Bartsch 401 West 18th Street Little Rock, Arkansas 72206 August 3, 1972 Planning Commission City Hall Little Rock, Arkansas 72203 Gentlemen: The previous owners of our property at 401 West 18th Street asked for a rezoning from C-2 to D. Their request was denied by the city but was granted by action of the Arkansas Supreme Court. By coincidence, we purchased the property the week of the Supreme Court ruling. The rezoning played no part in our decision to buy. We purchased the house as a single-family dwelling; we have maintained it as a single-family dwelling; It is our intention to retain it as a single-family dwelling. In light of this, we would favor the dezoning of our property back to C-2, which we feel is a more fitting use for land immediately surrounding the governor's mansion. We feel that a restudy of the Broadway area would show the propriety of dezoning not only our property but all F -Commercial property not now serving an F -Commercial usage, an action that would go far toward stabilizing and upgrading the Broadway area as a residential neighborhood. For this reason, we fully support such a study and respectfully request the Planning Commission to undertake it, delaying until the study has been completed its consideration of any further applications for F -Commercial rezoning. The property, however, is Zoned F -Commercial. The rezoning to F -Commercial followed the State Supreme Court ruling in the Andres' case several years ago and has remained as such since that time. The actual use of the property is D -Apartment. In view of a possible restudy of the Broadway area, we would like to state our willingness to request a deaoning of ours property to its actual usage, D -Apartment. We have confi- dence in downtown Little Rock and strongly feel that a stable residential area is in the best interest of the city and, therefore, offer our support of such an area by indicating our willingness to dezone. We also ask to appear in opposition to the application of Mr. W.C. McMirm for the F -Commercial rezoning of property at 1510 Broadway. Mr. McMinn has stated publicly that he wishes to convert the house on this property for use as office space, without altering the external appearance. If it is not going to be "F" Commercial then apply the zoning that ought to be applied on the property. If the determination is made to leave Broadway "F" Commercial in the future, then your "F" Commercial zoning will be automatically done and will not require you to come down here or spend any money or do anything else. It will be automatically done." Mr. McMinn stated they could not object to this. The Chairman asked the objectors if they would object to an "E-1" zoning and the study. Mr. Edward Wright, Jr., attorney for the group, stated that they did not object to the "E-1" zoning or the study. He had two documents, one from the Bartsch family and one from the Nicholson family,which were placed on file. A motion was made for "E-1" zoning. Mr. Putnam stated that first in order was to deny the "F" Commercial zoning requested in the application. A motion was made to deny the "F" Commercial and seconded. Mr. McMinn asked that his application not be denied for "F" and asked for the City Attorney to advise what procedure should be taken. Mr. Whitmore stated that the,By-Laws of the Commission requires action on the application as before them. "The action of the Commission here today will finalize the application." Mr. McMinn asked if they could amend the application to make it "E-111. Mr. Whitmore told him he could amend the application to "E-1". The motion made to deny the "F`° Commercial zoning was withdrawn. A motion was made to rezone the property "E-1", which was seconded and passed. A motion was made that the Staff be instructed to make a land -use study of the area and return their findings at the regular November meeting. Mr. Venhaus stated that "The. Staff would bring the results of the study to you in 60 days and ask for your permission to advertise the zoning recom- mended so the final action would come at the 90 day period." The Chairman restated the motion that the Staff make the study and report in 60 days their findings, which was seconded and passed, Tract No. 2 Z-2608 - 1510 Broadway From: "D" - Apartment District To "F" - Commercial District The Staff's recommendation was read as follows: "The Staff reaffirms its previous recommendations regarding the rezoning of property on Broadway." Mr. Taylor said that there was a group of people at the last Board of Directors' agenda meeting requesting that they have a Staff study. The Board referred -this to the Planning Commission. They were unanimous in their opinion that they want a study made. The Chairman asked the applicant if he would accept an "E-1" Quiet Business. Mr. McMinn, the applicant, stated they would rather not accept "E-1" zoning but if they had to, they would want it only on a temporary basis. They own the entire block with the exception of two lots which is zoned "F" Commercial. They have a tenant who wants to use the building for offices. They don't intend to change the exterior of the building, but still want "F" zoning to go with the rest of the block so they can use it at a future date if they so desire for something else. The Chairman stated that the City Board recommends and the Commission feels a study is certainly in order and to give them 90 days to make the study and return the study for the Commission's approval. He asked the applicant if he would object to this, or would he rather vote on his petition today. Mr. McMinn said that he did not object to a study because they needed some- thing done even if it was on a temporary basis. The Chairman stated that the Commission had no power to recommend anything on a temporary basis. Mr. Venhaus made the following statements: "First, let me recommend that we zone this particular property under consideration to "E-1" Quiet Business which will allow the applicants to proceed with the developments they presently have underway and will not affect the use of their property in the near future in any way. Secondly, we perform a land -use study on Broadway, Roosevelt to the south, 14th Street to the north, Louisiana Street to the east, and High Street to the west and based on the conclusions of this study then if it is found that the "F'; Commercial zoning is not appropriate then the same conclusions would be applied to this property as other properties in the study boundaries. If "F" Commercial is found to be appropriate for this property then I would think it would be desirable for the Planning Commission in either case to recommend the rezoning of this area to whatever is suaaested.
