I-430 From: "A" One -family District To: "MF 18" Multi -family District Mr. Venhaus stated the Staff's recommendation as follows: "The Staff is opposed to any rezoning change on the property under consideration unless the existing access situation can be changed. The arrangement the Staff would prefer would be to take the long narrow strip of land adjacent to the Water Works' property, trade that to the Water Works in exchange for access down to Pleasant Valley Drive. If this arrange- ment could be worked out, the Staff would support the application for "MF 18" on that large tract adjacent to the Expressway. Without this kind of change in the access picture,. the Staff would be opposed to any rezoning." Mr. Rawn stated that this application arose because of a buyer who wanted to use the property for apartment development. We have attempted to -work with that buyer and the Water Works to get the additional access which would naturally be desirable franthe land -use or land -plan standpoint. Not having been able to work this out, I no longer have a buyer. So, if it were to be rezoned, there would be no immediate plans for development. The Staff has recommended the easterly portion of the tract of approximately 82 acres. That acreage would not be adjacent to any one family platted lot. As an individual and a representative of Pleasant Valley, Inc., we have had some experience in doing land -use planning just as the City Staff has. I think that the proper and best use for that easterly portion as the Staff recommended would be a V go Mr. Rawn was present to represent the applicant. He states that they would not.regt�e,st another deferral. As of this date, nothing has been worked 5 atisfactorily with the Water Works regarding the access. Pleasant Valley, Inc. will continue to try to work it out. I would U like to suggest that the application be considered subject to this m condition. S Mr. Venhaus said that the Staff was opposed to any rezoning change on the property until they know exactly what the access provisions .� are going to be. 3 There were several persons present in opposition. .°° An objector stated that the question was "whether or not we need more apartments in the area?" We don't want apartments adjacent to our property. The Water Works does not really need the land. They have c� a green zone which we understood was there when we moved in. Pleasant Valley, Inc. designed this green zone and it was an advantage to us as homeowners to move into an area which did have a zone such as this. It did set up a natural boundary between us and the Water Company 01 and between us and I-430. There are already over 1,500 apartments 'b in this section of the city and we don't believe we need more. o This is the south's finest residential community. It was originally zoned. for "A" One -family and we would like to keep it that way. Mr. George Thweatt, 507 Valley Club Drive, was present in opposition. He stated that in 1972 Pleasant Valley, Inc. took under advisement S the proposed apartment complexes to be built and the following reso- c lution was conceived at that time and ready for presentation to the , Board. It has since been adopted the second time last month of this e year. (He read the resolution). This meeting of the Board was attended by eight of the nine elected directors. In view of the fact that there are significant substantial access questions to b.e.resolved before we can even fairly consider the application, the Staff has prepared no recommendation. Our recom- mendation, of course, with the property .located that way it is right now and without additional access, would be denial,of any rezoning proposal for the property." Little Rock Planning Commission Minutes February 1, 1973 The Chairman stated that the applicant had requested by letter a deferral until the March meeting. There were several persons present in opposition. Mr. Don Jarvis, 3425 Imperial Valley Drive, was present in opposition. He stated that they are asking for no delay. This is the 4th time this case has come up -and it is difficult for these people to keep .coming back. The real question is should there be apartments placed on this property. We are asking for no more deferrals. Mr. Russ -ell Long was present to represent the applicant. He said that they.a-re.wo.rking on a specific solution with the adjacent property owner concerning the access. The Chairman asked if he could assure the Commission that this will come to a head in March. Mr. Long said 60 days would surely be sufficient time. Mr. Cunningham asked what would be wrong with withdrawing this applica- tion .at this particular point. Mr. Long said this would be satisfactory if we are not barred from resubmitting a rezoning application in the next 30, 60, or 90 days. Mr. Whitmore, Attorney for the Commission, said, "I think the Commission could take the action that they deem appropriate with reference to the matter before them as long as they are in agreement, whether it be 60 or 90 days." The Chairman said, "You mean put a limitation on it rather than withdraw it? 90 or 120 days certainly would give you ample time Mr. Long?" Mr. Long said that they would be agreeable to a deferral of 60 or 90 days. I, as well as other residents in Pleasant Valley, feel that we should - not be subjected to the high traffic count that a 204 apartment dwelling would generate. Also great is the possibility of overloading the sewer lines in this area if this apartment complex is constructed. Rocky Valley, Imperial Valley, and Hidden Valley would be turned into race tracks with approximately 300 extra cars being driven in this area.
