Dear Commissioners:
I reside at #57 Wingate Drive immediately adjacent to the captioned property.
On April 1, 1976 the Commission is scheduled to hear this request for rezoning.
The subject property has a small frontage on West Markham and then extends
north for several hundred feet and broadens to around 200 feet. This area is
a wedge between several single-family residential neighborhoods.
My neighbors and I oppose this proposed rezoning for the following reasons:
1. The violation of the neighborhood which now consists of -single-
family dwellings as it has for over twenty years.
2. There would be no buffer zone from one concept of land use to
the other.
3. Traffic on West Markham is a serious problem. This rezoning
would add to this situation.
4. The main sanitary sewer line through the area is overloaded
and is subject to overflow during wet weather. Raw sewage
frequently flows from manholes on this line and into the drainage
ditch which runs alongside and through the subject property.
5. Surface water drainage is inadequate in the area. During heavy
rain the ditch through the area overflows and rises in the yards.
I myself, have suffered damages of over $2,000 because of high
water. The clearing of the subject property can only increase
the flooding problem.
6. The existing property owners have had every reason to believe
that their neighborhood would remain one composed of single-
family dwellings. Their property values can only suffer if the
proposed rezoning is allowed.

and the request was denied at that time. The reascnsfor the denial then
still exists. I strongly request that this rezoning be once again denied.

In answer to the rezoning request for property located at
8 114 W. Markham St., this city, owned by Donald Kirk and
Wilma Kirk, we hereby offer official notice of disc roval.
We hope you will listen to us (the neighborhood) once again
and disapprove the request once again.
The Kirks are still wanting to locate more apartment build-
ings on this property. The neighborhood has had already too
such trouble from youngsters from the existing apartments
Coming over to our streets to play and make mischief. More
apartments in the area will, no doubt, incur more of this.
We have infoemation that in the event of additional build-
ing of this type in that area, they also plan to try to get
Kaylin Drive opened into garkwood Drive. This is a dead end
street which ends at the creek at the foot of the street.
This is our most urgent concern.
At present, we have: a very serious traffic problem in trying
to get out onto Markham St., and also onto Parham road from
the other way out.
To throw more traffic into our area, Markwood Dr., Red Oak In,
Nob Hill Cove, & other streets with only two possible out-
lets, would be of even greater concern for many peoble in the
Earkwood Dr. & Kaylin Hills addition.
My wife and I will be unable to attend the hearing on April
1, and ask that the BOARD give consideration to our request
for disapproval of this classification change.

NOTICE IS HEREBY GIVEN THAT an application for rezoning of the above described property
requesting a change of some classification from "A-1"
District to "INIT-12"
District by amendment of the Little Rock Code of Ordinances (Chapter 43) has been filed wit
the Little Rock Planning Commission, City Hall.. A public hearing on said petition by this
Commission will be held in the Board of Directors' Chamber, City Hall on
April 1 1976,_ at 2:00 p.m.

to the Commission that you have read this notice announcing the time, place, and purpose
of the public hearing on this case. THIS IS NOT A PETITION TO APPROVE OR DETY THE
APPLICATION - IIERELY A NOTIFICATION OF A PUBLIC HEARING.
' P E T I T I O N
we, the undersigned, residents and property owners in the City
of Little Rock wish to express our firm opposition to the application
of Donald Kirk to rezone property located at 811+ West Markham Street
from A-1 family to MF -12 multi -family. Our opposition is based
substantially upon the following factors, among others:
1. The requested change would allow the development of
apartments on a narrow strip of land that is bounded on
three sides by single family residences. This would
destroy the character of the neighborhood as a single-
family residential area.
2. There are approximately twenty-one single-family
residential properties which are contiguous to the prop-
erty for which this rezoning is proposed. All of the
surrounding properties would be adversely affected by
the proposed change, but to an even greater extent these
property owners whose property is directly contiguous to
Mr. Kirk's property would suddenly find themselves abut-
ting paved property with multi -family dwellings and no
reasonable buffer zone.
3. The proposal would inevitably cause a large increase
in automobile traffic which is, as you know, already a
problem of immense proportions in the West Markham -
Mississippi - Rodney Parham vicinity.
4. The property in question is directly across Markham
from the Brady Elementary School and is situated directly
behind an apartment complex which fronts on Markham Street.
To allow the proposed change would seriously tax the
already over crowded facilities, schools, and playgrounds
in the immediate vicinity.
5. The owners of residential property in the surrounding
areas have made considerable investments in their homes
in reliance upon the reasonable expectation that the
neighborhoods in which they purchased homes would remain
stable single-family residential areas. To grant the
proposed application is to deny these expectations to the
unquestioned detriment of persons who have lived in these
areas for as long as fifteen to eighteen years under
present zoning ordinances or voluntary restrictions.
6. The properties in the immediate vicinity of the
subject property are plagued during wet weather with
problems caused from inadequate drainage and overtaxed
sewage facilities. This problem would simply be
worsened by the granting of Mr. Kirk's proposal.
7. It is without question that the property values of
those homes closely connected to the subject property
would experience an unexpected devaluation.
8. The fact that the proposed use of Mr. Kirk's prop-
erty may be its "best" or most profitable use is no
justification for this type of "spot zoning".
9. The same proposal was made by Mr. Kirk in 1970 and
was denied. The circumstances which warranted denial
of the request at that time remain unchanged today.
For these reasons and others we urge the Commission to deny
the application and to maintain this area as a single-family
residential area.
