AN ORDINANCE RECLASSIFYING THE NORTHWEST CORNER OF PARK
LANE AND 15th STREETS IN THE CITY OF LITTLE ROCK, ARKANSAS,
AMENDING SECTION 43-2 OF THE CODE OF ORDINANCES OF THE CITY OF
LITTLE ROCK, ARKANSAS; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. That the zone classification of the following
properties be and is hereby changed as indicated:
Z-2511 - Described as Lots 7, 8, 9, Block 157, Original
City From: "C" -Two-family District To: "D" -Apartment District.
SECTION 2. That the map referred to in Section 43-2 of the
Code of Ordinances of the City of Little Rock and designated "District Map"
be and it is hereby amended to the extent and in the respects necessary to
effect and designate the change provided for in Section 1 hereof.
SECTION 3. That this ordinance shall take effect and be in

period ot time. -
The defferal is made necessary because the final approval
of the Little Rock Housing Authority's Central Little Rock
plan has yet to be obtained. My request for rezoning

Reference is made to the Notice of Public Hearing dated
September 16, 1971, which announces a hearing to be held at
2:00 p.m. on October 7, considering a zone change as follows:
"Tract No. 9-2-25111424 Park Lane Road, described
as Lots 7, 8, 9, Block 157, Original City of Little
Rock. From "C" -Two Family District to: "D" -Apartment
District."
You are advised that the above described property is within the
Central Little Rock Urban Renewal Area, Project No. ARK R-12. The
property is within an area of the adopted Urban Renewal Plan which
provides that it be retained as "C" -Two Family District. However,
in the revised plan for the Urban Renewal Project for which the
Part I of an Amendatory Application has recently been approved by
the Department of Housing and Urban Development, it is planned that
the area be classified as medium density residential which would
permit "D" -Apartment District. This revised plan will be submitted,
for the consideration of the Commission in the near future.

inconsistent with the present adopted Urban Renewal Plan, we must

Mr, John P. Gill, attorney representing the applicant, was present as was
Mr. Dorman.
The Staff's recommendation was read as follows: "This application was withdrawn
by the Commission at its meeting on October 7,1971 due to policy of not deferring
a case indefinitely as requested by the applicant. The Staff re -states its
previous recommendation of deferral until January,1972 Planning Commission
meeting or sooner, dependent on the adoption of the revised Central Little Rock
Plan. (Applicant has re -notified adjacent property owners of this public hearing.)"
Mr. Gill stated that the purpose of the deferment was to afford Mr. Dorman an
opportunity to determine the status of this property with the Housing Authority
under the Central Little Rock Plan. The location of subject property is south
of MacArthur Park, just south of the Expressway. He indicated it to be one of the
most handsome, architecturally, buildings in the East End- a two-story brick
building - and at the time he bought it consisted of 5 apartments upstairs and a
grocery store,, a beauty shop and one apartment unit downstairs, which made it a
mixed "D" and""F" use, although it was zoned "C" -Two-family District, This made it
a non -conforming use and the principal purpose of this application was to make the
zoning conform to the use. Mr. Dorman bought this property with the intention of
rehabilitating and making it an asset tothe East End, said Mr. Gill. The property
was purchased in August, 1971 and at that time the Little Rock Housing Authority
approached him and offered him assistance in making an application for a 3% rehabil-
itation loan from HUD. He said it could be rented as it now stands, but it would not
reduce the "blight" in the East End. At the time the application was made Mr.
Dorman was advised by the Housing Authority that it would be necessary to'do a
number of things, among which was to hire an architect and obtain some plans for
redevelopment, which he did. The remodeling plans called for gutting the building
and converting it into nine apargments, four on the second floor where there are
now five, 5 apartments downstairs where there was a grocery store, beauty shop,
etc. At the architect's suggestion, some of the interior petitions were removed.,
two tenants were given notice to vacate with the hope that the proper zoning could
be obtained. With the assitance and the cooperation of the Housing Authority, he
prepared to meet the requirements of the 3% loan. It was not learned until after
the application was made, the tenants vacated, plans drawn that the Housing
Authority had changed the CLR project, and the new change had not been approved
(presently it calls for "C" -Two-family). Mr. Bill George of the Housing Authority
informed Mr. Gill today that final approval the CLR plan will not be secured for
a period of possibly 6 months; that it is possible that Mr. Dorman could proceed
as soon as the City Board approved the Plan. "D" -Apartment or medium density
zoning is the classification that the Housing Authority is proposing for this area,
in the amended plan.
Mr. Bill George, representing the Little Rock Housing Authority, was present,
stating that the Housing Authority must oppose this application as being inconsist-
ent with the current Urban Renewal Plan for the area which presently is "C"-Two-
family„Medium density is being proposed which would take care of "D" -Apartment
zoning, but they still must adhere to the old plan adopted by the City Board in
December, 1961. He said"we have had this happen once before during my experience,
and it brings the Federal government into the picture immediately. We had hoped
to have this taken care of before now but due to changes in the downtown area
particularly La Harpe Boulevard - these changes of necessity have delayed the sub-
mission of the new plan to the City Board for its final approval which we hope to

accomplish early next year - January or February, 1972. If the City Board did
adopt this plan, we would have no objection to this change. "D" -Apartment is in
the proposed revision which has not had local action. It has had preliminary
approval by HUD but this application is in violation of the plan as currently
accepted.
Mrs. Catherine Oat, representing a number of property owners in that section_,
was present in opposition stating that the notices which were sent to adjacent
property owners were incorrect in the description of the property to be rezoned
which they thought was illegal. The notices indicated the northeast corner instead
of the northwest corner of 15th and Park Lane. She was informed by Mx. Gill that
the legal description was correct, and there was no other prope.rty'in the entire
City that would fit the description which included apartments upstairs, and a grocery
store, beauty shop and. -apartment downstairs, so there could be no doubt as to the
property under consideration. Mrs. Oat read a petition signed by 23 families who
objected to the rezoning citing noise, added traffic, and the possibility of changing
an ideal neighborhood for senior citizens into one with many problems and hazards.
She suggested a deferment in order for a corrected notice to be sent to property
owners.
Mr. Gill responded to the deferment suggestion stating that Mr. Dorman is in an
unusual poasition - that he had made a considerable cash outlay already, now has
a building that is gutted and vacant, might have to spend another thousand dollars
to put it back in condition to be rented for some 60 to 90 days, and is losing
rentals at the present time of around $500. per month. In addition he would have to
bring the property up to the standards set by the City for habitation which would
require another $1,000. and asked the Commission to take action on this petition
so he could move forward with it.
Mr. Venhaus explained that Mr. Dorman had the right to rehabilitate the structure -
had a right to work on the interior of the building - that there is no reason why
he could not undertake the work he wants to do on a non -conforming structure. He
could not add the four or five additional units he proposes, and he could hold in
abeyance the other improvements until HUD approved the new plan.
Mr. Lyon expressed the opinion that the Planning Commission cannot decide whether
this is a breach of contract with HUD, but could recommend to the Board that they
rezone this property when, as, and if such a rezoning is not in violation of the
contract with HUD.
A motion was made to recommend to the City Board that subject property be rezoned
when, as, and if they are assured that it is not in violation of the contract
with HUD, which was seconded and passed,
Mr. Putnam re -stated that "we rezone this to "D" -Apartment subject to it not
violating our contract with the Little Rock Housing Authority as set out in a
statement signed by the City At' -ney to the City Board of Directors.
