A motion was made for approval of the minutes of the meeting on May 4,191 2, and of the special ;meeting on May 11, 1972, which was seconded and passed. "F" -Commercial District .:y The applicant, Mrs. Lula Mae Ellison was present. Mr. Venhaus explained the Staff's position on this application. He said through -the .efforts of the Housing Authority 5 and the Neighborhood Development Program in this area, there has been developed arld adopted a land use plan for all this r esidential area which calls for the area to remain single-family residential or low density residential. This "F" -Commercial application is definitely in violation of that adopted land -use plan. At the time we considered the land use plan, the Staff recommended, as did the Housing Authority, Planning Commission Minutes June 1 1972 platted as a 41 lot subdivision at a duplex potential of 82 total units with 6.5 wits per acre density.". Mr. W. P.Hamilton, attorney, was present representing the applicant, Developers Builders, Inc, ?here were no objectors. This tract approximately 20 acres in area lies adjacent to a 40 acre "F" zone to the south, a 20 acre "MF 24" site under development to the east, and city limits line adjacent on the north and the west. The proposed use was medium density apartments is in line with recent development and zoning action in this are of the City." Mr. M. R. Godwin was present representing the applicant, T.G.W., Inc. There were no objectors. A motion was made for approval of the application,which was seconded and passed. Tract No. 9 m Z-2582 9200 Kanas Road From: "A" -One -family District To "'MF 18" Multifamily District The Staff recommendation was react as follows: "The Staff recommends approval of the application. Single-family homes lie adjacent for the most part on the west and - the south. The hospital grounds lie across the street to the north and an undevelop- ed "E-1" tract ex4sts on the north. Lands zoned "A" exists adjacent on the east. Subject property with its favorable terrain could be developed with single-family homes but due to the potential impact of the land uses to the north,multi-family of low density would be a compatible use of the property." There were approximately 40 objectors present, and five letters in opposition filed. Mr. Tom Hodges, an urban planner, was present representing the applicant, H. T. Dickinson. Mr. Hodges displayed a site plan indicating 238 townhouses on the 13.2 acre tract which, he said, they had tried to design in such a way as not to adversely affect single-family residents on the west and on the south. Activities will be oriented to the center of the site and in almost all cases there is a 100 foot buffer strip between their property line and buildings. 831% of the site would be irs open space for driveways, parking and green area; 54% in green area which leaves 17% of the site covered by buildings. All entrances will be from Kanis Road which faces the Baptist Medical Center complex. On the east of the project will be a church and fire station and further east the pattern is for "F" zoning on Kanis Road. "We feel like this type development could serve as an adequate -buffer between intense uses across Kanis Road, traffic on Kanis, noise on Kanis and single-family development to the south and east. We have made an effort to have a very attractive appearance from Kanis Road in that the parking will not be on Kanis Road, but will be open space, and the units would be low profile with natural wood in nature." He said the existing land uses and zoning should be considered rather than just the property adjacent. M „-fanning CbWission Minutes June 1, 1972 He cited its relationship to theBaptist Hospital complex on the north, and a pattern :ay being established along Kanis Road of high intensity commercial to the east with institutional and public use next to their property. The proposed project would have 60 1 -bedroom townhouses, 20 3 -bedroom. units,and 158 2 -bedroom units, costing $3,500,000. which would generate approximately $25,000. in taxes to the public and school system. These are proposed to be luxury type apartments or townhouses. Mr. Paul Stittle, 1615 East Twin Lakes Drive, was present and presented a petition having approximately 150 signatures. Basically his objections concerned increased traffic which would be hazardous to the many children in the area, and in his opinion there is no need for this density at this time in this area. Mr. Paul Brown, 9615 Relda Drive, was present and stated that he bought his house for $20,000. in October, 1971, and his property has increased in value from 2% to 5%, and this project would depreciate the value of his property. Mr. Richard Cox, 9412 Cerelle Drive, was present and stated his concern was the large increase in residents in 238 units, that access would be from Kanis Road and Barrow Road only into the complex, and the safety of children living in the area from the increased traffic. Mrs. Madge McDaniel, 9419 Cerelle Drive, was present stating that the parking area for the complex would be in her back yard. Mr. .Roy N. Chancellor, 1512 East Twin Lakes Drive, was present saying that he had lived there for five years and bought his house as a retirement location. He said Kanis Road is very narrow and the intersection of Kanis and Barrow Road is a high accident area, and in his opinion there is no need for more apartments in the vicinity. Mr. Hodges answered some of the voiced objections saying that the traffic problems will be there from now on, but that Kanis Road has been designated as an arterial street as has Barrow Road, and while they have no solution for the traffic problem, there is no way to avoid it regardless of the proposed project. As to the parking it will be located in the 100 foot buffer between the property line and the build- ing and will provide a 30 foot strip between any parking or any construction which would be heavily landscaped on the total periphery of their property. The architect- ural design they will establish here is going to be a positive one, he said, and that they plan more screening and landscaping than is required by City standards. A motion was made for approval of the application, which was seconded, but failed for lack of sufficientfaffirmative votes. Mr. Venhaus pointed out that inasmuch as this constituted a denial of the applica- tion, the applicant had the right of appeal to the Board of Directors, and that notice of the hearing would again be sent out to property owners witbin 200 feet of the property if the case were appealed. Dickinson From: "A" -One -family District To "MF 18" Multi -family District The Staff's recommendation was read as follows: "(The Commission at its last meeting denied this application of rezoning property to "MF 18". The Board of Directors has referred this case back to the Commission for further consideration.) The Staff restates its previous recommendation of recommending approval of the application. Single-family homes lie adjacent for the most part on the west and south. Hospital grounds lie across the street to the north and an undeveloped "E-1" zoned tract exists also on the north. "A" zoned land, a church site, exists adjacent on the east. Subject property with its favorable terrain could be developed with ' single-family homes but due to the impact of the potential land -uses to the north, and as well to the east, which is a major change in character of the neighborhood, it is felt that a multi -family development of low density would be a compatible and practical use of the property at issue." Mr. Venhaus explained the status of the application. Mr. Paul Stittle, 1615 Twin Lakes Drive, was present in opposition. He stated that the area was too congested already. Streets are single lane and have no plans to become widened. There would also be heavy traffic going to and from three schools in the area. Mrs. Richard Cox, 9412 Cerelle Street, asked what price the apartments would rent for. She objected to the brick building she would see from her property. Mr. Austin Brightop, 1209 Twin Lakes Drive, stated that there were several apartment houses in western Little Rock and they did not need another one in this neighborhood. Property located around 9219 West 12th Street is residential and is gener- ally one of the better classes of homes than other areas. I believe that the way Twin Lakes is growing, it will be an asset to Little Rock for public relat- ions purposes. Families from other areas of the State and other States are looking for a quiet neighbor to settle in. We represent this type of neighbor. Multi -Family districts bring increased traffic, accidents, danger to children while they are playing and increase the possibilitg of theft, etc. One major concern involving the rezoning is the lowering of property values This is of vital interest to all residents in this area. In 1971, there were 42 building permits issued for the construction of 1, 733 apartment units in Little Rock. In Western Little Rock, (west of University, north to the Arkansas River and south to Asher Avenue) there are an cestimated �, 200 high density multi -family units with a vacancy rate of 20%. Due to the over -building of multi -family housing in Little Rock, the regional office of Housing and Urban Development is no longer accepting applications for HUD insuring or market -rate apartment construction in this area, and has not done so for over a year. The immediate need for high-density multi -family units has been met in the Little Rock area. The Twin Lakes area is served by three public schools. They are: Romine Elementary of grades 1 through 5, Henderson Middle of grades 6 and 7 and Parkview High of grades 10 through 12. In September, 1971, there were 389 students enrolled in Romine, 1, 112 enrolled in Henderson and 1, 354 in Parkview. Many of these children live in the Twin Lakes area and must walk to and from school on Kahi.s Road and Barrow Road. Both are major arterials. The lack of sidewalks or paths makes walking very dangerous. A major area of concern is the increasing traffic volume. This problem would be compounded upon completion of an apartment complex of such high - density as that which has been proposed. (M. F. 18) Still another area of concern is the proposed apartment complex location, which is on a hilltop overlooking and adjacent to Twin Lakes Subidvision, a single-family residential neighborhbrod. There are approximately 300 homes in the subidvision. The neighborhood should be protected by an adequate buffer zone. The intrusion of high-density residential into a low-density single-family neighborhood would so disrupting as to constitute an invasion of privacy.
