The Staff's recommendation was read as follows: "(This case was deferred for further
consideration -at the last meeting. The matter of non -conforming use of 1520 Broadway
and off-street parking was cleared up by separate memorandum.)
The Staff re -states its previous recommendation: "The Staff recommends denial of
this application inasmuch as there appears to be no basis for the requested variance
other than the potential financial gain of the applicant which is not hardship due
to circumstances unique to the individual property. The present development of the
"F" -Commercial lot provides only a 20 foot rear yard and a 25 foot front yard. The
Variance if granted would provide a 15 foot front yard, 10 feet short of the required
space for new construction.
Section 43-11 para (2) City's Zoning Ordinance reads as follows:
"(f) that no part of the existing nonconforming building shall encroach,
extend or project into more than one yard space distance required
by this chapter.
(g) that such erection, conversion, or reconstruction of structural alteration
shall fully conform to the yard space and all other provisions of this
chapter required for new construction."
Mr. McMinn was present saying that they desperately need "to get going", and had
nothing further to add to his comments made at the last meeting.
There were no objectors.
A motion was made that the Variance be approved, which was seconded and passed.
There beimg no further business, the meeting was adjourned at 2:30 P.M.

There being a quorum present, the meeting was called to order by the Acting Chairman
at 2:00 P.M. This meeting was a postponed one from July 19,1971, the scheduled date
due to a lack of a quorum being present. A motion was made for approval of the minutes
of the last meeting as mailed, which was seconded and passed.

The Staff's recommendation was read as follows: "The Staff recommends denial of
this application inasmuch as there appears to be no basis for the requested
Variance other than the potential financial gain of the applicant which is not
hardship due to circumstances unique to the individual property. The present
development of the "F" -Commercial lot provides only a 20 foot rear yard and a 25
foot front yard, The Variance if granted would provide a 15 foot front yard, 10

Sec. 43-11 para (2) City Zoning Ordinance reads as follows:
"(f) that no part of the existing non -conforming building shall
encroach, extend or project into more than one yard space
distance required by this Chapter
(g) that such erection, conversion, or reconstruction of structural
alteration shall fully conform to the yard space and all other
provisions of this Chapter required for new construction."
In the opinion of. the Staff, this is a case of overbuilding on the lot."
Mr. Ben McMinn, representing the applicant, W. C. McMinn Company, was present as was
Mr. W. C. McMinn. Mr. McMinn stated that there would be no addition to the building
as they intend only to enclose a part of a porch with glass between existing colums
on the second floor, and remove the steps which extended about 15 feet out to the
side. He stated they had executed a long term lease on this building based on the
remodeling which includes enclosing the building, and if this request is denied it
would cause them irreparable harm amounting to many thousands of dollars. He asked
the Board to reject the Staff's suggestion and approve the Variance.
Mr. Venhaus said that the fact that construction was under way without a building
permit indicated the project was substantially premature; that there was a great
deal of expense incurred for architect's fees and plans, etc. for this project,
which would not be a rational way to proceed with development until the Board of
Adjustment had an opportunity to deal with this question. "If any hardship accrued
from the preparation of plans they were self-induced, and they didn't have a project
until this Board permitted extension into the front yard area. If it faced Arch
Street, they would be in non-conformance on the east side and would. be 3.9 feet
rear yard instead of the 25 feet required by ordinance, The entrance would not
determine the frontage or side yard relationship - where you walk into the structure
is not the determining factor as to where the frontage is."
Mr. Flake told Mr. McMinn the Board is concerned with what appears to be going on
in the former apartment house at the corner of Broadway rich is being converted
to a quiet business use prior to its being rezoned. Mr. McMinn replied that this
was a separate issue and had no relevance to the property in question, Mr. Flake
said it was hard to consider it as a separate issue when part of the parking on this
application is to be used for justification for the other. Mr. McMinn contended that
the property at 16th and Broadway had been rezoned, but Mr. Venhaus refuted this
saying that no ordinance had been adopted by the City Board of Directors (ed: It
has since been determined that the northwest corner of Broadway and 16th Street
originally applied for (Case Z-2070) in March, 1967. This property was rezoned in
February, 1971 4Z-2423 which case also includes this Board of Adjustment applica-
tion for Variance.), and that a resume of that case would be provided the members of
the Board of Adjustment which would include notices which were sent to Mr.McMinn.
Mr. McMinn requested that a copy be sent to him, too.
A motion was made that the application be approved, but there was no second. Mr.
Grundfest commented that he personlly felt that it was very embarrassing for the
Board to be asked to rule on such situations after construction had begun, and would
put everyone in better position if they were allowed to review these things after
the building permit had been issued and bofore construction had commenced. He said
this comment was of a general nature, and not for this particular case. The Chairman
then seconded the motion, but there was one negative vote, and the motion failed for
lack of three affirmative votes, and consequently the application was denied.

upon advice of counsel that this was permissible, a motion was made for a re -hearing
at the August meeting, which was seconded and passed.

February 4, 1971
Mr. W. Co McMinn, Agent for the Third Baptist Church, the applicant, was
present. He stated the proposed tenants for the building will be a dental
labIr-
oratory wh ich is a national supplier of dental equipment on a who esale
bas -is a will have a long term lease on the property. Their intent n is
that the property will be used primarily for offices with only a small
amount of warehousing, which necessitates an '"F"'=Commercial zoning.
When questioned about accepting BBE=1" zoning for the western portion of the
tract under consideration, Mr. McMinn stated that the proposed purchase is
contingent upon the rezoning to "F" -Commercial and he would like the whole
block rezoned as requested.
Mr. Venhaus, by way of clarification, said if the laboratory in question is
the usual dental laboratory where they make bridges, certain kinds of equspment,
etc. for the dentist, it would be included in an "E=11' D istricto However,
if their operation is the sale and distribution of dental equipment per se such
as laboratory tools that dentists use, then it would fall into an "F" -Commercial
category, and we would be of the judgment if it is a dental laboratory it would
be entirely appropriate at that location. If it is a wholesale operation supply-
ing the machinery and equipment it would not be an appropriate location for
that kind of an operation.
Mr. McMinn responded saying it does supply dental chairs and equipment of that
nature, but to get it developed they would have to have the "F" -Commercial
classification. He added that it was one of the larger dental supply houses
in the country and they now operate in a downtown office building. They would
occupy this location on a -long-term lease and would be a great improvement
to the neighborhood. When asked if there would be warehousing, Mr. McMinn said
there would not be a great deal of warehousing because there is not room for
that, and would be used primarily for offices.
The pastor of the Third Baptist Church was also present and stated that the
church needs to dispose of its property in order to relocate, and would like
for the Commission to approve the rezoning to "PI -Commercial so that the
property could be sold to the prospective buyer.
Mr. McMinn indicated that the church building would be remodeled for the use
of the dental laboratory and that the parking area would be retained and paved.
A motion was made that the rezoning be approved as requested by the applicant,
which was seconded and passed.

This is in connection with the McMinn case involving the addition to the
former church structure located on the northeast corner of Arch and
16th Streets at which time the matter of off-street parking for his
"E-1" use of the northwest corner of Broadway and 16th Streets came up.
I had in hand the file case #Z-2070, which indicated that the property had
not been rezoned due to the failure of the applicant to satisfy the off-
street parking requirements. This original zoning petition was considered
by the Planning Commission April 6,1967.
The attached resume and letter of October 8,1969 will indicate some
of the action taken on this matter. Having this involved problem upper-
most in my mind, I had forgotten that subject property together with
almost the remainder of the block (Block 206, Original City) was recently
rezoned, February 15, 1971, to "F" -Commercial District.
I am truly embarrassed and I apologize for my placing Don Venhaus in such
a resolute position.
With this doubt in mind, immediately after the meeting, I checked into the
matter and discovered my error. I contacted Mr.McMinn's office and extended
my apology and explained how the error came about.
The off-street parking requirement of 14 spaces for the land -use of 1520
Broadway (northwest corner Broadway and 16th Street) can be adequately
served by the parking provided on the converted church site under the
provisions of para (E) Sec. 43-21.

CASE HISTORY - ZONING CASE Z-2070- 1520 BROADWAY
1. Property originally was 1 -story office building
1 -two story brick apartment house
Off-street parking consisted of 1 carport structure for about 4 cars
2. On March 6, 1967, Mr. W. C. McMinn, agent for Trinity Life Insurance
Company filed a petition for rezoning subject property from "D" -
Apartment to "E-1" Quiet Business District.
3. On April 6, 1967, the case was considered by the Planning Commission and
was approved subject to Staff approval of off-street parking plan prior
to rezoning by City Board of Directors. A letter to this effect was
mailed to Mr. McMinn on or about April 10,1967.
4. On April 26, 1967, Mr. Barber advised Mr. McMinn by letter that he would be
required to furnish 12 off-street parking spaces for the proposed use, and that a
Certificate of Occupancy would be issued at such time as the required parking
was provided.
9. On May 9, 1968, Mr. Barber of this office advised Mr. McMinn of the disposi-
tion of this case and that the use of the property was in violation of the
Zoning Ordinance. Mr. McMinn was advised of necessary requirements for
clearing up this matter.
10. A survey dated May 20, 1968 and prepared by a registered engineer was
received by the Staff for review, and it did not meet the requirements of
the land use.
11. The Staff in a letter dated July 30, 1968 advised Mr. McMinn of the status
of the case and that a "cease and desist" order would be issued if the
matter were not cleared up in a reasonable time. August 15,1968 was
established as final date for action to clear up matter.
12. Mr. Barber talked to Mr. McMinn August 2,1968 over the 'phone about this
matter and Mr. McMinn seemed confused. He thought the property had been
rezoned and that Mr. Finley Williams, engineer, had worked out the parking
arrangement to the satisfaction of the Staff. Mr. McMinn was told that the
off-street parking requirement had not been met.
13. As of August 5,1968 no further action has taken place concerning this matter.

On February 6, 1968 the Third Baptist Church which lies adjacent to this

property on the west gave the applicant permission to park on its lot.

Due to the fact that the provided parking was not within the boundary of

the property, the Staff submitted the matter to the Planning Commission on
March 7, 1968 for their consideration. At this time the Planning Commission

deferred action on the case until the applicant could obtain a more definite
commitment from the Church.

On April 4, 1968, Mr. McMinn advised the Commission by letter that a new
commitment from the Church had been obtained and a copy of same was
received by the Staff.

The Planning Commission reviewed the letter of commitment from the Church
at its meeting April 4, 1968. A motion was made to approve the zoning
subject to the applicant providing legal covenants suitable to the Staff
and the City Attorney and substantially in accord with the Church's letter
dated April 4, 1968. A letter to this effect was mailed to Mr. McMinn on
April 10,1968.

On this day comes on for hearing the motion of Plaintiff for a decree
on the mandate issued out of the Supreme Court of Arkansas from an appeal
of this cause to that court, which mandate was duly filed herein on January 7,
1975 (Plaintiff herein being Appellant and Defendant and Intervenors being
Appellees in the Supreme Court of Arkansas), and pursuant to the opinion
delivered December 23, 1974, by the Supreme Court of Arkansas, appeal
of this cause to that court (a copy of the said 12/23/74 opinion is attached to
said mandate filed herein), it .is ORDERED, ADJUDGED and DECREED by
the Court that the decree rendered by this Court in this cause on October 2,
1973, be and the same is hereby annulled, set aside and shall be forever
held for naught; that Defendant, its agents and employees be and they are
hereby directed to zone Plaintiff's property in Block 206 of the original
City of Little Rock to F Commercial and are hereby enjoined from
interfering with the use of Plaintiff's property involved herein within such
F Commercial zoning classification. That Appellee, City of Little Rock,
shall pay unto Appellant, W. C. McMinn, Company, Inc., the sum of
Nine Hundred Fifty-two and 50/100 Dollars ($952.50), which sum is
