This property is located on the south side of Asher Avenue,
approximately 500 feet east of its intersection with Western
Hills Avenue.
2. Compatibility with Neighborhood
The uses and zoning in this area are extremely varied,
ranging from single family residences to an I-2 zoned,
trailer manufacturing facility.
The zoning abutting this site is C-3, I-2 and a 50 foot
buffer which separates the site from residences located to
the south.
The applicant is a subcontractor for Arkla Gas. The
materials for each project are generally supplied by the
utility company and placed on the job site. The applicant
states that there may occasionally be some short term
storage of material for a particular project, but there will
typically be no inventory of materials kept at this site.
Any materials kept at this site are kept in one of the
existing "shed -type" metal buildings. There will be no
outside storage of materials. The applicant has stated that
the primary use of the contractor's maintenance yard will be
as a place to park his trucks, trailers and equipment.
The proposed use should be compatible with the other uses in
the immediate neighborhood.

3. on -Sit Drives and Parkin
A paved parking lot is located in front of the main
building. This is used by customers of the gun shop.
Beyond a metal, security fence, an existing gravel parking
lot extends beside and to the rear of the main building.
The proposed contractor's maintenance yard is located on
this portion of the site. The proposed use generates no
customer traffic which would enter this area.
4. Screening and Buffers
The applicant is proposing no site improvements. This
applicant will occupy a portion of the existing building and
will use an area of the former lumber storage yard to park
his trucks and equipment. There will be no outside storage
of materials, as such no additional screening or buffering
is required.
5. City Engineer Comments
Any needed right-of-way on Asher Avenue will be required
through the rezoning (Item No. 22, File No. Z -3117-C).
6. Utility Comments
Water Works reports that on-site fire protection will be
required. Confirm the requirement and the location of the
hydrant with the Fire Department.

This site was formerly occupied by a home center/lumber
yard. The main building is currently occupied by a gun shop
and will continue as such. The applicant 'uses the rear
portion of the property, which once was the lumber storage
yard, as a place to park his vehicles and equipment. A

although most materials are delivered directly to each job

Roy Tobey was present representing Tarcon.
Dana Carney, of the Planning staff, presented the item and
outlined the City Engineer and Utility Comments noted above.
It was explained that any needed right-of-way on Asher Avenue
would be required through the rezoning (Item No. 22, File No.
Z -3117-C).
A brief discussion followed concerning the proposed contractor's
yard.
Mr. Tobey explained that there would be no outside storage of
materials, that he needed a place to park his trucks and
equipment. He stated that some materials would be kept in one of
the shed -type buildings, but most of the materials are delivered
directly to the job sites.
It was determined that there were no outstanding issues attendant
to the conditional use permit application and this item was
forwarded to the full Commission for final resolution.

STAFF ANALYSIS
7415 Asher Avenue is zoned C-3, and the request is to rezone
5 acres to C-4. Currently, there is a retail gun shop on
the property and the proposal is to allow a portion of the
site to be utilized by a contractor for a storage or
maintenance yard. The gun shop use, with an indoor shooting
range, will remain and is not an issue. For the
contractor's yard to use the location, the property must be
rezoned to C-4 and have a conditional use permit approved.
(Item No. 16 on this agenda is the conditional use permit
request.) There are several buildings on the property and
the majority of the site is paved. The land has 286 feet of
frontage on Asher and a depth of approximately 900 feet.
Along the rear of the property, there is an OS area that
will not be affected by this rezoning request.
zoning in the general vicinity is R-2, R-3, R-5, MF -6,
MF -12, MF -18, 0-2, 0-3, C-3, C-4, I-2 and OS. The site in
question abuts C-3, I-2 and OS. The nonresidential
properties along Asher Avenue are zoned 0-2, C-3, C-4 and
I-2. Wilson School, which is directly across Asher Avenue,
is zoned R-3. Land use is similar to the existing zoning
and includes single family, a day care center, commercial,
industrial, a business school, Wilson Elementary School, a
post office facility and a golf course. The uses along the
south side of Asher Avenue range from a day care center to
industrial. There are also some undeveloped tracts found
throughout the neighborhood.

Over the years, the City has endorsed a zoning configuration
of C-3, C-4 and I-2 along most of Asher and the area under
consideration is no exception. Reclassifying 7415 Asher to
C-4 reinforces the existing zoning pattern and should not
have an impact on the nearby properties. The proposed
rezoning conforms to the adopted land use plan and there is
no plan issue.
LAND USE PLAN ELEMENT
The site is in the Boyle,Park District and is recommended
for commercial. The request is in conformance with the
plan.
Asher Avenue requires a right-of-way of 45 feet from the
centerline. If the existing right-of-way is deficient,
dedication of additional right-of-way will be required.
STAFF RECOMMENDATION
Staff recommends approval of the C-4 rezoning as requested.
PLANNING COMMISSION ACTION: (NOVEMBER 16, 1993)
The applicant was present. There were no objectors, and the
item was placed on the Consent Agenda. The Planning
Commission voted to recommend approval of the C-4. The vote

Board of Directors; and (b, c, d, e, f, and g,) Resolutions No.
9,056, 9,057, 9,058, 9,059, 9,060, and 9,061 were read in full
and adopted by unanimous voice vote of the Board Members present.
At the time allotted for Citizen Communications, Mr. Benny
Johnson, 1805 West 18th Street, was the only person to appear.
Mayor Dailey introduced Mr. Johnson and commended him for his
involvement in the "Stop the Violence" Program. Mr. Johnson
works with the youth of the community and security at Central
High School. He presented Mayor Dailey and Director Lewellan
with Certificates of Appreciation for their devoted and valuable
service to the "Stop the Violence" Program. Mayor Dailey
suggested that Mr. Johnson visit with the other Board Members and
explain the benefits of the program, so that they too, can become
involved.
On December 7, 1993, a proposed Ordinance was read the first
time to rezone 5 acres at 7415 Asher Avenue, from 11C-3" General
Commercial District to "C-4" Open Display District. The zoning
application Z -3117-C, was filed by Mr. Roy C. Tobey for Franklin
T. Sipes, and was approved by the Planning Commission on November
16, 1993. After the first reading, Director Joyce stated that
due to some concerns of the neighborhood, she would like more
information; therefore, the proposed Ordinance remained on the
calendar for second reading (see Minute Record of 12-7-93).
Before the Ordinance was read the second time, Mayor Dailey asked
for discussion and mentioned possible amendments might be
necessary. Mr. Mike Kumpuris, representing the Westwood Property
Owners Association, advised that zoning from 11C-3" to 11C-4" would
not be acceptable to the neighborhood, and to the appearance of
Asher Avenue. However, he did say that after a meeting with Mr.
Lawson, Director of Neighborhoods and Planning, and City Director
Linda Joyce, that a "PCD" would be acceptable. Mr. Lawson
recapped the zoning proposal stating the neighborhood was
concerned with 11C-4" zoning and a "PCD"' was agreed upon. Mr.
David Overton, 10 Valley Court, had questions about where trucks
and equipment would be parked and Mr. Lawson advised the "PCD"
would address those conditions. Mr. Roy Tobey, 10 Laver Circle,
representing the applicant, advised that a meeting was held with
the neighborhood group and a mutual agreement had been worked out
for a "PCD" Development. Director Joyce expressed appreciation
to Mr. Tobey and Mr. Sipes for their cooperation in arriving at
an agreement. Upon question by Mayor Dailey, Mr. Tom Carpenter,
City Attorney, advised that a motion to amend the proposed
Ordinance, read the first time on December 7th, would be in
order. A motion was then made by Director Sharpj, seconded by
Director Priest„ to amend the Ordinance to establish a "PCD"
District. The motion was unanimously adopted by the Board
Members present. Ordinance No. 16,540, as amended, was then
presented, entitled:

None. Whereupon, the Ordinance, as amended, was declared PASSED.

The next presentation was Ordinance No. 16,541, with the
title being:
AN ORDINANCE TO AMEND THE CITY LAND USE PLAN IN THE PINNACLE
DISTRICT, LOCATED NORTH OF HIGHWAY 10 AND EAST OF HIGHWAY 300,
FROM SINGLE-FAMILY TO OFFICE AND MULTIFAMILY; AND FOR OTHER
PURPOSES;
and there was a third and final reading of the Ordinance, having
been read the first time on November 16, 1993, and the second
reading occurred on December 7, 1993. There was no discussion
and a roll call vote was taken on passage of the Ordinance with
the results recorded as follows: Ayes - Directors Priest, Sharp,
Lewellen, Mason, Mayor Dailey, Directors Hendrix, Scheibner, Keck
and Joyce - total 9; Noes - Director Adcock - total 1; Absent -
Director Roy - total 1. Therefore, the Ordinance was declared
PASSED.
Ordinance No. 16,542, a companion proposal to the Ordinance
above, was next considered, described as:
AN ORDINANCE RECLASSIFYING PROPERTY LOCATED IN THE CITY OF
LITTLE ROCK, ARKANSAS, AMENDING SECTION 36 OF THE CODE OF
ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER
PURPOSES;
(2-5099-A - To rezone 68.79 acres at Highway 10, Highway 300 and
Chenal Parkway from "R-21" Single-family, "C-211 Shopping Center
and 110-3" General Office Districts to "MF -18 Multifamily, '110-3"
General Office and "C-3" General Commercial Districts.)
with the Ordinance being read the third and last time, having
been read the first time on November 16, 1993, and the Ordinance
was read the second time on December 7, 1993. No further
discussion occurred and the roll call vote taken on passage of
the Ordinance is recorded as follows: Ayes - Directors Priest,
Sharp, Lewellen, Mason, Mayor Dailey, Directors Hendrix,
Scheibner, Keck and Joyce - total 9; Noes - Director Adcock -
total 1; Absent - Director Roy - total 1. The Ordinance was
declared PASSED.
Consideration was then given to Ordinance No. 16,543,
containing the following title:
AN ORDINANCE TO AMEND THE CITY LAND USE PLAN IN THE CENTRAL
CITY DISTRICT IN AN AREA FROM 22ND TO 26TH STREETS AND IZARD TO
MAIN, AND FOR OTHER PURPOSES;
and the Ordinance was read the first time. There was a motion
and second by Directors Priest and Mason, respectively, to
suspend the rules and place the Ordinance on second reading. The
motion was unanimously adopted by the Board Members present,
being ten in number and two-thirds or more of the members of the
Board of Directors -elect, and there was a second reading of the
Ordinance. There was a subsequent motion made by Director Priest
to again suspend the rules and place the Ordinance on third and

AN ORDINANCE APPROVING A PLANNED UNIT DEVELOPMENT
AND ESTABLISHING A PLANNED COMMERCIAL DEVELOPMENT
DISTRICT TITLED SIPES SHORT -FORM PCD (Z -3117-E),
LOCATED AT 7415 ASHER AVENUE, IN THE CITY OF
LITTLE ROCK, ARKANSAS, AMENDING CHAPTER 36 OF THE
CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK,
ARKANSAS; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That the zone classification of the following
described property be changed from C-3 to PCD.
A parcel of land in Section 13, T -1-N, R -13-W, and located
at 7415 Asher Avenue, Little Rock, Arkansas, being more
particularly described as follows:
Commencing at the Southwest corner of Section 13, thence run
East 458.7' to a point of beginning, thence run N 00029' E
841.01' to a point on the South right -cif -way line of Asher
Avenue, thence run N 56037' E alone said right-of-way line
286.44' to a point, thence run S 00029' W 998.61 to a point,
thence run West 237.6' to the point of beginning, containing
5.0 acres, more or less.
SECTION 2. That the change in zoning and establishment of
the PCD is subject to the following conditions proposed by the
applicant:
(A) The north 335' (measured along the West property line
as shown in the site land survey dated August 18, 1992)
shall retain uses listed as "permitted uses" in the C-
3, General Commercial District, zoning district.
(B) The south 506.01' (measured along the said West
property line), shall be used as a contractor's
maintenance yard for TARCON, INC., Roy C. Tobey,
President, with the following conditions applying:
(1) There is to be no outside storage or display of
materials.
(2) There is to be no permanent storage of inoperative
equipment or vehicles.

(3) Parking of contractor's "rolling stock" is to be
limited to the following numbers and types of
equipment:
(a) six (6) 2 -ton trucks or equivalent
(b) two (2) 1 -tan trucks or equivalent
(c) one (1) 1/2 -ton pick-up truck or equivalent
(d) three (3) backhoe/loader excavators
(e) three (3) portable axle mounted air
compressors

(C) A current survey/site plan is to be provided which
shows all site improvements and shows the width of the
Asher Avenue right-of-way.
(D) Additional Asher Avenue right-of-way is to be dedicated
to the City if the required survey indicates that there
is less than 45' of right-of-way on the south side of
the Asher Avenue center line so that the amount of
right-of-way shall be not less than 45' measured from
the Asher Avenue center line.
(E) The applicant is to comply with the utility comments
which were reported in the Planning Commission agenda
of November 16, 1993.
SECTION 3. That the change in zoning classification
contemplated for SIPES SHoRTb-FORK PCD is conditioned upon
obtaining a final plan approval within the time specified by
Chapter 36, Article VII, Section 36-454(d) of the Code of
Ordinances.
SECTION 4. That the map referred to in Chapter 36 of the
Code of Ordinances of the City of Little Rock, Arkansas, and
designated district map be and it is hereby amended to the extent
and in the respects necessary to affect and designate the change
provided for in Section 1 hereof.
SECTION 5. That this ORDINANCE shall take effect and be in
full force upon final approval of the plan.

AN ORDINANCE APPROVING MODIFICATION TO A
PLANNED ZONING DISTRICT AND PROVIDING FOR
THE ESTABLISHMENT OF A PLANNED ZONING
DEVELOPMENT TITLED SIPES - REVISED SHORT -
FORM PCD (Z -3117-C), LOCATED AT 7415
ASHER AVENUE, IN THE CITY OF LITTLE ROCK,
ARKANSAS, AMENDING ORDINANCE NO. 16,540
AND CHAPTER 36 OF THE CODE OF ORDINANCES
OF THE CITY OF LITTLE ROCK; AND FOR OTHER
PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That Ordinance No. 16,540 passed on December
21, 1993 be amended to provide for modification of the Planned
Zoning Development described as Sipes - Revised Short -Form PCD
(Z -3117--C) ;
SECTION 2. That Section 2, subsection (B) of Ordinance
No. 16,540 be amended as follows:
(B) The South 506.01 feet (measured along the said crest
property line), shall be used for vehicular parking to include
trucks and trailers, with the following conditions applying:
(1) There is to be no outside storage or display
of materials.
(2) There is to be no permanent storage of
inoperative trailers or vehicles.
(3) The two existing metal buildings within this
area are to be used for storage only.
SECTION 3. That the zone classification of the following
described property be changed from PCD to Revised PCD:
A parcel of land in Section 13, T -1-N, R -13-W, and
located at 7415 Asher Avenue, Little Rock, Arkansas,
being more particularly described as follows:
Commencing at the Southwest corner of Section 13, thence
run East 458.7 feet to a point of beginning, thence run
N00029' East 841.01 feet to a point on the South right-
of-way line of Asher Avenue, thence run N56637' East
along said right-of-way line of 286.44 feet to a point,

thence run S00°29' West 998.6 feet to a point, thence run
West 237.6 feet to the point of beginning, containing 5.0
acres, more or less.
SECTION 4. That the map referred to in Chapter 36 of the
Code of ordinances of the City of Little Rock, Arkansas, and
designated district map be and is hereby amended to the extent
and in the respects necessary and affect and designate the
change provided for in Section 3 hereof.
SECTION 5. That this Ordinance shall take effect and be
in full force upon its passage.
