A' RESOLUTION AUTHORIZING THE CITY MANAGER TO

ENTER INTO AN AGREEMENT WITH STORER

COMMUNICATIONS, INC., CONCERNING THE CITY'S
6
RELEASE OF THE FINE ARTS ACCESS CHANNEL FOR
7
THE BALANCE OF THE CURRENT CABLE TELEVISION

FRANCHISE PERIOD, AND FOR OTHER PURPOSES.

WHEREAS, the City of Little Rock, Arkansas ( "City ") entered
11
into a cable television franchise with Riverside Cable TV, Inc.
12
also known as Storer Cable Communications, Inc. ( "Storer "), on
13
February 19, 1980, for a nonexclusive cable television franchise
14
( "the Franchise ") that runs until February 19, 1995; and,
15
WHEREAS, the Franchise requires Storer to, among other
16
things, provide a non - leased access channel for Fine Arts
17
programming; and

WHEREAS, this channel has been totally underutilized and
19
Storer wishes to use the channel for leased access and has
20
proposed a contractual arrangement to purchase from the City the
21
right to use the channel for the balance of this initial
22
franchise period.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
24
THE CITY OF LITTLE ROCK, ARKANSAS:

SECTION 1: The City Manager is authorized to enter into an
26
agreement with Storer for the purchase by Storer of the right to
27
exclusively use or lease the Fine Arts Access Channel for the
28
balance of the current franchise period, and any extension,
29
pursuant to terms in substantially the same form as the Attached
30
Exhibit A.

SECTION 2. This authorization is conditioned upon the
32
mutual understanding that nothing in this agreement prevents or
33
diminishes the ability of the City to negotiate for additional
34
public, educational or governmental access channels during the
35
franchise renewal process.

SECTION 3. The funds collected from Storer for this channel
shall be used solely for the City's cable television station.
