From: "A" -One -family To: "D" -Apartment and "E-1" Quiet Business Districts The Staff's recommendation was read as follows: "This application was deferred by the Commission at its September 2nd meeting in order that the applicant have suffi- cient time to study the "MF Multi -family Districts". The Staff re -states its previous recommendation: 'The Staff recommends denial of the entire application. Request for "E-1" across the street from the northern "E-1" portion of this appli- cation was withdrawn by the same applicant on submission of an earlier petition. There appears no justification planning -wise for zoning the southernmost tract of this application to "E-1". The applied for northern tract for "D" zoning appears without justification. Property to the -west has been replatted for single-family homes. The terrain of subject property is suitable for single-family development. The southernmost applied for "D" tract would be spot zoning this 17.5 acres to the rear of a 10 acre tract fronting on Barrow Road that still remains "A" -Single-family. Any rezoning of this property in its present configuration is highly undesirable. There appears no justification which would justify rezoning subject property as applied for since there has been no major change in the neighborhood to warrant the requested rezoning. The applicant indicates in the application that he has no immediate development but plans to sell in the future." Mr. Charles Brown, attorney, was present representing the applicants. He said an amended application had been filed which in effect amended the requested "D" - Apartment to "MF 18" Multi -family, plus 125 foot strip on the north tract for "C" Two-family as a buffer between "A" -One -family and "MF 18" portion. He stated that the Commission, and they, have letters of consent from those persons in the middle portion and the Church; that they have cut this application from 35 units on "D" to 18 on "MF 18"; that this is a growing area and they need to do the planning in advance and not wait until they get into its development. He also cited anticipated increased traffic in this area which would make the area unsuitable for single- family development. Regarding the "E-1" portion on Barrow Road, the access on the lower portion would, of course, be one street going in, he said. "We do not propose any access on Barrow Road for the "E-1" area. What we propose is access through the entrance street that will be here. On the north portion the access will be from Labette Drive - no access directly on to Barrow Road. Access to the "E-1" is through Labettte with one exit in the south section permitting off-street use of traffic for those using the "E-1" section. We feel like there will be a growing need with the impact of the Baptist Medical Center." Mr. James Larrison, realtor, was present in the interest of the application, and said he wanted to re-emphasize the explosive growth that has been occurring in the John Barrow area because of the recent installation of two or three sewer improve- ment districts, and the tremendous increase in traffic that is bound to occur when the Wilbur Mills Freeway is completed. He commented that the area is going through Planning Commission Minutes - October 72_1971 a transition and that now would be the time when the City could do some "horse trading" and secure the needed rights-of-way which will be needed. This is a relative- ly undeveloped area which would provide a lot of right-of-way which eventually would cost the City a lot of money to acquire, he said. Mr. Brown added that they had withdrawn the subdivision plat, for the reason that he had talked to his client on the basis of a planned unit development type for this area which they think is the coming thing and would be an asset for multi- family development in that area. Mr. Venhaus interjected a statement that "we are going to get that dedication what- ever the land use because they will have to plat that property - 60 feet is specified on the Master Street Plan. We have seen areas where there has been wild speculation as to how quickly it will develop, and what it really means is 'we have got a lot of land that we can sell'. We Are not really talking about planning rationally for the growth that is anticipated in this area by spreading multi- family zoning willy-nilly on either side of John Barrow Road. If we are really trying to make provisions to protect ourselves from John Barrow Road, and if we are trying to come up with intelligent and rational kind of anticipation of the hospital area development, then I should think that an "MF 6" category, which would allow any kind of multi -family development except high rise, would be a reasonable kind of compromise for the entire application. This would run out an overall density of 6 units per acre, and when you are talking about large tracts of ground like this - about total development process through here - that would be much more desirable than adhering to the density suggested. I would like to point out to you that the existing property zoned in this area right now on Mr. Brown's property - MF 24- on the east side of Barrow Road, and the "D" tract on the west side from the church, we have got 590 dwelling units potential there right now - it runs out a density of 28 units per acre. If we zoned this property as is suggested we would have 1075 units. I submit to you in view of the intense multi -family potential of property at the northeast corner of Barrow and Kanis Road adjacent to Kanis Road and the 8th Street Expressway, that is a pretty substantial density. Everybody is going to insist on the opportunity to sell land out here for purposes other than single-family. Across the street we are going to be faced with the same kind of application we have here. I would recommend to you that we zone the entire property to "MF 6" which would allow them to do everything that they have suggested they would like to do." After some discussion,Mr. Brown was asked if he could live with "MF 12", to which he responded that he did not object to "MF 12" on the south tract, but on the north tract next to "D", "MF 18" is possibly a reasonably compatible use there. A motion was made that the application be approved as amended which was seconded. This motion was subsequently withdrawn. Mr. Walker suggested that the parcels be voted on separately, and made a motion to recommend zoning the portion abutting "D" to "MF 18", and "C" -Two-family as shown on the submitted plan. He then made a motion for approval of the "E-1" portion of the application,which is 300 feet in depth from Barrow Road, which was seconded aand passed. He stated that Barrow Road is designated for development as a four lane street in the future and they are faced with the problem of trying to anticipate the effect of.,the Medical Center and other business- es in that area, and whether or not it is better to plan for development for the future on Barrow Road or whether to wait to rezone for apartments and "E=1" Quiet Business in the area where there is now !.A" -One -family development already built. -7- Planning Commission Minutes September 2 1971 - , Property to the north of the Big K Development was zoned "D" by this Board; also the property to the south was zoned "C" -Two-family on Staff recommendation at the last meeting of the Commission,he said. To the west of this property is the City limits line and there is no zoning jurisdiction in this area -:anything could be built in that area. Also to the west is a lake which is now owned by Twin Lakes Property Owners Association, and if the Bill of Assurance were ever removed the property could be zoned for any purpose in the County, or otherwise held as a lake by the Property Owners Association. He said it should be noted that Labette Drive which is shown on the east side of Barrow Road has, under the plan of the proposals here, been extended and designated as a collector street. Mr. Brown said this was not spot zoning inasmuch as when this property came into the City it came in as "A" -One -family and subject to rezoning. We feel that the buffer zoning of "C" -Two-family on the south would be adequate for a buffer zone for the remaining "A"- to the south, he said. Mr. Wickard asked if the Sullivan and Reichstadt property could be included in an application so the whole area could be developed for "D" -Apartment which would be a more orderly development. Mr. Brown said these owners were in favor of the development but did not want to make application at this time. There are no objections from the Twin Lakes Property Owners Association nor the church across the street. Mr. Brown indicated that their most serious problem is the southernmost portion. "There would be some stingent side yard requirements. The density is no real problem and we could "live with" less density than "D" and would be amenable to making a covenant for "MF 16" on that property." Mr. Bob Lowe, the engineer for the development, said a subdivision plat had been filed and has been recommended for approval. The lots are to be sold for apart- ment development, and on this property the restriction of "MF" development side yard restrictions would prohibit the development of individual lots. On the Brown property which has not reached this stage, they would not object to "MF 24". Mr. Lyon explained that there is a subdivision plat for consideration which has been recommended for approval, but that this has no relationship to the use of the land. A motion was made for denial of the application, which was seconded. Mr. Brown then asked for thirty day delay for study of the "MF" zoning requirements. A show of hands was called for by the Chairman, and the motion failed for lack of suffi- cient affirmative votes. A motion was then made to defer this matter for.thirty days until the October 7th meeting, which was seconded and passed. Mr. Cunningham abstained.
