the Little Rock Planning Commission has to do with the
rezoning of all but the North 100 feet of Tract 26, Leigh:-
Butler Acres, from "F" Commercial and "E-1" Business
District to "G" Commercial District. This property lies
to the south of a portion of Stonegate Addition rear the
dead . end of Southern Oaks Drive and extends to West
65th Street.

Mr. Venhaus stated the Staff's reconnnendation as follows: "The Staff's concern on
this "F" ("G") Connnercial application is restricted to the relationship
between the proposed use and the single family subdivision innnediately to
the north. The applicants have,as Mr. Williams will explain to you,volun-
teered and suggested that they dedicate 100 ft. strip between the actual
car dealership proposed for the property and the adjacent single family
subdivision to the north. I understand that Julius Breckling, Director of
Parks, would be interested in accepting this 100 ft. dedication as a small
neighborhood park for this residential area. That being the case, the Staff would
reconnnend approval of the "F" ("G") Connnercial subject to the 100 ft. property
to the nor~n being dedicated to the public for park purposes as Mr. Williams
has suggested prior to filing the application. 11
Mr. John Williams was present to represent the applicant. He stated that the
recommendation of the Staff was a little bit different from what he had
anticipated in as much as his conference with ·.the Staff and with the land-
owners abutting this 100 ft. strip was to the effect that they would deed
these properties proportionately to the abutting landowners. That is, 100 ft.
green strip with the nice trees on it would be deeded by the purchaser of the
land to Mr. and Mrs. Fluharty, Mr. and Mrs. Walker, Mr. and Mrs. Russell New
and Mr. and Mrs. Lawrence Frye proportionately as their land abuts onto this
100 ft. strip to be kept and used by them as a green strip. I have not dis-
cussed with them that it would be dedicated as a park because I understood
that the City Parks Department had stated that they did ~~ar~ire a small
100 ft. park and this is a new development to me. I am R today prepared
to tell the Commission as I told the Staff earlier and as I have told all
these abutting property owners that we would deed the properties to them to
be used by them. It is a nice green strip with nice oak trees and other
shrubbery on it. I have contacted all property owners within 200 ft. of the
proposed rezoning and none objected to it. We propose to deed' these properties
to these people and trust that the Staff will agree with this recommendation.
Mr. Walker was present in opposition. He said that he lives on the north
side of the subject property. We thought we would be deeded that. We do
not want a park in this area.
The Chairman asked if there was anyone present who opposed this rezoning
whereby you do dedicate this in parts.
Mr. Joe Norton, 7 Timberlane, said he lives about 300 ft. east of subject
property. .I am not directly affected but I am interested in what will
happen to the property east if this goes connnercial.

..._ Chairman stated that that particular property was at present zoned "F"
Connnercial and ''MF 18 ".
Mr. Venhaus said that they did not find out from Mr. Breckling his attitude
toward accepting the area as a park until during the agenda meeting. Our
assumption had been that he probably would not be interested in this small
piece of land and try to develop it for park purposes. He since went
and saw the lovely trees, etc. and changed his mind. We would have·
absolutely no objections to this land being dedicated to the adjacent
property owners. There is a consideration however we would like to inject
that the property be restricted to a permanent open space kind of use, that
the trees not be cut, that the property not be used for structural purposes,
and that it would indeed in the future serve its intended purpose as an
open space area.
A mn~ion was made to approve the application, which was seconded and passed.
