The Staff recommendation was read as follows: "The petition to rezone subject
property was originally filed November 7,1970 and was deferred by the Commission
at its January and February meetings at the request of the applicant. It was
finally withdrawn by the applicant on March 3, 1971. Subsequently it was deferred
again at the applicant's request to enable him to put together a larger tract
to insure a more practical development. The case was later withdrawn entirely
by the applicant.
This -case is again submitted by a new applicant, and for "E" Apartment rather
than "D" as originally submitted.
The Staff recommends denial of this application for "E" Apartment and recommends
instead zoning to "D". A "D" tract lies across the street to the east and vacant
land across the street to the north. Construction of an "E" -Apartment develop-
ment on this tract would be out of character with the neighborhood."
Mr. Delbert Spears, realtor, representing J. H. Davis, the applicant, was present.
After hearing the Staff's recommendation, he said he could understand why "E"
zoning was not recommended and would like to consider it for "D" Apartment.
A motion was made to accept the Staff's reconmendation for "D" -Apartment District
zoning, which was seconded and passed.

This case was deferred at the last meeting at the request of the applicant. The
Staff recommends further deferral of this case until the applicant can put together
sufficient property to insure a practical development of this and adjacent property
with reasonable and safe ingress and egress.
Mr. Bert Nard, the developer of the property, and Mr. Whisnant, realtor, were present
in the interest of this application. Mt. Ward stated that they needed a little more
time to get more property together and would like the matter deferred for thirty days.
