None. Staff recommends approval of the requested PD -R zoning. The Planning Commission voted to recommend approval of the requested zoning, as recommended by Staff, by a vote of 8 ayes, 0 noes, 2 absent and 1 recuse (Mizan Rahman). The Planning Commission reviewed the proposed PD -R request at its August 26, 2004 meeting. There were registered objectors present. All property owners within 200 feet of the site, all residents within 300 feet, who could be identified, the John Barrow Neighborhood Association and the Westwood Neighborhood Association were notified of the Public Hearing. The Little Rock Board of Directors rezoned this site from B -Residential to MF -12 on October 5, 1971, by the adoption of Ordinance No. 12,547. The applicant has indicated the development will be constructed with 22 single-family homes, a mosque and an education building. The site plan indicates a 25 -foot BACKGROUND CONTINUED building setback will be provided on the front of all the proposed lots and a 20 -foot rear yard setback is being proposed. Other uses in the area include a manufacturing facility in the old Borden Plant and non-residential uses are scattered along Colonel Glenn Road. 2 FILE NO.: Z -2502-A Cont.) The area to the west and north of the site are predominately residential uses. To the east of the site is a vacant tract currently zoned MF -12. C. NEIGHBORHOOD COMMENTS: As of this writing, Staff has received several phone calls from an area resident requesting additional information. The John Barrow Neighborhood Association, the Westwood Neighborhood Association, all property owners within 200 feet of the site and all residents, who could be identified, within 300 feet of the site were notified of the Public Hearing. D. ENGINEERING COMMENTS: Public Works - 1 . orks: 1. Prior to final platting, provide design of street conforming to the Master Street Plan. Construct one-half street improvement to the streets including 5 -foot sidewalks with the planned development. 2. For existing improvements, repair or replace any curb and gutter or sidewalk that is damaged in the public right-of-way prior to occupancy. 3. A grading permit in accordance with Section 29-186 (c) and (d) will be required prior to any grading or excavation activities at the site. Site grading, and drainage plans will need to be submitted and approved prior to the start of construction. 4. Storm water detention ordinance applies to this site. Show the proposed location for storm water detention facilities on the plan. 5. Increase the driveway width to 26 -feet minimum (back of curb to back of curb) to provide adequate width for two-way traffic. 6. Prepare a letter of pending development addressing streetlights as required by Section 31-403 of the Little Rock code. Contact Traffic Engineering at (501) 379-1813 (Steve Philpott) for addition information regarding street light requirements. 7. Plans of all work in the right-of-way shall be submitted for approval prior to start of work. On site fire protection will be required. A Capital Investment Charge based on the size of connection(s) will apply to this project in addition to normal charges for all connection off Potter Street. This fee will apply to all connections including metered connections off the private fire system. Existing waterline easement recorded as Inst. No. 86-66357 should be reflected on the plat. It appears that this will affect the buildable area on Lots 1, 11 and 23. Contact Central Arkansas Water at 992-2434 for additional information. ISSUESITECHNICALIDESIGN: Planning Division: This request is located in the Boyle Park Planning District. The Land Use Plan shows Single Family for this property. The applicant has applied for a PDR for a mosque and a single-family residential development. The request does not require a change to the Land Use Plan because it is not necessary to recognize every religious institution on the Land Use Plan. Master Street Plan: Potter and 40th Streets are shown as local streets on the Master Street Plan. Those streets previously named may require dedication of right-of-way and half -street improvements. City Recognized Neighborhood Action Plan: The applicant's property lies in the area covered by the John Barrow Neighborhood Action Plan. The Housing & Neighborhood Revitalization Goal states: 1) "The design should be compatible with existing houses in the area and complement the overall appearance of the neighborhood, and 2) Affordable housing through new development and new subdivision development. The Public Improvement and Circulation Goal list an objective of "To provide (no parking signs) on one side of Potter Street." Landscape: A minimum of eight percent of the interior of the vehicular use areas must be landscaped with interior landscape islands of at least 150 square feet in area and 7 Y2 feet in width. The plan submitted does not satisfy this requirement. Landscaped areas associated with the proposed parking areas will be required to be irrigated. 4 FILE NO.: Z -2502-A (Cont.) G. SUBDIVISION COMMITTEE COMMENT: (June 24, 2004) A representative of the applicant was present representing the proposed development. Staff stated the request included the development of a single- family neighborhood as well as a worship center and education facility. Staff requested the applicant provide additional information concerning the proposed preliminary plat request. Staff also requested the applicant provide details concerning the seating capacity of the worship center, the total enrollment of the education facility, details concerning proposed fencing and maximum building height. Public Works comments were addressed. Staff stated the proposed street extending from Potter Street would be required to be 26 -feet of pavement for two-way traffic. Staff also stated storm water detention would be required on the site. Landscaping comments were addressed. Staff stated the parking area would require landscaping at eight percent of the total on-site paved area. Staff also stated irrigation would be required to water landscaped area. There was no further discussion of the item. The Committee then forwarded the item to the full Commission for final action. H. ANALYSIS: The applicant submitted a revised site plan to staff addressing most of the issues raised at the June 24, 2004 Subdivision Committee meeting. The applicant has provided the proposed details of the worship center, the total enrollment of the education facility and the details concerning proposed fencing. The applicant has also increased the driveway width to 26 -feet of pavement for the proposed drive to the worship center. The applicant has indicated the development will be constructed with 22 single- family homes, a mosque and an education building. The site plan indicates a 25 - foot building setback will be provided on the front of all the proposed lots and a 20 -foot rear yard setback is being proposed. The applicant has indicated a ten foot side yard setback will be maintained. The average lot size proposed is 6313 with the minimum lot size proposed as 6024. Staff is supportive of the applicant's request. Lots in the John Barrow Addition, which have been plated in this area average fifty feet by one hundred thirty eight feet or 6000 square feet, The applicant has indicated front lot widths of sixty feet and a lot depth of 100 feet on the average. Although, the proposed lots do not meet the current city requirement for R-2, zoned property (7,000 square feet) staff feels the lots are adequate to allow the construction of new 5 FILE NO.: Z -2502-A (Cont. homes. In addition, with the reduced rear yard setback will allow for additional buildable area on the site. The applicant has indicated the maximum number of students for the education building will be 50 students. The applicant has indicated five teaches and three support personnel will be on site. The hours proposed are from 8:00 am to 5:00 pm five days per week. Staff is supportive of the applicant's request. The indicated students and staff appear to be consistent with other private schools located within the City and should have minimal impact on the adjoining properties. The applicant has indicated the worship center will have a maximum seating capacity of 100 persons. The applicant has indicated daily activities will take place on the site from 5:00 am to 9:00 pm seven days per week. Staff is supportive of the applicant's request. The worship center appears to be seminar to other neighborhood churches located throughout the city and should have minimal impact on the adjoining properties. The applicant has indicated the worship building will be a maximum of 36 feet in height and the mineret (steeple) height is proposed as forty feet. The education building is proposed as a single story building and the residential homes are proposed as a maximum of two story structures. Staff is supportive of the applicant's indicated building heights for each of the indicated activities. The applicant has indicated interior landscaping within the proposed parking area. The applicant has not indicated screening to the property to the east of the Mosque. Staff recommends a screening fence be placed along the eastern property line of proposed Lot 23 to allow for the required screening. The proposed subdivision is scheduled to be developed in five phases. The first phase will consist of the development of the single-family homes along West 40th Street. The second and third phase will include the construction of 7 and 8, 9 and 10. The fourth phase will include the construction of the school and mosque. The final phase will be the development of the lots along the proposed cul-de-sac street. Staff is supportive of the applicant's indicated phasing plan. Staff is supportive of the applicant's request. The applicant has indicated the development of a single-family subdivision with a school and worship center anchoring the subdivision. Staff feels the placement of the indicated activities on the site should have minimal impact on the adjoining properties. In various locations through out the city neighborhood schools and churches coexist with single-family homes with little to no impact. STAFF RECOMMENDATION: Staff recommends approval of the request subject to compliance with the conditions outlined in paragraphs D, E and F of the above report. 1.1 FILE NO.: Z -2502-A (Cont. Staff recommends a screening fence be placed along the eastern property line of proposed Lot 23 to allow for the required screening. PLANNING COMMISSION ACTION: (AUGUST 26, 2004) The applicant was present. There were registered objectors present. Staff presented the item with a recommendation of approval of the request. The applicant stated he had worked with the various neighborhood associations in developing plans for the site. He stated he felt the development was quality in fill for the neighborhood. He stated the Islamic Center had been working with the neighborhood since 1998 and the intent was always to construct a mosque, education facility and single-family homes. He stated a Bill of Assurance would be developed for the single-family homes and all Muslim's would be required to sign the Bill of Assurance to indicate their devotion to following the guidelines of the Koran. The applicant stated non -Muslim's would not be required to participate in that particular aspect of the Bill of Assurance. Questions were raised as to the ownership of the property and if the development was to be a gated community. The applicant stated the Islamic Center for Human Excellence owned the property. He stated the development was not to be a gated community. The applicant stated any one regardless of race, creed or religion would be able to purchase a lot within the proposed subdivision. Questions were also raised concerning the "call to prayer". The applicant stated the volume level of the "call to prayer" was only intended to reach those standing immediately outside the building. Mr. Tim Lawson addressed the Commission in opposition of the proposed request. He stated he had lived in the area 40 plus years. He stated the Little Rock School District had spent several years trying to resolve the issues of desegregation through the courts. He stated to allow a development which only allowed Muslims was taking a step backward. Ms. Carolyn Hitman addressed the Commission in opposition of the proposed request. She stated as Secretary of the John Barrow Neighborhood Association she want to put on record the Neighborhood Association had not taken a formal vote on the proposed issue. She stated the vote would be taken at the next board meeting. She stated as a resident she was concerned with a development of the indicated intensity being developed on the site. She stated the applicant was indicating the development of twenty-two single-family homes and a Mosque and educational facility. She stated she felt the development was too intense for the site. She stated the proposed development did not fit with the character of the neighborhood. She stated the neighborhood had spent fourteen years trying to rid itself of gangs, crime and violence. She stated the neighborhood was tired of the City allowing the John Barrow Community to be a dumping ground for things the City did not know what to do with. She stated the applicant had indicated the developer had indicated he wanted to be inclusive of the neighborhood. She questioned if the developer had twenty-five 7 FILE NO.: Z -2502-A (Cont. commitments how this was being inclusive. She stated the proposal only included the placement of twenty-two homes. She stated the area residents were not given a chance to purchase one of the proposed homes since all lots were already committed to other potential Muslim buyers. The applicant has also increased the driveway width to 26 -feet of pavement for the proposed drive to the worship center. The applicant has indicated the development will be constructed with 22 single- family homes, a mosque and an education building. The site plan indicates a 25 - foot building setback will be provided on the front of all the proposed lots and a 20 -foot rear yard setback is being proposed. The applicant has indicated a ten foot side yard setback will be maintained. The average lot size proposed is 6313 with the minimum lot size proposed as 6024. Staff is supportive of the applicant's request. Lots in the John Barrow Addition, which have been plated in this area average fifty feet by one hundred August 26, 2004 SUBDIVISION ITEM NO.: H (Cont.)FILE NO.: Z -2502-A thirty eight feet or 6900 square feet. The applicant has indicated front lot widths of sixty feet and a lot depth of 100 feet on the average. In addition, with the reduced rear yard setback will allow for additional buildable area on the site. The applicant has indicated the maximum number of students for the education building will be 50 students. The applicant has indicated five teaches and three support personnel will be on site. The indicated students and staff appear to be consistent with other private schools located within the City and should have minimal impact on the adjoining properties. The worship center appears to be seminar to other neighborhood churches located throughout the city and should have minimal impact on the adjoining properties. The applicant has indicated the worship building will be a maximum of 36 feet in height and the mineret (steeple) height is proposed as forty feet. The education building is proposed as a single story building and the residential homes are proposed as a maximum of two story structures. Staff is supportive of the applicant's indicated building heights for each of the indicated activities. The applicant has indicated interior landscaping within the proposed parking area. The applicant has not indicated screening to the property to the east of the Mosque. Staff recommends a screening fence be placed along the eastern property line of proposed Lot 23 to allow for the required screening. The proposed subdivision is scheduled to be developed in five phases. The first phase will consist of the development of the single-family homes along West 40th Street. PLANNING COMMISSION ACTION: (AUGUST 26, 2004) The applicant was present. There were registered objectors present. Staff presented the item with a recommendation of approval of the request. The applicant stated he had worked with the various neighborhood associations in developing plans for the site. He stated he felt the development was quality in fill for the neighborhood. He stated the Islamic Center had been working with the neighborhood since 1998 and the intent was always to construct a mosque, education facility and single-family homes. He stated a Bill of Assurance would be developed for the single-family homes and all Muslim's would be required to sign the Bill of Assurance to indicate their devotion to following the guidelines of the Koran. The applicant stated non -Muslim's would not be required to participate in that particular aspect of the Bill of Assurance. Questions were raised as to the ownership of the property and if the development was to be a gated community. The applicant stated the Islamic Center for Human Excellence owned the property. He stated the development was not to be a gated community. The applicant stated any one regardless of race, creed or religion would be able to purchase a lot within the proposed subdivision. Questions were also raised concerning the "call to prayer". The applicant stated the volume level of the "call to prayer" was only intended to reach those standing immediately outside the building. Mr. Tim Lawson addressed the Commission in opposition of the proposed request. He stated he had lived in the area 40 plus years. He stated the Little Rock School District had spent several years trying to resolve the issues of desegregation through the courts. He stated to allow a development which only allowed Muslims was taking a step backward. Ms. Carolyn Hitman addressed the Commission in opposition of the proposed request. She stated as Secretary of the John Barrow Neighborhood Association she want to put on record the Neighborhood Association had not taken a formal vote on the proposed issue. She stated the applicant was indicating the development of twenty-two single-family homes and a Mosque and educational facility. She stated she felt the development was too intense for the site. She stated the proposed development did not fit with the character of the neighborhood. She stated the neighborhood had spent fourteen years trying to rid itself of gangs, crime and violence. She stated the neighborhood was tired of the City allowing the John Barrow Community to be a dumping ground for things the City did not know what to do with. She stated the applicant had indicated the developer had indicated he wanted to be inclusive of the neighborhood. She questioned if the developer had twenty-five commitments how this was being inclusive. She stated the proposal only included the placement of twenty-two homes. She stated the area residents were not given a chance to purchase one of the proposed homes since all lots were already committed to other potential Muslim buyers. Ms. Kathy Wells addressed the Commission in support of the proposed request. She stated she was representing the Episcopal Bishop of Arkansas. She stated the church was supportive of the proposed development and the diversity of populations around the world. She stated the fears of residents from existing actions of extremist organizations do not represent the views or the wills of most citizens. Mr. Don Darnell addressed the Commission in support of the proposed request. He stated he was an advocate for Civil Rights and Fair Housing Laws. He stated the proposed development would allow for diversity of residents and housing in the area. He stated according to Fair Housing Laws a person can not be denied a home based on race, creed or religion. He stated this did not apply to religious organizations. He stated the charge of the Commission was not to establish all equalities but to determine if the land use was appropriate for the proposed location. There was a general discussion concerning the Fair Housing Laws. A question was raised as to if any one would be able to purchase a home in the subdivision. The applicant stated no one would be discriminated against because of race or religion. He stated the lots would be available for anyone to purchase. A motion was made to approve the request. Construction on the develop- ment will begin in January, said Aquil Hamidullah, resident imam of the Islamic Center for Human Excellence. During the meeting, Deputy City Attorney Melinda Raley si- lenced several city directors and neighborhood residents who in- quired about the religious prac- tices of the congregation build- ing the community at 40th and Potter streets. "Do you ask that of every ap- plicant?" Raley asked several times. After the vote, members and supporters of the Islamic Center celebrated the board's decision. "I'm feeling wonderful," said Sister Maryam Numan, a Mus- lim who lives in the John Barrow neighborhood. "It's going to be a peaceful community. That's why we support it." The lands embraced in said plat shall be forever known as New Africa Community, Phase I, being a plan development in the east of South east Quarter, Section 14, Township 1 South, Range 13, West, Pulaski County, Arkansas, and any and every deed of conveyance of any lot in said plan development describing the same by the number of numbers shown on said plat shall always be deemed a sufficient description thereof. Said lands herein platted and any interest therein shall be held, owned and conveyed, subject to and in conformity with the following covenants which, subject to being amended or cancelled as hereinafter provided, shall be and remain in full force and effect until to -wit: DEFINITION OF TERMS USED For the purpose of these restrictions, the word "street" shall mean any street, terrace, drive, circle, or boulevard. The word "lot" shall mean as platted, but excluding the tracts designated as Reserved. A "corner lot" shall be deemed to be any lot as platted having more than one street contiguous to it. Definition of plan development Buyer(s) and sellers are aware that this development, including the sell of lots and etc. is for the purpose of creating a wholly owned residential Al - Islamic community conforming to the social guidelines given in the Quran and modeled in the life of Prophet Muhammed Ibn Abdullah and all parties agree to this purpose. 3 RESTRICTIONS I. Use of land. None of the lots defined as "Phase 1" may be improved, used, or occupied for other than private residence purposes, and no duplex, flat, apartment or condominium, although intended for residence purposes, may be erected or maintained thereon. The tracts of land designated on the plat of New Africa Community, Phase I as Reserved shall be used in accordance with regulations of the city of Little Rock and Pulaski County, Arkansas. 2. Axeliitec.tural Coinmittee. No building shall be erected, placed or altered on any lot or tract designated as Reserved in this plan development until the building plans and specifications therefore, exterior color scheme and materials thereof, and plot plan, which plot plans show the location and facing of such building, have been approved in writing by a majority of an architectural committee designated by the Islamic Center Board composed of lot owners who are desi Lied, or their duly authorized representatives, representative or successors. In the event of the death or resignation of any member or members of the above-named committee, the remaining member or members shall have full authority to approve or disapprove such plans, specifications, color scheme materials and plot plan, or to designate a representative or representatives with like authority to fill any vacancy or vacancies created by the death or resignation of any of the aforesaid members, and said newly appointed members or member, shall have the same authority hereunder as their predecessors as above set forth. In the event the architectural committee fails to approve or disapprove any such plans, specifications, color scheme, materials and plot plans submitted to it as herein required within thirty (30) days after such submission or in the event no suit to enjoin the erection of such building or the making of such alterations has been commenced prior to the completion thereof, such approval shall not be 4 required and this covenant shall be deemed to have been fully complied with. The architectural committee shall not be liable for any approval given hereunder and any, approval given shall not be considered as a waiver of any requirement of or restriction in this Bill of Assurance. Nothing herein contained shall in any way be deemed to prevent any of the owners of property in this plan development from maintaining any legal action relating to the improvements within this plan development, which they would otherwise be entitled to maintain. The powers and duties of such committee or its designated representatives shall cease on or after approval of Lots 1-25 defined as residential Phase 1. Thereafter, the approval described in this covenant shall be transferred, maintained, and executed by New Africa Homeowners Association. A written instrument shall be executed by the then record owners of a majority of the lots in this plan development and duly recorded, appointing a representative or representatives who shall thereafter exercise the same powers as previously exercised by said committee. 3. Heights and Type of Residence. No residence shall be erected, altered, placed or permitted to remain on any lot numbered 1-25 in New Africa community, residential Phase I, other than one detached single-family residence not to exceed two and one-half stories in height or a split-level residence and a private garage or carport for not less than one (1) and no more than two (2) cars. 4. Plan development of Lots.. No lot shall be re -subdivided into a smaller lot. 5. Set --back Requirements. No residence shall be located on any lot nearer to the front lot line or nearer to the side street line than the minimum building set -back lines shown on the recorded plat. No building shall be located nearer to an interior lot line than a distance of 10% of the average width of the lot or 8 feet, whichever is less, except that a permitted accessory building located 35 feet or more from the minimum building set -back line may be placed not F nearer than 5 feet from the side or rear lot line. No principal dwelling shall be located on any lot nearer than 25 feet to the rear lot line. For the purposes of this covenant, eaves, steps and porches not under roof shall not be considered as a part of the building. 6. Area. No dwelling shall be constructed or permitted to remain upon any lot in this plan development which has a finished heated living area measured in a horizontal plane to the face of the outside wall at the top plate line of such dwelling less than 1,450 square feet, except as provided hereinafter: (a) Two or More Levels - Basement Tytae. If a dwelling has finished heated living area on a different level, and the finished floor levels of such areas are separated by more than eight feet measured vertically, then such dwelling shall have at least 1,100 square feet of finished heated living area measured in a horizontal plane to the face of the outside wall at the top plate line of such dwelling, and shall have at least a total of 1,700 square feet of finished heated living area: however, the top plate line amount of floor space may be reduced from 1,100 square feet of finished heated floor space to 900 square feet of finished heated floor, if the double garage area of not less than 450 square feet is also on the top plate line level, and the total heated finished area in the dwelling is not less than 1,800 square feet of floor space. (b) Two-StoKy and Star -and-a-Half. If a dwelling has finished heated living areas on two or more levels or stories, which levels or stories are immediately above and below each other measured vertically and all of such levels or stories are above the finished exterior grade of such dwelling, then such dwelling shall have at least 900 square feet of finished heated living area measured in a horizontal R plane to the face of the outside wall at the top plate line of the first level or story, of such dwelling and shall have at least a total of 1,700 square feet of finished heated living area, provided, however, that the top story or level may have less than 700 square feet of finished heated living area if the first level or story shall have at least 1,200 square feet of finished heated living area measured in a horizontal plane to the face of the outside wall of the first level or story of such dwelling and such dwelling shall have at least a total of 1,700 square feet of finished heated living area. In the computation of finished heated living area, the same shall not include any basement or attic area used for storage. All dwellings shall have an attached carport or garage for at least two automobiles. 7. Commercial Structures. No building or structure of any sort may ever be placed, erected or used for business, professional, trade or commercial purposes on any portion of any lot. This prohibition shall not apply to any business or structures that may be placed on any lot or portion of a lot that is used exclusively by a public utility company in connection with the furnishing of public utility service to New Africa Community, Phase I. 8. Outbuildings Prohibited. No outbuilding or other detached structure appurtenant to the residence may be erected on any of the, lots hereby restricted without the consent in writing of the architectural committee, unless a detached garage. 9. Livestock and Poultry Prohibited. No animals, livestock or poultry of any kind shall be raised, bred or kept on any lot or part thereof, except that dogs, cats or other household pets may be kept provided they are not kept, bred or maintained for commercial purposes. 10. Noxious Activity. No noxious or offensive trade or activity shall be carried upon any nor shall any trash, ashes or other refuse be thrown, placed or dumped upon any vacant lot 7 nor shall anything be done which may be or become an annoyance or nuisance to the neighborhood. No vehicle may be stored or allowed to be parked on any lot unless said vehicle is in evident good operative condition. 11. Billboards Prohibited. The construction or maintenance of billboards or advertising boards or structures or signs on any lots is specifically prohibited except that billboards, advertising board, structures or signs used by the Islamic Center for Human Excellence advertising the sale or rental or such property during the construction and sales period are permitted provided they do not exceed 5 square feet in size or signs approved by the Architectural committee/New Africa Homeowners Association displaying the name of a residential complex, commercial establishments, parking instructions or regulations relating to the use of recreation facilities. 12. Oil and Mineral Operations. No oil drilling, oil development operating, oil refining, quarrying or mining operations of any kind shall be permitted upon or in any building site, nor shall oil wells, tanks, tunnels, mineral excavations or shafts be permitted upon or in any building site. No derrick or other structure designed for use in boring for oil or natural gas shall be erected, maintained or permitted upon any building site. 13. Cesspool. No leaching cesspool shall ever be constructed or used on any lot. 14. Existing Structure. No existing, erected building or structure of any sort may be moved onto or placed on any of the above-described lots without prior written approval from one of its predecessors, the architectural committee, or NAHA. 15. TemporM Structures. No trailer, basement, tent, shack, garage, barn or other outbuilding other than a guest house and servants' quarters erected /on a building site covered by 8 these covenants shall at any time be used for human habitation, temporary or permanently, nor shall any structure of a temporary character be used for human habitation. 16. Easements for Public Utilities. Easements for the installation, maintenance, repair and replacement of utility services, sewer and drainage have heretofore been donated and dedicated, said easements being of various widths, reference being hereby made to the plat filed herewith for a more specific description of width and location thereof. In the event any trees, shrubbery, incinerators, structures, buildings, fences, pavement or similar improvements shall be grown, built or maintained within the area of such easements, no person, firm or corporation engaged in supplying public utility services shall be liable for the destruction of same in the installation, maintenance, repair or replacement of any utility service located within the area of such easement. 17. Fences. No fences, enclosure or part of any building of any type or nature whatsoever shall ever be constructed, erected, placed or maintained closer to the front lot line than the building setback line applicable and in effect as to each lot; provided, however, that it is not the intention of this paragraph to exclude the use of evergreens or other shrubbery to landscape front yards. All fences shall be of wood construction and their design shall be approved by NAHA/architectural committee. Moreover, no automobile, truck, trailer, tent or temporary structure of any nature whatsoever, shall every be parked, located or otherwise maintained on any lot, provided that it is not the intention of this paragraph to exclude the temporary parking of passenger automobiles on any portion of the garage driveway. 18. Sight Line Restriction. No fence, wall, hedge or shrub planting which obstructs sight lines at elevations of more than thirty inches above roadways shall be placed or permitted to remain on any corner lot within the triangular area formed by the street property line and a line 6 connecting them at points fifty (50) feet from the intersection of the street line, or in the case of a rounded property corner, within the triangle formed by tangents to the curve at its beginning and end, and a line connecting them at points fifty feet from their intersection. The foliage line of any tree located within such distances of such intersections must be maintained at a height of not less than eight-- feet from the adjacent roadway to prevent obstruction of such sight lines. 19. Property Lines and Boundaries. Iron pins have been set on all lot corners and points of survey and all lot dimensions shown on curves and chord distances, and all curve data as shown on the attached plat filed herewith is center line curve data. In the event of minor discrepancies between the dimensions or distances as shown on the attached plat and the actual dimensions or distances as disclosed by the established pins, the pins as set shall control. 20. Right to Enforce. The restrictions herein set forth shall run with the land and shall bind the present owner, its successors and assigns, and all parties claiming by, through or under it shall be taken to hold, agree and covenant with the owner of the lots hereby restricted, and with its successors and assigns, and with each of them to conform to and observe said restrictions, as to the use of said lots and the construction of improvements thereon, but no restriction herein set forth shall be personally binding upon any corporation person or persons, except in respect to breaches committed during its, his or their seisin of title to said land, its successors and assigns, and also the owner or owners of any of the lots hereby restricted shall have the right to sue for and obtain an injunction, prohibitive or mandatory, to prevent the breach of or to enforce the observance of the restrictions above set forth, in addition to ordinary legal action for damages and failure of its successors or assigns, or any owner or owners of 10 any lot or lots in this plan development to enforce any of the restrictions herein set forth at the time of its violation shall, in no event to be deemed to be a waiver of the right to do so thereafter. may, by appropriate agreement made expressly for that purpose, assign or convey to any person or corporation all of the rights, reservations and privileges herein reserved by it, and upon such assignment or conveyance being made, its assigns or grantees may at their option exercise, transfer or assign these rights or anyone or more of them at any time or times in the same way or manner as though directly reserved by them or it in this instrument. 21. Modification of Restriction. Any and all of the covenants, provisions or restrictions set forth in this Bill of Assurance may be amended, modified, extended, changed or cancelled in whole or in part, by a written instrument signed and acknowledged by the owner or owners of more than 80% in area of the land in this plan development, and the provisions of such instrument so executed shall be approved by the Little Rock Planning Commission and shall be binding from and after the date it is duly filed for record in Pulaski County, Arkansas. Approximately 20 residents were in attendance along with Donna James, Subdivision Administrator, City of Little Rock Planning Department, and Mr. Taheed Salaam, representative for the Islamic Center for Human Excellence, (owner and applicant of above mentioned properties). Meeting was called to order by Carolyn Heitman, Secretary and Board Member for the John Barrow Neighborhood Association and introduction of Ms. Jaynes and Mr. Salaam preceded opening of discussions on the proposed development. Mr. Salaam, stated he had come before the John Barrow Neighborhood prior to purchasing land at 40+h and Potter and discussed development. However, after later reviewing facts, The Neighborhood Association learned of ownership in early 1998 after complaints had been received through the Westwood Alert Center about young men riding four wheelers, go caxts and cars. At that time, Mr. Taheed Salaam was contacted and a meeting was scheduled with him and several other representatives from the Islamic Center at the Westwood Alert Center. That started a series of meeting that had led us to where we currently are. Mr. Salaam began by saying he knew we were not in favor of apartments being developed on this property. He stated the Islamic Center wanted to develop a small community with an Educational Facility, Prayer Facility and 23 Single Family Home. They currently have approximately 30 children enrolled in their school at another location in the City of Little Rock. The Mosque would be a community based institution that basically serves that group of persons. Development will be done in 5 phases, hopefully beginning in 2005. When asked about the size of homes it was stated between 1500-2400 sq.ft. Design of home, brick, wood, and combination has not been concluded. Traffic concerns were addressed: very minimal , main meeting would be on Friday from 1:15 to 2:O0p.m. and may generate 16 to 17 cars. Parking will be inside of development for educational and religious facilities. At this time, meeting was opened for questions and concerns: STATRUMM: One resident stated it is to congested for the amount of space for all this development. Also, it would be changing the facial structure of a neighborhood. Mr. Salaam responded with, " this development will be complimentary -improve look of area, will have a Bill of Assurance. Not sure of housing assistance for homes but will look into different options City of Little Roth and Government may have available. Also, individual owners can acquire their own financing. STATEMENT AND QUESTION: Will there be a stipulation as to the number of people that can live in one resident? Mr. James stated that City of Little Rock has ordinances in place to handle that aspect of property. It is nothing different from any other community responded Mr. Salaam. STATEMENT; One resident stated, " Let's be realistic, the residents belong to the Muslim faith, a face lift is being done to accommodate approximately 50 students, and building 22 homes of which most will be of your community. Most people in this room still this development as a community within a community, or a project. QUESTION: What is being offered to our neighborhood? Mr. Salaam responded with the fact that a new facility will be built and it will be open for use by our neighborhood. Membership, over the past several years, has met with Mr, Taheed Salaam and other representatives from the Islamic Center for Human Excellence concerning rezoning and development of property owned by them at 401h & Potter streets. However, no concrete plan was in place until now. At the June, 2004 meeting of the Association, Mr. Salaam presented a proposal for the rezoning of property which would allow for 23 Single Family homes, a Mosque, and an Educational Building. Mr. Salaam has kept the Association abreast of progress or changes concerning proposed development, however, it was apparent from discussions, at the June, 2004 meeting, several unknown factors still existed. With that, it was suggested a Public meeting be scheduled in order for additional information to be obtained. A meeting was set, however, due to conflicting schedules and the applicant needing to submit additional information to the Planning Department, this item was deferred until the August 26th, 2004, meeting of the Planning Commission. No vote was taken by the John Harrow Neighborhood Association membership present at the August, 2004 meeting which states our position on the proposed development.
