Lowes operated a lumber and hardware business until about 1988. It is zoned C-3, and beside the main building of 25,000 sq. Feet, has 2 smaller buildings in the back of 8,000 sq. Feet each. There is a graveled storage lot in back also ,which has been used for storing of vehicles and merchandise over the years. In looking over this property before buying it, I noted two different areas being used for truck and other vehicle storage: One included dump trucks and construction equipment, obviously being used, and another being used to store new trucks. The contractor equipment belonged to Mr. Roy Toby, while the new trucks were being stored by Davis Trailer & Truck Equipment Co., owned by others, awaiting installation of various types of bodies or equipment. I was informed by Sipes representatives that these companies had rented this space for this use for several years, and in fact talked to both companies, who confirmed this. Davis wanted to continue this arrangement, while Mr. Toby decided to sell his equipment and discontinue his business. I have just now been informed that a special permit was issued for only Mr. Toby's use, and it does not go with the land, as all other P.U.D.'s and zoning permits do. I have spent a considerable amount of money since January of this year cleaning up and repairing fences, roofs, gutters,side walls, etc. Apparently no one since Lowes was in the property had bothered to fix any thing. Sipes bought it in 1992 or 93, and it was rented to some others in the mean time. I have renovated the main building and have a solid tenant in it, with a good lease, and have a couple of tenants in the rear storage buildings. This graveled storage area is excellent for what it is being used. It is low and storm water run off would be greatly aggravated were it paved. It is several hundred feet off Asher Ave., and is not very noticable, especially since your code enforcers have overlooked the new vehicles for about 5 years. I None Staff recommends approval of the revised PCD ordinance. All residences within 300 feet of the site as well as the Westwood and John Barrow Neighborhood Associations were notified of the public hearing. On November 16, 1993, the Planning Commission approved a rezoning of this property from C-3 to C-4 and a conditional use permit for a contractor's maintenance yard within the rear portion of the property. On December 21, 1993, the Board of Directors passed Ordinance No. 16,540, rezoning the property from C-3 to PCD. It was determined by the Board of Directors that the PCD zoning was more appropriate and attached conditions to the rezoning, which included part of the PCD use being for a specific business owner (see Section 2, subsection (B) of the attached original ordinance). This property has recently been sold to Atley G. Davis and the contractor's maintenance yard use by Tarcon, Inc. has been discontinued. Mr. Davis has informed staff that Davis Trailer and Truck Equipment Company has used this rear area for truck and BACKGROUND trailer parking for the past five (5) years. Mr. Davis wishes to CONTINUED continue this use and requests that the original ordinance be amended to allow it. Staff feels that since the Board of Directors rezoned the property to PCD and established the specific conditions of the rezoning, that the revised ordinance request should be brought back directly to the Board and not the Planning Commission. Screening and Buffers The applicant is proposing no site improvements. This applicant will occupy a portion of the existing building and will use an area of the former lumber storage yard to park his trucks and equipment. There will be no outside storage of materials, as such no additional screening or buffering is required. 5. City Engineer Comments Any needed right-of-way on Asher Avenue will be required through the rezoning (Item No. 22, File No. Z -3117-C). 6. Currently, there is a retail gun shop on the property and the proposal is to allow a portion of the site to be utilized by a contractor for a storage or maintenance yard. The gun shop use, with an indoor shooting range, will remain and is not an issue. For the contractor's yard to use the location, the property must be rezoned to C-4 and have a conditional use permit approved. (Item No. 16 on this agenda is the conditional use permit request.) There are several buildings on the property and the majority of the site is paved. The land has 286 feet of frontage on Asher and a depth of approximately 900 feet. Along the rear of the property, there is an OS area that will not be affected by this rezoning request. Zoning in the general vicinity is R-2, R-3, R-5, MF -6, MF -12, MF -18, 0-2, 0-3, C-3, C-4, I-2 and OS. The site in question abuts C-3, I-2 and OS. The nonresidential properties along Asher Avenue are zoned 0-2, C-3, C-4 and I-2. Wilson School, which is directly across Asher Avenue, is zoned R-3. Land use is similar to the existing zoning and includes single family, a day care center, commercial, industrial, a business school, Wilson Elementary School, a Post office facility and a golf course. The uses along the south side of Asher Avenue range from a day care center to industrial. There are also some undeveloped tracts found throughout the neighborhood. November 16, 1993 ITEM NO.: 22 Z -3117-C (Cont.) Over the years, the City has endorsed a zoning configuration of C-3, C-4 and I-2 along most of Asher and the area under consideration is no exception. Reclassifying 7415 Asher to C-4 reinforces the existing zoning pattern and should not have an impact on the nearby properties. The proposed rezoning conforms to the adopted land use plan and there is no plan issue. LAND USE PLAN ELEMENT The site is in the Boyle Park District and is recommended for commercial.
