Thank you for visiting with me in your office during my recent trip to Little Rock, and also for
the time you have spent with me on the telephone. You have already been of great assistance
helping me work my way through the steps I must take to obtain a rezoning of this lot from R3
with a variance to C3.
At your suggestion, I have spoken with Brian Minyard regarding the designated use of this lot
under the Future Land Use Plan. Mr. Minyard informed me that the lot is designated "office"
on the plan, and that I would need to submit an Application for a Land Use Amendment to be
considered at the same time as the Application for Rezoning. It is completed and enclosed with
the necessary supporting documents.
REGARDING THE APPLICATION FOR REZONING:
This lot is on the SW corner of a busy north south thoroughfare (Van Buren) and a residential
street ("A"). A Street for many years has served as the dividing line between commercial and
residential properties. On February 6, 2003, twelve of the 16 lots in this block were rezoned
from 0 (11 lots) and R3 (1 lot) to Planned Commercial Development (PCD) to accommodate
the redevelopment of the old Markham Inn. Three lots (9, 10 & 11) are zoned C3. This lot is
zoned R3. It is now the only lot of the 16 lots in Block 7 that remains residentially zoned.
Rezoning is being requested because the lot has had no appeal to the general public for
residential purposes for almost ten years. It has not been used for residential purposes since
May 1993. The noise and traffic on Van Buren make the lot undesirable for a residence. I
bought the property in September 1999 and converted it to a parking lot for the building my
family owns south across the alley on adjoining Lot 9. The highest and best use of this lot is to
incorporate it into the existing commercial development that now completely surrounds it. It is
for these reasons that I am seeking to have the lot rezoned from R3 to C3.
Enclosed with this letter you will find:
• Application For Rezoning completed as we discussed;
• Street Right -of -Way Agreement completed as we discussed;
• Six copies of a survey by 011en Dee Wilson dated September 2,1999; and
• Check number 1429 made payable to the City of Little Rock for the $225.00 filing fee.
Please see that I have written a note on the Street Right -of -Way Agreement regarding my
previous agreement to dedicate any needed right-of-way. To obtain the variance in 1999 to use
this residential lot for parking required a right of way dedication and landscaping buffer that
decreased the effective lot size by 1,864 square feet or 31.4% of the surface area. I remain willing
to dedicate this same area and I assume the requirement is the same as before.
REGARDING THE APPLICATION FOR A LAND USE AMENDMENT:
As stated above, this single lot is currently designated for office use under the Future Land Use
Plan. Prior to my purchase of the lot in 1999, an attempt to change its zoning to office failed
because the owner was unwilling to agree to any dedication of any needed right-of-way, and
because the lot by itself was and is too small to support a new office development with the
required parking spaces.
Furthermore, there was then and there is now no contiguous land in the block to acquire for
additional parking. For this reason, it is improbable if not impossible to consider the
redevelopment of this Lot 8 by itself. From a practical standpoint, Lot 8 since I acquired it has
been and most likely always will be considered as one property with its adjoining Lot 9. I can
not envision a circumstance where either lot would be available for development by itself. For
this reason, I am asking that the Future Land Use Plan be amended to designate this lot for
commercial use, the same use now available for every other lot in the block. This will not
disturb the historical division of commercial and residential uses at A Street, and it will correct
the zoning inequity that now exists between this lot and the other 15 lots in the block.
As we discussed, I would appreciate your passing of the forms for a land use amendment to
Mr. Minyard. Also enclosed with this letter are the items he indicated I needed to provide for
this Application:

• Three copies of a survey by 011en Dee Wilson dated September 2,1999; and
• Check number 1430 made payable to the City of Little Rock for the $60.00 fee.
While I believe I have submitted everything required at this time, I would be grateful for both
your and Mr. Minyard's review and examination of the enclosures. I can be reached at the
numbers above. If I need to submit anything else, please let me know.
I believe all that remains for me to do is:
• Mail out the Notice of Public Hearing by certified mail postmarked no later fifteen (15)
days before the April 3, 2003 meeting date;
• Provide your office with the required Notice of Public Hearing with Affidavit and
supporting exhibits no later six (6) calendar days before the April 3, 2003 meeting date;
• Post the Rezoning and Land Use signs on the property not later than thirty (30) days
before the meeting date; and
• Show up for the meeting at 4:00 PM on Thursday, April 3, 2003. It will be held in the
Little Rock Board of Directors Chamber, 2'd Floor, City Hall, 500 West Markham Street.

I look forward to hearing from you soon. Again, I wish to thank both you and Mr. Minyard
for your assistance to date. I am hoping for a favorable staff recommendation for both the
rezoning and land use amendment. Approval of these requests will recognize Lot 8's current
use and the public's perception of its zoning. It will also correct the unequal zoning condition
and land use designation of the last residential lot in the block.
After we next speak, I will ask Ms. Tracey D. Perry to go to your office and that of Mr. Minyard
to pick up the two signs that must be posted on the property. I look forward to speaking with
