There *R•-) (is not) any restriction on this property imposed by a Bill of Assurance (Should there be one, I realize I shall be liable to the.' rqperty owners having a common interest in this matter.)„ Date: 19111-1-- / 5-4-71 XC 150 Signature� owner, or lG ly authorized agent Tract No. 5 - Z-2514 1800 - 1810 North Polk Street From:"A"-One-family District To : "F" -Commercial District The Staff's recommendation was read as follows: "The Staff recommends denial of the application for "F" -Commercial and approval instead of rezoning subject property to "E-1" except the south -25 'feet thereof, and further recommends approval of the development plan as submitted provided a revision is made in the structure to eliminate the blind corner at "R" and Polk Streets. The "E-1" zoning would afford some nature of a buffer to the residential properties to the east and by application to the Board of Adjustment may be considered for parking for the "F" -Commercial use. The proposed plan replaces two development plans now on record concerned with the west half and the NE -4 of this block. (The 25 foot strip identified "green strip" on the plan remaining "A" would provide a green area adjacent to Cantrell Road.) Mr. Eugene Pfeifer, III, was present representing himself, E. G. Levy and -E. M. Pfeifer, Jr., the applicants. He commented that the blind corner has been eliminated in the revised development plan which takes care of the objection of the Staff. "As to the part of the recommendation as to "E-1" providing some form of buffer, the physical reality of what would go on this property would remain the same, and we are building a structure that should last 40 to 50 years,so as far as providing any difference in the physical reality of what is there, there would be none. The only thing that the Staff's recommendation would accomplish would be to delay us for 45 to 60 days while we accomplish this other procedure through the Board of Adjustment. We have a deal here that is necessary that we get under construction as quickly as possible and if the feeling of the Staff was that the Board of Adjustment would recommend this waiver, as far as we can see nothing really would be achieved except a delay." This area would be used only for parking, and the proposed structures would be on the north half of the block. Mr. W. H. Freyaldenhoven, 1801 North Polk Street, was present stating that he lived east of the property involved. He said this is a residential area directly across from the subject property and they are all concerned as to how this would affect the neighborhood. It is hoped, he said, that in the event this is considered for rezoning that some protection would be given to the property owners living across Polk Street, -- Mrs. J. A. Hill, 1817 North Polk Street, was present stating that her main concern was that' -the loading dock and ramp would be directly across from her home, .Mrs. Hill mentioned the Forest Heights Shopping Center Criteria quoting item #6 reading "entrances to all structures should be oriented to the interior of the commercial area." Mrs. Hill added that since three sides of that block are commercial, it would seem that they are putting a whole lot on the residential area on the other side. Mr. T.W. Jarratt, 1815 North Polk, was present stating that he lived across Polk Street from subject property. He was protesting the entrance on "R" Street saying that this would create a hazard going in and out of "R" Street, and this should be relocated if possible. -3- Planning Commission Minutes October 7,1971 Mr. J.H. Clark, 1819 North Polk Street, was present stating that the loading dock is right across the street from his front door, to which he strongly objected. It was suggested to Mr. Pfeifer that he shift the building to the west, putting the loading ramp and dock on Taylor and "R" instead of Polk and "R". Mr. Putnam added that "we are more concerned with the neighbors than Kroger. Loading is a problem when it is done on the perimeter instead of the interior with backing of rigs and trucks in and out. He suggested that the building be moved west away from the residential properties. Mr Venhaus said there were two alternatives. (1) Insomuch as Mr. Pfeifer has asked for a waiver of yard area requirement from the Planning Commission through the approval of a development plan, it was his opinion that the Planning Commission did have the authority and jurisdiction to require the relocation of the store, or require the relocation of the loading ramps as a condition of approving this setback. (2) Part of the Staff's recommendation being for "E-1" zoning, would require that Mr. Pfeifer go to the Board of Adjustment to receive permission to use this "E-1" area for off-street parking. The Board of Adjustment would have wide latitude to protect the interest of the people on Polk Street who deserve every consideration in terms of effort expended to make this area as compatible as possible. In addition, the "E-1" zoning would assure that this parking lot could not be used for any structural purpose other than "E"-1. In my opinion they have the authority to require the relocation. At the request of the Chairman, the applicant and objectors conferred in an effort to resolve some of the problems presented by the protectants, but Mr. Pfeifer announced that the meeting was to no avail. Mrs. Hill further stated that the Forest Heights Criteria included screening of all commercial property adjacent to residential property and requested that this provision be followed. Mr. Pfeifer commented that the Criteria was only a guide- line and not an ordinance, Dr. Daniel Autry was present stating that he lived about a block away on Tyler Street and "R" and agreed with the objectors that the loading ramps on Polk Street were objectionable from noise, rats, refuse, and added that the Safeway Store in the vicinity h d agreed to install screening around their property, but that it was inadequate. In his opinion, the Forest Heights Criteria should be adhered to. Mr. Pfeifer agreed to an alternative which would involve "flip flopping" the building from east to west putting the loading dock parallel to Taylor Street instead of Polk Street. Mrs. Hill said they would be agreeable to this revision, but would like some screening along the property adjacent to Polk Street. A motion was made to recommend approval of the Staff's recommendation as printed with an additional requirement that the development plan be amended to observe all criteria of the. Forest Heights Shopping Center code, and amended to permit a curb cut on Polk Street,which was seconded. Before the vote was taken, some discussion ensued about the requirements the Board of Adjustment could make as to curb cuts, screening, etc,, and the motion was withdrawn. -4- Planning Commission Minutes - October 7,1971 A motion was then made that subject property be rezoned to "E-1" and this subject to a development plan which reverses the location of the Kroger Store, aid assuming that the application will go on to the Board of Adjustment for the waivers that are needed, leaving the south 25 feet of the property "A" -Single-family, which was seconded and passed. Mr. Venhaus recapitulated saying "we have zoned this southeast quarter of the block to "E -1"a We have approved the development plan on the property subject to the building locatidia being flip flopped, loading ramps on Taylor instead of Polk Street, You have not made any specific disposition of the access to Polk Street, and no disposition of the screening along Polk Street."
