Rather than take up your time with a telephone call or office visit, it was felt that a letter outlining our opposition to the proposed change would be more appropriate. No doubt the Anthony School will be one of the most vitally affected, inasmuch as the entire block of land in the proposed change borders the school campus on the east, a distance of 663' from Iowa to Ohio Streets. We feel that Commercial Zoning adjacent to a school would be extremely detrimental to the environment and atmosphere so necessary to learning. Both Iowa and Ohio Streds are very narrow and woefull-,/ inadequate to carry the existing traffic. ;Iowa Street being only 16' to 18' wide wits places where automobiles cannot pass. It is realized that traffic is increasing everywhere, but unless and until these streets are widened, any increase in traffic would be intolerable. In an attempt to assit in alleviating the problem, a paved driveway 663, long was constructed across the entire length of school property from Ohio Street of Iowa Street. Thus establishing a one way traffic pattern in to and out of our school campus. You are, of course, aware that should the 1800 block of Mississippi Avenue be changed to "F" Commercial, the tre ndency would be for strip Zoning commercial along the street and furtherencroachment into a fully developed one family area. We cannot speak for other property owners in the area, however, it appears to us that the 1800 block of Mississippi might be suitable for "E-1" quiet zoning and property fronting on Iowa and Ohio Street suitable for low density apartments. In other words, we recognize that a property owner is entitled to the highest and best use of his property as long as it does not detract from the neighborhood. Respectfully submitted. The applicant made application for the November, 1971 meeting for rezoning of a larger tract to "F" -Commercial, which included that in the previous "E- Apartment September application. The Staff recommended denial of this application basically for the reasons of incompatibility of land use and the inadvisability of development of commercial on Mississippi due to the excessive grade in this area. At the November meeting the applicant again requested a deferral until the February 3, 1972 meeting.) Prior to the meeting on that date applicant withdrew application entirely. The application now filed for consideration encompasses only the 2.5 acres lying west of and immediately behind the houses along Mississippi Avenue. The Staff recommends denial of this application as it is felt that an "E-1" use of the land lying between residential property on Mississippi and Anthony School adjacent on the west would be highly inadvisable. It would be incompatible with adjacent properties. It is felt that low density multifamily "MF 6" development would be appropriate and a practical use of the land." Mr. John P. Gill, attorney for the applicant, F. E. Bates, was present. There were approximately 12 objectors present, two letters of objection filed, and a petition having 30 signatures in opposition filed. Mr. Gill stated that this particular tract is at present vacant. The property is part of a tract which includes the southwest corner of Mississippi and Iowa zoned "E-1" which is also owned by Mr.Bates to the east. This request is to permit the use of this entire tract including that "E-1°" corner for the Arkansas Allergy Clinic offices. There are at present single-family houses along Mississippi Street, and one house to the west of the tract on Iowa Street, and the Anthony School and houses across Ohio Street. The proposed use contempates leaving the south half ("A"-Single- family) ""A"-SIngle=family) vacant for future development as the owners have no plans for that particular portion of the tract at present. Although there is not any immediate need for that zoning as such, it does pose somewhat of a question in the proposed use of the land if the doctors intend to develop it for a clinic, it would seem that they should have the assurance that for future expansion that property could be used for "E=1" and the only way it could be assured is to zone it at this time. Mr. Gill filed a petition signed by property owners along Mississippi and Iowa Street indicating no objection to the use of "E-1"' on the entire tract. Mr.Wesley Stevenson, 1720 Mississippi, was present in opposition and filed a petition having 30 signatures of adjacent property owners objecting to the rezoning. He also stated that the drainage situation is very critical at this location. Mr. M. E. McGahan, 7603 Ohio, who lives directly across the street from this property was present in opposition. The suggestion that the south half be retained as ""A"-Single4 family zoning was acceptable to him, and the north half be rezoned to "E=1" Quiet Business District as requested. Mr. Allen Anthony representing the Anthony School at 7700 Ohio Street, was present and expressed no objection to the Allergy Clinic, but would not want "E-1" zoning on the entire tract. He later modified his statement to approve "E -l" in the 1500 block and the remainder "A"' -One -family to be a buffer zone between the commercial property and "A" zoned property. Mrs.G. K. Waters, 7500 Bonne Brae, was present in opposition stating that in her opinion the entire tract should remain "A" single-family as the streets in the area are narrow, particularly Obio, that the sewer is not adequate now and the situation -3- Planning Commission Minutes .lune 1,1972 would be worsened. Mr. Venhaus responded saying that because of the importance of this property and its relationship to Mississippi Street and that whole area, if the north half of this property cannot be reasonable used for "A"-Sing.le-family, then realistically the south half cannot be either, so all we are doingis deferring the problem. "I don't think that anybody would expect the south half of this property would be used at some point in the future for "A" Si.ngiemfamiiy. If it cannot be used now it certainly won't be a better piece of property for "A" -Single family its the future, and it won't be maintained in perpetuity as a buffer strip, I am sure, if the value of the land is as high as it is suggested to be. So I think that is a problem that might simply be deferred to another time and place. Again I want to remind you that the application as filed places these frontage properties on Mississippi in your judgment in such a situation as to become a very strong argument for "'F`' Commercial zoning. You would bane, if this application is approved "F" Commercial zoning on every corner on Iowa and Mississippi except the southwest corner which the applicants own and does not propose to develop for professional office use. That leaves it in perfect set up .for "F11 - Commercial zoning, if not through the City then through the Court. Once that corner property is zoned "F" -Commercial it appears to me that we have jeopardized that entire strip of houses on the west side of Mississippi.,, Mr. Gill stated that the fact that the streets are narrow (Ohio and Iowa) would make it necessary to .improve them however the property is improved whether it be single- family residential or any other use, from the property line out to the existing street which would entail a large expense. "Because of that expense and because the property owner is entitled to use the property for the highest and best uses, it seems to me that there should be a consideration certainly on the north part of the property for "E-118 use where it ,joins the existing "Eml'" which the Bates owes. With reference to the south part of the tract, the suggestion was made by the Planning Staff that 'IMF 6.P would be appropriate on the south portion, and after conferring with my clients their position is that they will accept your best judgment insofar as that lower portion is concerned. I suggest that if the Planning Commission feels that the south 300 feet of that tract deserves some classification anther than "Eel'" that it be given the classification as recommended by the Staff." Mr. Gill said the south 300 feet would provide ample room for the development of the north portion of the tract to permit park- ing that they propose. The parking is to the south of the 'Nailding. Mr. Putnam asked Mr. Gill if he were amending the request for "B-111' Qu ie t Business for all the property except the south 300 feet of the tract. Mr. Gill replied that the owners would like "E -i" on the whole tract, but this would be an appropriate method of handling the ownership because it esn't put a limitation on the expansion of the clinic, but there has been a suggestion by the Staff for some other type of classifica= tion, but he would not like to be the one to set it. "If there is to be ones, I would like to request that it be done by the Commission on my petition as it stands, and again recall that the Staff has recommended "MF 6" on that southern portion." Mr. Venhaus corrected him saying the Staff recommended '"MF 6" for the entire tract. Mr. Putnam then restated his motion that all except the south 300 feet of subject tract be zoned "E-1" Quiet Business a to the south boundary line of Lot C. He re- phrased his motion to rezone all of the tract to "E-1" Quiet Business with the exception of that portion lying south of an extension of the south line of Lot C running westward, which was seconded. Mr. Venhaus at this point said that the motion as stated does not satisfy the concern that the Staff has expressed throughout. "It places "'E-1" on theinterior tract behind the single-family dwellings on Mississippi. It certainly enables them to rezone their property '�E-1" on demand. I think it sets up the corner property at Mississippi and Iowa for an "V_Coamtcercial application. By this action I believe we in effect are committing all those frontage property on -4- Planning Commission Minutes June 1, 1972 Mississippi �,o a change in zoning to "E=1" and possibly "F" -Commercial."' The: motion failed for lack of sufficient affirmative votes. Mr. Putnam asked Mr. Kemp if this killed the modification to which he replied "yes, but the application has not been acted on yet." The Chairman asked &.Stevenson if this modification was acceptable and he replied that he would go along with it although he was not happy with it. Mr. Carroll Foley was in the audience saying that he had bought a house on Mississippi for an investment and he objected to the rezoning of half of the subject property, and -in his opinion that area needs to be developed in its enti.retyp otherwise the "A" -Single-family on Mississippi would probably want to get 'IF" -Commercial zoning. Mr. Wickard said he wanted to go on record of sharing Mr.Venhaus concern about the southwest corner of the intersection of Mississippi and Iowa. "I am daiinitely against any IT"- Commercial on that portion of the block or anywhere else on that block. Of course, it is possible to go to Court and override the Commission, but I would like to state that I am opposed to that. I would like to make the same motion in essence that Mr. Putnam made that this property be rezoned - the north so many feet, but up to the property line to an extension of the south boundary of Lot C, and the balance remain "A" -Single-family. The motion was seconded. Mr. Gill then asked to address a comment to what seems to be the Staff's concern about that particular corner e that at some future date it may change classification to #T ". "I am fully aware that when the property is classified, it is classified for whatever use, is permissible there. I am also aware that by the time an individual places an expenditure of funds and erects a doctors' office, which is an "Eml"" use, the chances of that doctors' office requiring "V-CoTroiercial are nonexistent, and chances of vacating this property for some "F" Commercial use are likewise rather remote. It just does not seem realistic that in the future a recommendation or request for "F"0 would be made. We have submitted this application in toto. We have asked for a full development plan for this particular plat as an "E=1"" use. I am not unwilling to try again for a motion by the Commission as to what might be done on the north half, but that failing that some type of concurrence of the members of the Commission it would be proper to look at the whole applicatlzn. I would like for you to vote on the petition as filed." Dr. Miller asked if he would be in order to move for a thirty day deferral with instructions to the professional staff that they completely review the area between Iowa and Ohio m all property facing Mississippi back to the Anthony -School, and property north of it with the idea of making a total zoning recommendation that would be in keeping with the good of the neighborhood and community. The Chairman agreed that this might be well taken, and Dro Miller made a motion to defer for thirty clays action on this application and the professional staff be instructed to make a study and recommendation on that area. The motion failed for lack of a second. Mr. Gill countered that the Staff had apparently made a study of this area, and considered the property along Mississippi and made their recommendation, and it would seem that the Staff's recommendation is in a posture so that we could go forward with it. We do need to get it resolved today, he said. The owners of that particular piece of ground is entitled to use it for its highest and best use. That particular piece of ground has a drop on the front end in excess of 20 feet. It is a rough piece of ground and any development on that tract is going to require enormous expenditure of mosey whether for single-family or a doctors' clinic. The only highest and best economic use of that property is going to be for a doctors' clinic, or for some mother type of clinic or use that would go in an "E-1" District. If you cannot economically justify the development of that property for single family use - that is the present use - because of the street grades that would be requested on ""MP" use o you can't economi- cally do that either. You can economically place haat building where it is placed on the plan and provide parking on both the south and west, and to that end we Mould like to ask that you give favorable recommendation to the "E-1" request. There is really no other good use of that property bearing in mind that the Bates already own a piece of property zoned "QEal" to the east, and for that reason they have requested that the entire strip that is behind the row of houses on Mississippi be rezoned to "E=140 use. I would request that you grant this particular petition as it has been presented to you. - When asked about the status of the motion made by Mr. Gilmore, Mr. Kemp replied that the proper approach is to act on the petition and not the Staff's recommenda- tion. Mr. Wickard added that basically his opinion was that the entire block needs to be rezoned "E -l" ultimately. Mr. Gill said "it is .important that we bear in mind that these are two obligations Of this Commission, (1) the highest and best use of this particular property upon which an application is made; (2) the obligation for the proper planning in the community. This tract is under one ownership now and will remain in one ownership if rezoned. I have spoken to you about what is the highest and best economic use of this ground rough terrain s expensive to develop m its inaccessibility. This is already single- family. I would ask you again to permit it to be developed for its highest and best economic use and permit it to be developed under "E -l" classification. In reply to this statement, Mr. Venhaus said "if Mr. Gill is going to talk about the highest and best use, and the obligation of the Planning Cosmmis.ion, I feel obliged to point out to you haat it seems completely foolish to me to construe a piece of property for its highest and best use - to take a piece of property that has no adjacency - no frontage on a major street, that is separated from a major street by existing "QA..- Si-ngleafamily dwellings, and to argue that the highest and best use for that property is "E-1" professional office when it lies between two developed strips of "A" -Single family property. I dont think the highest and best use has any application here at all. The Planning Commission has an obligation, of course, to render a judgment that they think is best for the benefit of that area." "A portion of this property was involved in a request for "E" -Apartment and "E-1" filed for the September Planning Commission meeting. The applicant requested deferred of thirty days which was granted by the Commission. On October 4th., prior to the scheduled re -hearing, the applicant withdrew the apartment portion of the request. The "E-1"1_lot was rezoned on September 20, 1971. The applicant has submitted by this application all of the former "E" - Apartment request, the "E -l" lot and the adjacent lots along Mississippi Avenue which have not been previously considered on -a rezoning request. The Staff recommends denial of this application, An "F" -Commercial development at this location would be highly undesirable and incompatible with the sunrounding land uses - Anthony School is adjacent on the west, practically new homes on the north, and a well established and stabilized residential development on the south. Tanglewood apartment complex lies across the street to the east and the topography physically separates the Tanglewood commercial complex lying across the street to the north portion of this property. It is the opinion of the Staff that the -location and topography favor single-family development of the property similar ,to other single-family development in this area. The tract is sufficiently wide enough to permit construction of a street between Iowa and Ohio with the lots rearing onto those facing Mississippi which are occupied by well maintained and high quality single-family homes. Mr, Samuel Raines, the applicant, was present. He stated that this property abuts Anthony School, but this is a private school and can't be classified as a public school. It is a business -type operation, he said, and can be a buffer to the property to the west. Mississippi Street has been widened and is now an arterial street and this is the reason for the application for "F" -Commercial zoning in order to obtain prices for the property owners in this area that they would like to have. "In its present use as residential property, this would not -be justified as far as price is concerned. There is a definite hazard to those living on Mississippi." If you could walk down Iowa some warm summer afternoon and see and smell the stream of trash and sewage often flowing in the make -shift gutter, you would understand paft of my objection to certain plans: of rezoning. This condition is not new. I don't have the answer, but I know more business would only make a bad matter worse, I can see the needq perhaps, for the use of this land, and the owners desire to sell, but I can also envision a strip of moderately priced homes on this land, with a private street from fowa to Ohio, and a buffer zone of trees or shrubs, to shield the homes from the school.
