"E" -Apartment District The Staff's recommendation was read as follows. "The Staff recommends denial of this application, inasmuch as this property has no public dedicated access. Information presently available indicates that some of this property lies within the right-ofmway of the East-West Expressway. The rezoning of this property would effect an increase in intensity of use of said land. It should be pointed out that the U. S. Corps of Engineers study of Rock Creek indicates this property was entirely covered by flood water in January, 1969." Mr. Edward Brueggeman, architect, was present representing the applicant, George E. Bushmiaer. :sirs. Bushmiaer was also present. They propose to construct an apartment complex on the site and Mr. Brueggeman stated that this land could not be used under any stretch of the imagination for residential property. As to the flood problem, he said they would develop to overcome that situation. Concerning the access problem he said Mrs. Bushmiaer has been assured that this is available for a price and she indicated that they could work with the Morman Church for access to Rodney Parham Road. The small portion of the property in the proposed East- West Expressway right-of-way would be excluded from the development, he said.. Another access to the property is across the nursing home property on the north to West 5th Street. -Unless the zoning is granted, negotiations for access to Rodney Parham Road could not proceed, he said. Mr. Venhaus commented that assum- ing the property were rezoned and access secured to Rodney Parham Road, that property would also have to be zoned "E" as it would be a violation to cross single- family property to this deve-lopment. Mr. Brueggeman added that the land on the east side of Rodney Parham Road, directly opposite the property separating this -3- Planning Commission Minutes m " December 3,1970 tract is presently zoned "E`° -Apartment and is undeveloped. It was suggested that the access could be provided by option conditioned on the rezoning and the applicant was asked if a deferral of thirty days would enable them to work out this problem as well as that of flooding. Mr. Brueggeman said this was advisable. A motion was made that action be deferred on this application until the J anua� 7th 1971 meeting.
