The Staff's recommendation was read as follows. "The Staff recommends denial
of this application. To rezone subject property as requested would violate the
Forest Heights zoning plan previously adopted by the Commission. The plan calls
for subject property to be zoned "E-1" and compliance with the established
requirements for the Forest Heights Shopping Center Area."
There were no objectors.
Mr. Eugene Pfeifer, III, the applicant, was present and stated that the Forest
Heights Criteria was established in 1960 and was a plan agreed upon by a previous
Planning Commission which was to be uses as a criteria. The history has been one
of waiver after waiver after waiver, he said, and the request that he has made is
in keeping with the present development of the area, and the trend that has already
been established outthere. He enumerated several deviations from the plan m the
Tipton -Hurst Building, Wagons West drive-in, the Post Office Substation, etc. He
has submitted a development plan which .indicates a 25 foot green belt which would
be adhered to, he said. He has a tenant who is anxious to move in in the near future.
A motion was made for approval of the requested rezoning with the exception of the
south 25 feet of Lot i which is to remain "E -l" Quiet Business District as a green
belt. The motion was seconded and passed.
