A motion was made to recommend a thirty day deferral of this case to the November
4th hearing, which was seconded and passed.
Mr. Woolsey added that the FHA would not "go" on this construction because of
the amount of retaining walls proposed, and he would like for the Commission
to take into consideration the way the rest of the neighborhood would look;
that his property which is across the street, would be left up in the air.
Mr. Raymond R. Talley, 2823 Barrow Road, was also present in favor of the
zoning stating that he owns 4 lots on the corner of 29th Street, and was for the
requested rezoning.

Higher density than sinigl.e-family is warranted on Barrow Road as it is a major
collector street. This consideration plus the fact that the terrain in the area
is rather severe, larger tracts of higher density development, rather than single-
family development, would be more practical and desirable, and would encourage
the development of the Barrow Addition."
Mr. B. L. Church, attorney, representing the applicant, Ben Thompson, was present
as was Mr. Thompson.
Mr. Cecil Woolsey, 8818 West .30th Street, was present in opposition, asking for
information about "MF 24" Multi -family zoning recommended by the Staff instead
of the "D" -Apartment zoning which was requested. He was informed that "D" -Apart-
ment density zoning allowing 36 units per acre with setbacks of 5 feet from
side lines and 25 feet front and back, whereas "MF 24" setbacks are greater on
the side lines (equivalent to the height of the structure) parking ratios are
two to one instead of one to one, there is much more open area, and only 24 units
allowed per acre, Mr. Woolsey added that this property is single-family and he
would like to keep it that way.
Mrs. Harold Ballentine, 2916 Ludwig, was present in opposition stating that she
owns 3 lots - 4, 5, 6 across Ludwig from the property in question, and these lots
face Ludwig which would be -facing this property. Her concern was mainly the fact
that there are terrain problems - if they don.et grade the hill down, the apart-
ments would be above her house, and if they grade it down, the roofs of the apart-
ments would be below her house, and in her opinion it would not be a good thing.
Mr. Lester Woolsey, 8824 West 30th Street, was also present in opposition, stating
that he owns property adjoining on the south., Lots 10, 11, and 12, 1, 2, and 3,
Block 175. He said that was all zoned single-family, and would like for it to
remain such.
Mr. Lee Webb, 2900 Ludwig, was present in opposition stating that he owned three
lots all facing 29th Street just across the street from the subject property, and
agreed with the others who opposed this development.
Mr. Ben Thompson, the applicant, was present and stated that he did not intend to
make it difficult on the neighbors. He plans to develop the property with 10
apartment units, and the rest townhouses, that he would have to cut this property
down to the level. of 29th Street, and is already 14 feet down and would follow
the contour of 29th Street. He 'intends to put a wall, with. a fence around the
property above the wall.
Mr. Thompson was asked if he would accept "MF 18", and said he would prefer "MF 24"
but would be glad to study the matter further and see, what he could come up with.
When asked about a development plan, he said if he knew what he could get in the
way of zoning, he could prepare a development plan.
Since this is an established neighborhood, it was suggested that it might be mutually
advantageous for a deferral for a refinement of the applicant's plans.

The Staff re -states its previous recommendation of "MF 24" Multi -family zoning
on this tract. "The Staff recommends denial of the application for "D" -Apartment
zoning and recommends instead "MF 24" Multi -family District due to the established
non -conforming use which existed on annexation of the area to the City. The terrain
is such that it appears apartment development of the tract is a practical use
of the land. Location on a major collector street (Barrow Road) favors this
development of the land.
Higher density than single-family is warranted on Barrow Road as it is a major
collector street. This consideration plus the fact that the terrain in the area
is rather severe, larger tracts of higher density development, rather than single-
family development, would be more practical and desirable, and would encourage the
development of the Barrow Addition."
Mr. B. L. Church, attorney, was present representing the applicant, Ben Thompson.
There were no objectors present at this meeting.
Mr. Church stated that the revised plot plan presently is based on "MF 24" Multi-
family District zoning as recommended by the Staff. The drop-off of the property
has been reduced to 122 feet from the original 25 feetto:which the adjacent
property owners were objecting. He added that there would be a green strip all
the way around the development.
A motion was made for approval of "MF 24" Multi -family District zoning, which was
seconded and passed.

(1) Attached hereto is a list of apparent
property owners of all real property lying within 200
feet of the boundaries of Lots 4, 5, 6, 7, 8 and 9 of
JOHN BARROW ADDITION to the City of Little Rock, cer-
tified by Standard Title Company.
(2) On September 14, 1971, I mailed, by
certified mail, return receipt requested, letters to
each of said owners notifying them of the public hear-
ing before the Little Rock Planning Commission on the
rezoning application of Ben and Peggy S. Thompson,
scheduled for October 7, 1971. A true copy of the
notice mailed to each owner is attached hereto.
(3) As of the date hereof three letters
were returned unclaimed and are attached hereto.

hereto.

LITTLE ROCK PLANNING COMMISSION

TO ALL PARTIES IN INTEREST, including owners of
land lying within 200 feet of the boundary of property
at Lots 4, 5, 6, 7, 8 and 9, JOHN BARROW ADDITION to the
City of Little Rock (South Side of West 29th Street be-
tween Ludwig Street and Barrow Road) owned by Ben Thompson
and Peggy S. Thompson.
NOTICE IS HEREBY GIVEN THAT an application for a re-
zoning of the above described property requesting a change
of zone classification from "B" Single Family District to
"D" Apartment District by amendment of the Little Rock
Code of Ordinances (Chapter 43) has been filed with the
Little Rock Planning Commission, City Hall. A public hear-
ing on said petition by this Commission will be held in
the Board of Directors' Chamber, City Hall on October 7,
1971 at 2:00 P.M. _
ALL PARTIES IN INTEREST MAY BE HEARD at said time
and place or may notify the Commission by letter of their
