1. The area both sides of Markham from rine to Woodrow appear to be sound,
healthy single-family homes with few exceptions. (Any rezoning ought to be
done in such a way to produce minimum impact on adjacent properties.)
2. Visual investigation of rL-,ham and study of sale turnovers, indicate
as many or more sound and well maintained single-family structures as there
are those in state of disrepair.
3. The width and depth of the average lots on Markham is so restricted that
redevelopment of any kind would be extremely difficult even if reasonable
access and off-street parking is provided.
4. Average value and structure conditions on Markham is such that there
appears to be r.o possibility of total redevelopment under any rezoning
classification 'within S to 10 years. Redevelopment is apt to be sporadic,
slow and totally unrelated to other redevelopment.
5. Between Pine and Woodrow there are
(a) 19 parcels on the north side of Markham of which 9 front on
Markham Street. Of the 9 seven are not adjacent to an alley
or street which limits access from Markham Street only
(b) 24 parcels lie on soth side 01 Markham between Fine and
Woodrow ofwhich 4 have access only via MArkham
6. Problem of conversion from residences to "E-1" with minimum of off-
street parking and minimum site redevelopment would produce marginal
office use as compared to present single-family use.
7. We feel it would be premature to abandon. Markham Street for single-family
use.

(This case was denied by the Planning Commission on December 2, 1971, and was ap-
pealed to the Board of Directors. The Board at its meeting February 8, 1972 re-
ferred the case back to the Commission for consideration of possible "E-1" Zoning.)
The Staff recommendation was read as follows:
"The Staff recommends denial of the "E-1" and deferral of the case for 30 days to
permit a more detailed study of Markham Street in this area."
Judge Steel Hays, attorney representing the applicant, Mrs. Marjorie Blevins, was
present. He said he had hoped that the Commission would act on this case today.
Between the time of the action by the Commission and the consideration of the ap-
peal by the Board, he said his client had a chance to reflect on the matter, and
the fact that the spokesman of the property -owners at the last meeting has indi-
cated that they would have no objection to "E-1" Quiet zoning, we asked the Board
that it be returned to the Planning Commission for favorable action on "E-1" Quiet
classification. The surrounding owners have expressed publicly and privately that
"E-1" would be congenial to them. Mr. Hays said, "I would not want to be in posi-
tion of interpreting the staff recommendation to the Commission, but I do feel that
it would not be unfair to say that I think the staff finds an "E-1" Quiet Business
usage more congenial and far more acceptable to this area than the "F" Commercial,
and I felt a much stronger reception when I discussed it with the Staff than from
an "F" Commercial standpoint. I think the merits that support this application as
an "E-1" Quiet Business usage in that area are far greater than an "F" Commercial,
and I would hope you would entertain "E-1" Quiet Business Zoning." He added, that
he had resurveyed that area from Stifft Station to Pine Street and counted seven or
eight properties for sale along West Markham Street, and felt that this area is
badly in need of some thoughtful review as to whether this area is not ready for
some change.
Mrs. Geraldine Hamer, 111 North Pine Street, was present and stated that they did
not want this property rezoned to "F" Commercial or "E-1" Quiet Business. She
asked what the proposed use would be or what could go in there. Mr. Venhaus ex-
plained that an "E-1" District would allow a doctor's office, beauty shop, and
would also allow apartments to be built on the site at "D" Apartment density.
Mrs. Wanda Pyle, 107 North Pine Street, was present and stated that she had lived
at this address for 32 years. She said this was a nice residential seciton and the
reason you see homes for sale on Markham is because of "something like this".
Mrs. Pyle said they had spent quite a bit of money on their home recently and would
like the area to remain residential. Mrs. Pyle said they were opposed to "E-1"
Quiet Business and certainly "F" Commercial.
Mrs. Marjorie Fleming was presenL and stated that she owned the property adjacent
to this property where she had lived for many years. She indicated they.deY_iUitely
,did not want ''F" Commercial, and if it was rezoned for "E-1" Quiet Business they
would like to have a chance to know what would go in as there are some uses they
would object to and others might noL be too bad. She added they did not want the
zoning changed at all.
Mr'. Venhaus explained to Mr. Hays that the Staff's recommendation was for a 30 day
deferral to do a study of West Markham Street, but it should have been 60 days be-
cause of other commitments the Staff has--sagn ordinance, Downtown Central Little
Rock study, etc. He said the Staff would have to recommend denial of it if the
case had to be voted on today, but 60 days would allow time for a thorough study
of West Markham Street in this area. Mr. Hays said he would rather give the Staff
time that they need for the study rather than have an unfavorable decision today.
A motion was made to defer the matter for sixty days or to the regular May 4th
meeting, which was seconded and passed.

Staff recommendation was read as follows: "This case was deferred from the last
meeting at the request of the applicant. The Staff re -states its previous recommenda-
tion which was for denial of this application. The rezoning as requested would not
.be in character. and compatible with the surrounding land use which is predominantly
a stabilized and well-maintained single-family area.. It would effect an intrusion
of commercial activity in this neighborhood which would be highly undesirable.
(At the November meeting there were several persons present objecting to the
rezoning, and a petition containing 28 signatures was filed.)"
Mr. Steele Hays, attorney representing the applicant, Mrs. Marjorie Blevans,
was present. He stated that the fundamental principle of planning for problem
areas in a community is for periodic re -assessment and re -appraisal, and in
his opinion this is appropriate for West Markham Street in this area. With some
minor adjustments for the last five years the general planning classification
for West Markham Street has been pretty much in its present form, he said. The
traffic count in this stretch of West Markham mowing west toward Van Buren is
as high as any section in the City, and the residences between Stift Station and
Spruce Street, for example, at least those facing West Markham have deteriorated
to a noticeable degree, and an erroding process is in effect. There are five
for -sale signs this morning on residences facing West Markham Street and two or
three residences that appear to be abandoned. A comparable example occurred on
South Broadway some years ago when this sort of process began, and when this sort
of process begins, he said, it seems that residential use at least systematically
if not unconditionally.has to yield to another type of use, and that problem is
particularly apparent with respect to this property at the -corner of Pine and
West Markham. Mr. Hays cited a similar parallel at 13th and Woodrow when the
Commission granted an identical use across the street in such a neighborhood on
the southwest corner of 13th and Woodrow and there has been a clear reversal of
an unfortunate trend.. He said "it seems to me that that sort of process when it
begins ought not to be permitted to go tb the extreme before recognition occurs,
and that is,clearly what is happening in some of these sections on West Markham.
Isn't it the very essence of planning that the highest and best use that the
individual property owner has a right to subject his property to is weighed or
balanced against any detrimental aspects of that use by contiguous property
owners. If there is not an appreciable imbalance, then certainly the use he can
put his property to should be considered. The highest and best use of this property
would be of this sort as contemplated by this application. I don't believe any
detrimental aspect of this type of use to the surrounding property owners would
be more than minimal, and from a visual and aesthetic standpoint would be an
improvement."
There were approximately 18 persons present in opposition.
Mrs. Carl Schneider, 3820 West Markham Street, was present and stated that they
had found only one person who actually favored this application within two or
three blocks in any direction. Another objection was the fact that Pulaski Heights
School children travel this side of the street and with increased traffic, this
would be hazardous to them. She said they did not object to some other commercial
activity at this location, but not a store.
A relative of Mrs. Goodson, 100 South Pine Street, was present in opposition citing
that the traffic problem would be worsened by a store on this corner, as well
as the parking problem.
Mr. Walker said that the lady's comments about traffic and parking situations was
indicative of the change in the character of the neighborhood. He said he was
concerned about Pulaski Heights School, but the subject propertyis on the south

side of West Markham and if the children can get across West Markham at this
point they would not be endangered by this structure. "The Planning Commission
has been hung up too long on transitional neighborhoods. There is a difference
in my mind in intruding into a neighborhood and rezoning on the periphrey of-it
where you are on a street comparable to West Markham Street, and for those reasons
I would like to move that the application as requested be approved. The motion
failed for lack of an affirmative vote sufficient fot its passage. Mr. Lynn
Wassell abstained.
A motion was then made that the application be deni.ed,but it also failed for lack
of necessary affirmative votes.
Mr Whitmore advised that in this case "if the affirmative becomes the negative,
the petition is denied as there were not enough members of the Commission present
to'make a majority on either side."
Mr. Vanhaus added that this is an extremely significant issue and would suggest
that the Planning Commission call, in the near future, a special meeting since we
had some evident sympathy for the application as submitted. We need to have some
serious discussion on how we deal with this kind of proposition. "I am very fear-
ful of what almost happened in this particular matter. The conversion of older
neighborhoods on one lot basis to highway frontage oriented kind of zoning, in my
opinion is absolutely the worst kind of thing you can do to a neighborhood of this
kind. Asher Avenue is the ultimate kind of product that this process yields. What
is happening on Broadway that the courts imposed on us in an area that was beautiful
and could be salvaged has now become the repository of restaurants, car-washes,
drive-in places, etc. is another example of the kind of hazard we deal with. The
problem on Markham Street if we'deal with one lot, you have literally hundreds of
properties zoned "A" up and down this street. Once we subscribe to a policy of
rezoning in this fashion, we create a tremendous potential along Markham for the
same kind of conversion which has happened to Asher and Broadway. I think we need
to give some serious thought and discussion to alternatives on these streets
because Cantrell is in the same situation, Markham is in the same situation - we
have many streets that stand in this same kind of hazard."
Mr. Walker responded saying "I don't know how to help this particular property
owner utilize his property in an obviously und.esiaable location for the zoning
that is on-.it. If we feel that it is a responsibility here that we ought to
get on with a study of West Markham Street from Stiff.t's Station to the west -
I have never been one for the idea that one man's property should stand as a
buffer against someone else. I would like to see us study these properties in
older neighborhoods that are fronting on high traffic streets where they are used
for single -family residences which have become undesirable. It doesn't make any
sense at all to me to say that people two blocks away were against this - why7
Perhaps we•need to be able to re-assure the people that we are'not in fact, by
rezoning on West Markham, going to go south with it."
Mr. Venhaus stated that he shared Mr. Walker's concern-that it is an extremely
difficult problem and the two alternatives that we are talking about are both
unfortunate. One is you always have to maintain a single -family dwelling on that
street; and the other is that you sell it for a chicken fry, or "get and go" or
something of this type. Both of these are extremely unfortunate alternatives,
and unfortunately there are not a lot of other areas of consideration. We could
take a look at multi-family zoning. It is a serious problem, and I appreciate
your concern."
Mr. Walker added that the type of zoning which deny a property owner reasonable
use of his property i,s what in the long run leads to deterioration. The
Chairman commented that in his opinion West Markham has more problems than any
other one street from Shackleford Road to Stifft's Station and favored a study
such as was proposed by Mr. Venhaus.

states on oath as follows:
1. Attached hereto is a list of apparent prop-
erty owners of all real property lying within 200 feet
of the boundary of property at 3819 West Markham Street,
Little Rock, Arkansas, owned by Marjorie Rogers Hanson
Blevans.
2. On February 1972, the undersigned
mailed by duly posting the same in the United States postal
service by certified mail, return receipt requested, notices
to each of said owners informing them of a public hearing
before the Board of Directors of the City of Little Rock
on the petition of Marjorie Rogers Hanson Blevans to re-
view the denial of an application to change the zoning of
the above property from C 2 -Family to E-1 Quiet Business,
to be held at 2:00 p.m. in the Board of Directors Chamber
at City Hall on March 2, 1972. A true copy of the notice
mailed to each owner is attached hereto.
