Mr. Minyard,
Last week I received notice of a public hearing to discuss a request to change the 200 block
of McKinley Street from 'Single Family' to 'Suburban Office'. I own the property at 209 North
Plaza Drive that is west of the 200 block of McKinley Street.
Before making my comments on this request, I would appreciate it if you could answer some
questions for me:
What type of businesses qualify for'Suburban Office'?
Can 'Suburban Office' be a multistory structure?
Are there any guidelines that the property owner must follow in regards to the placement of
buildings/parking on the property?
Does the Planning Commission require or consider information in regards to the potential
impact on neighborhood property?
Does the Planning Commission require or consider information pertaining to the availability of
office space in the general vicinity?

The land use plan category of Suburban Office provides for low intensity development of office or
office parks inclose proxinno N Inwer density residential areas to assure compatlbiRy. A
Planned Zoning District Is required A PZO requires that the applicant show, for example', where
Me building, parking loft, lighting, truncates. screening, buffers, etl are to be located as well as
hours of operational type of business etc. Some examples of businesses that have been placed
in suburban office are read estate agencies, dentist of Gas, insurance agencies and general office
complexes. A Malb-story building can be placed in Suburban ORrce. The Planning commission
does consider the Impact on neighboring properties.

I spoke to you on the phone last week about the rezoning and new zoning development for the
above mentioned property. My name is Charles McCarty and my brother and I indirectly own the
house at 205 No Plaza Dr which is behind the McKinly house. I say indirectly because the
property is still in my deceased fathers name. My parents bought that house new in the summer
of 1959. My daughter still lives in that house.
I was planning on attending the planning commission meeting today but have a conflict. I decided
to send you this note in case I could not attend the meeting.
My understanding is that the property is zoned residential with a conditional use permit for a day
car center that has been closed for around a year. It is also my understanding that the owners
wish to rezone the property as suburban office or quiet business in order to establish a birthing
center. I understood you to say that this center would not be open 24 hours a day, but the more I
have thought about this I can't understand the service being offered unless it does offer 24 hour a
day service. The definition of a birthing center according to my health insurance policy is that it is
a licensed or certified institution which meets several criteria, one of which is; providing 24 hour a
day nursing service. Maybe I just need a clarification but if it is open 24 hours a day , what is the
noise level? We would still probably not oppose the conditional use permit being modified to
allow the birthing center based on the information that you provided me. That is, the use of
existing parking. I possibly am oppposed to allowing them to add on to the second story on the
McKinley side, for no other reason than that might set a precedent to allow a multiple story
building should the house be torn down.
As you can probably tell we are mildly opposed to the rezoning of the property because as you
mentioned, they could build a new building. I am concerned over the building height, distance
from our property line, and placement of parking, just to name a few.

Baseline approved on 5/16/00. The other one is at 212 North McKinley that was
