A motion was made for approval of the minutes of the last meeting as mailed which was seconded and passed. III. New Matters (Advertised Zonin Tract No. 1 -243 1123 Thayer Street From: "C" -Two-family District To . "F" -Commercial District The Staff's recommendation was read as follows: "The Staff recommends denial of the application for '°F" -Commercial and recommends instead rezoning to "E_1" Quiet Business to act as a buffer and contain any encroachment of "F" -Commercial to the east. The surrounding area is developed residentially and zoned "C" -Two family District. A survey of the surrounding,area to subject property reveals a solid mixed development of single-family, duplex and apartment usages of the land. Good City planning dictates Quiet Business development of -the property as an "appropriate and compatible use of the land and would not deny the owner a practical redevelopment of the property. Planning Commission Minutes - March 4,1971 The "F" -Commercial lot on the corner to the east has been zoned "F" some 23 years and has been and is being used as residential property. There are two single-family homes on the lot in good state of repair. The easternmost one is used also as a real estate office. In connection with this recommendation it is suggested that the Commission favorably consider the upgrade -zoning of the northwest corner of Rice and 12th Streetand the southwest corner of Dennison and 12th Streets, and both to conform to the "C" zoning of the general area. Both properties have been used for many years a higher use than their present zoning permits." Mr. Ben Rowland, Agent for the applicant, the First Church of God, as well as its pastor, were present. After hearing the Staff's recommendations for approval of "E -l" Quiet Business zoning, Mr. Rowland stated that this was acceptable to the owner. He stated that they did.not as yet have a purchaser. Mr. Walker asked if the applicant was familiar with "what is permitted in "E -l", and "F" Commercial Districts. Mr. Venhaus stated that he wanted to be sure the appli- cant understood the Staff's recommendation that we would recommend denial of the "F" -Commercial zoning, and would recommend "E -l" Quiet Business classi- fication as set out in Section 43.6 of the Code of Ordinances:: Mr. Walker than said "I don't mean to be the advocate for the petitioner, but I am just wondering if he may find when he goes to dispose of this property that the "E -l" zoning may be a little restrictive and rather than accept this zoning it might be better to find out what he proposed to do with it, and apply later. I think, perhaps I am a little surprised that you acquiesced to the Staff's recommenaation." Mr. Rowland replied that he had looked over the uses permitted in Section 43.6 but was not familiar with the restrictiona.-mentioned and asked what the restrictions were that applied to "E=1" zoning. Mr. Walker explained "You can't do what you can in an "F" -Commercial zone. You can -do whatever is permitted. I don't mean to imply that there is something mysterious abdut it. It is a somewhat restrictive zoning which does not permit commercial operations - retail business. Mr. Rowland stated that Mr. Venhaus said the property across ,the street is zoned "F" -Commercial. Mr. Venhaus explained that the property just east of the Church on the north side of the street at the corner of 'Rice Street and 12th on the northwest corner that is zoned "F" -Commercial but used as a real estate office; then on down the street two blocks on the southwest corner of Dennison and 12th there is a small drug store which is zoned Commercial. Mr. McLean suggested to Mr. Rowland that under "F"®Commercial, he could have retail sales m in fact operate a service station,, while ander "E -l" the use would have to be professional offices, etc. Mr. Rowland said the Church's position is that it needs to put this property up for sale immediately because it is moving to anew location. "Obviously they would like to get as much money for the property as possible to apply toward the erection of a neva church. In view of the two commercial uses already existing in the area, I would like to withdraw what I said about "E -l" Quiet Business zoning and request that it be zoned "F"m Commercial." Mr. McLean added that his alternative may be "F"' -Commercial, but it could be rejection of his petition. Mr. Rowland then conferred with the Pastor for a decision. -2- Planning Commission Minutes march 4,1971 Mr, hymn commented that while mrn Walker said he did not want to be the Petiti.onprls_ advocate, he was going to risk being the devil's advocate; that he thought the question before the CoVIMission and what it should Consider is `ghat is the proper use of this land for all the citizens of Little Rock, and "I think the Staff' has answered that question., at least to my satisfactions, Mr. Rowland added that since 12th Street had been widened to four lanes that the uses are charging and that all the corner lots up and. down 12th Street are either "F" -Commercial or at leapt being used as such almost without exception. Mr. Venhaus corrected this statemetmt saying this would be true west of the Church property, but it is not true east of the property„ Mr -Rowland requested "F"-Compnercial zoning for the subject property at this pointe and a motion was made that this property be rezoned to "F"-Coruiercial, which was seconded and passed.
