OF NEW ST.• 0 "PCD" - Dairy Bar The ownLr of the property on Barrow Road and Morris Manor Drive is seeking to rezone the property as a -planned commercial development. The 0.3 acre tract has 140 feet frontage on Barrow Road and it has been zoned 110-311. The purpose of the request'is to permit the use as a dairy bar. There will be no -service inside; all will be done by drive-thru and pick-up orders. The operation hours will be from 10 a.m. to 9 p.m. with a maximum of 5 employees in the summer time. A. PROPOSAL/REQUEST: This application invol a 0.3 acre tract of land which is proposed for use as a drive-thru dairy bar. 1 July 17, 1990 SUBDIVISION Item No. 7 Continued B. EXISTING CONDITIONS: The site is covered with scrub, brush and trees. The adjacent streets are constructed to the City's standards. C. ENGINEERING COMMENTS: Provide sidewalks on Barrow Road and Morris Manor Drive frontages. Pedestrian crossing of Barrow Road may become dangerous due to the location. D. ISSUES/LEGAL/TECHNICAL/DESIGN: The principal concern of the Staff is the adopted lai.a use plan for this neighborhood which provides for maintaining an office corridor along Barrow road. This corner is proposed for an office usage on that plan, which would be a less intense activity for such a busy Barrow Road, especially across the street from the high school campus. Additionally, the site is too narrow for the amount of physical improvements that are proposed. E. ANALYSIS• The Planning Staff's view of this proposal is that it is too much on too little land. This corner, due to its unique location and relationship to the school, will no doubt cause disruption in the traffic flow on Barrow Road, not only during peak hours but at other hours as well. Staff also feels that approval of this PCD would only continue the striping out of the Barrow Road as retail activity. Currently, this road is threatened at several points with commercial expansion and eliminating the various office nodes which separate the large commercial pockets. We feel there is sufficient commercial zoning in this area that would accommodate this use. Such areas are located at the intersection of Barrow Road and Kanis and Barrow Road and West 36th Street. 2 July 17, 1990 SUBDIVISION Item No. 7 (Continued) F. STAFF RECOMMENDATION: The Planning Staff recommends denial of the proposal as being in violation with adopted land use, a source of traffic problems and an unsuitable site for a drive- thru business. SUBDIVISION COMMITTEE COMMENTS: (July 5, 1990) Mrs. Joan Harrison was present. The Staff recommendation was discussed. Mrs. Harrison addressed the Staff's concerns. It was determined that this land use matter needs to be discussed by full Commission. Comments from the Engineering Department were offered. It was pointed out that driveways and building needs to be redesigned to allow safe traffic circulation on the site. Mrs. Harrison agreed to submit a revised site plan and talk to school officials. There being no further discussion on this item, the matter was forwarded to the full Commission for resolution. 3 July 1.7, 1990 1 SUBDIVISION -It ern _N q.__. 7 __ .. ( Cont inued ) PLANNING COMMISSION ACTION: (July 17, 1990) There were several objectors in attendance. The applicant was present. The Planning Staff recommended denial of the proposal as being in violation with adopted land use, source of 'traffic problems and unsuitable for drive thru business. The Chairman then asked Ms. Harrison to present her application. Ms. Harrison offered a lengthy presentation herein she addressed the staff's comment. She described the location as being excellent for the dairy bar drive thru because the amount of traffic. She states that high school is a closed campus for gifted children and they would not be allowed to run across the street. She further responded to the staff's comment by showing letters from the School Board members supporting her proposal. She also presented her personal check to the Planning Commission Members showing the price she paid to the seller for the property. Commission Chairman then asked David Jones, representing property owner directly north to express his opinion. Mi.. Jones stated that. he supports the project. and he t.,ould lime to see more development on this part of Barrow Road. The Commission then asked the next person to present his position. Mr. J. Babbs, principal of the Parkview High School, opposed this development being a traffic hazard for his students. The Chairman then recognized the next. objector, Mr. Chip Jones. Mr. Jones supports S'taff's recommendation in behalf of Dr. Steele, School Superintendent. The Chairman then recognized another person present who desired to offer comment in objection. This person was Ms. Gantt, owner of the Day Care located southeast of Ms. Harrison's property. Her concerns are traffic and safety for her Day Care. The Chairman then recognized Ms. Harrison statement. She states that school is 1/4 property and her business does riot create presently exist. 1 for closing mile from her more traffic than July 17, 1990 SUBDIVISION Item No. 7 (Continued} Commissioner McDaniel then inserted a comment to the effect that he cannot support this item being so close to school. The motion was then offered to recommend approval of this PCD as filed. The vote was 0 ayes, 10 nays, 1 absent. The motion failed and the application was denied. The proposed site is directly across the street from Parkview Arts/Science Magnet High School and would warrant significant problems for us if approved. The following concerns are presented: 1) John Barrow Road is a (5 lane) major traffic artery of the city. Student efforts to cross the street would be hazardous. At present, we have flashing yellow caution lights warning oncoming traffic during our opening and closing times. This business is proposed directly in front of the primary entrance for our students and buses. Traffic is very heavy during designated periods and presents a real danger. 2) This type of business setting would increase supervision concerns for us to operate a closed campus. Incidents relating to school tardiness, loitering and truancy would be increased. It is our primary intent to provide students with an instructional setting that is safe and orderly. All services for immediate support (food and supplies) are available within our boundaries. This proposed business would hinder our efforts to establish and foster the best interests for students and their success. Your consideration to our request is appreciated. The District objects to this rezoning based on its previous experience with two other commercial fast food establishments near high schools in our city. In both instances they have created dangerous traffic conditions and have lured students away from the school campus during the school day causing a disruption to the students' education and necessitating increased supervision by school personnel. It is my position that this kind of commercial establishment is not compatible with a place of education and would impair the District's ability to protect the educational interests of this community.
