in the land use plan, and urge the Planning Staff and Planning Commission of the City of Little Rock to reject this proposed change. It is our understanding that the Transition classification allows either retail or office uses while the Suburban Office classification allows only office uses. It is also our understanding that the area at or near the intersection of the Highway 10 and Taylor Loop Road has been designated as one of the few "retail nodes" on Highway 10 from I-430 to Chenal/Highway 300. The former Harvest Foods store next door to the east has closed but it is our further understanding that the ownership of that building has filed an application to increase the number of retail or C-3 type uses which are to be allowed there. Walgreen's is planning a new store on the north side of Highway 10. It is clear that our property is located within an area which is a retail/commercial node with new retail/commercial activity either confirmed or highly likely. It would therefore seem unreasonable to adopt a new land use category which would eliminate retail/commercial uses. Further, we have attempted to market our property for about 15 years, and can attest to the fact that there has been no serious or legitimate interest in pursuing any office uses, suburban office included. We desire to sell our property, and we believe that such a revision in the Master Land Use Plan would present a significant impediment and would cause the value of our property to be significantly reduced and would foreclose our ability to sell the property for its most logical and reasonable use. Mining uses will include assurances that these resources be properly managed so as not to create a hazard, nuisance or the disfigurement or pollution of the land.= PK/OS Park/Open Space This category includes all public parks, recreation facilities, greenbelts, flood plains, and other designated open space and recreational land. PI Public/Institutional - This category includes public and quasi -public facilities that provide a variety of services to the community such as schools, libraries, fire stations, churches, utility substations, and hospitals. T Transition - Transition is a land use plan designation that provides for an orderly transition between residential uses and other more intense uses. Transition was established to deal with areas which contain zoned residential uses'and nonconforming nonresidential uses. I would submit to you that there are no current nearby residential areas that are not well buffered by the floodway easement listed above. Because of this properties' location adjacent to commercial usage on the south, and buffered easements on the east and north, we believe a more suitable land use designation would be for a mixed use development of offices and commercial (MOC). Recently, the Planning Commission approved a development that adjoins this properties' southwestern corner for the construction of a Walgreen's Drug Store. The two parcels involved in the WalCrreen Development were Zoned C-3 and R-2. The land use plan had a very small portion of the C-3 property as Commercial with the balance located in the Transition area of the land use plan (more than 80%). We see no reason that the property owned by the Converse's should not be afforded the same treatment and request a land use plan amendment change to MOC. I strongly support the Staff's position which is in opposition to the changes for Areas 3, 4, 6, 7, 10, 15, 16, 19, 22, and 26. The proposed changes should not be made for these areas for many reasons including those expressed in the subject memorandum. 2. 1 am disappointed in the process that has been followed here. It seems to me that any proposed changes in the Master Land Use Plan should be the product of a more widespread and comprehensive process than has been utilized in this instance. I understand various neighborhood groups, in part, instigated these changes. However, in spite of the routine notification process, property owners whose values are materially affected by these changes have had limited opportunity to provide input regarding the proposed changes. My strong suggestion is that any future wholesale changes to a Master Land Use Plan be part of a much broader process where there is involvement at the outset from property owners as well as neighborhood associations. The proposed change was from Commercial to Suburban Office. It was the intent of the neighborhood action plan committee to propose to change the classification of the land south of the existing PCD from Commercial to Suburban Office on the Future Land Use Plan. The graphics that were prepared were based on the GIS maps of the zoning and future land use plans. Those graphics do that: show the area south of the PCD as the area to be considered. When the zoning file was pulled for the PCD and the survey provided was checked against the GIS maps, it was discovered that the area in question was actually included in the PCD zoned land. Therefore, the portion of the Land Use Plan amendment located on Fairview Road from Commercial to Suburban office will be withdrawn.
