As you are one of my City Directors-, I am writing to formally object to an application
for a zoning change application on a parcel located in the NIV 1/4, NE 1/4, E 1/2 of
Section 2, Township 1 North, Range 13 West, city of Little Rock. The present zoning
is for single family dwellings (A-1). The City Planning Commission hearing is scheduled
for December 3, 1970.
This parcel is'bordered by attractive residential additions as follows: on the West
by Markwood; on the North by Leawood; on the East by Wingate; on the South by Briar -
wood. Except for a crowded -in 60 unit apartment complex called Plantation Apartments
which faces West Markham Street, the entire area is private, single family homeowner-
ship in character - not commercial or multi -family dwellings.
Now, Mr. Kirk who notified me by letter of his application, proposes to squeeze in
another 120 multiple family units on a lesser parcel of land per unit, than exists
in his jumbled area of the Plantation Apartments. Further, he proposes a new access
road into the now busy West Markham Street, about 50 feet West of my property's South-
west boundary. I have been assured this would depress the market value of my property,

this property in April 1970, making a very large equity investment, to make a home
after many years service in the U. S. Navy. Now this squeeze in proposition beleagures
it.
I submit that this zoning change would create two serious and undesirable situations
worthy of your discerning investigation. First, this new access road would be directly
across from the entrance to Brady Elementary School on busy West Markham. Another
traffic hazard to young children; second, the addition of 120 more multiple family
dwellings on this parcel, even 40 initially, would create an overcrowded condition -
yea, even slum conditions, even though of new construction. Families deserve room to
breathe, even in apartments. All of this in among some of Western Little Rock's
nicest residential areas.
I solicit your support to 'deny this zone change application to protect the single
family residence character of our neighborhoods. I am personally petitioning to
object to this application, each City Director, the City Manager, and the Chairman
of the City Planning Commission.

Dear Mr. McLean: ,
I wish to extend my sincere appreciation for the
consideration and the attention given by yourself and the
other members of your Commission to the objections pre-
sented by the neighborhood homeowners relative to the
request for rezoning 8115 West Markham.
It did a great deal to dispel the cynicism some
of us develop with age as regards representative
government. We could not have expected more.
We would especially like to express our appreciation
to Mr. Crawford for having made the motion to disapprove
the request for rezoning.
Assuming the City Board of Directors will not have
occasion to take issue with your decision, we shall
endeavor to purchase the land in question for what would
seem to be its best use - a small park.

THE MATTER OF REZONING PROPERTY LOCATED
8116 WEST MARKHAM STREET, LITTLE ROCK, ARKANSAS FROM "A" TO "C"
Let it be known that the undersigned property owners in
Little Rock, Arkansas and owning property adjacent to or in the
immediate area to the proposed rezoning are directly opposed to
any rezoning.
We are opposing the rezoning change for several reasons.
These being:
(1) The destruction of the neighborhood concept of one
family dwellings that are now, and have been for fifteen
years, on adjacent property.
(2) The nuisances created by multifamily and multistory
buildings with no reasonable buffer zone from one concept
of family dwelling to another.
(3) The traffic problem created directly across from the
existing neighborhood elementary school,
(4) The overcrowded situation -as -to -lana, s6h6ols, play-
grounds, -and other facilities in immediate area, including
fire protection.
(5) The area proposed for change does not have a main
through street, but drives a wedge into several single
family neighborhoods.
(6) The existing property owners have had reason to
believe they were buying property in a single family
neighborhood and it would not change.
(7) The drainage of a large portion of Wingate, Leawood,
Nob Hill and neighborhood areas as far as Highway #10
depend on existing proven drainage. Any change (i.e.
addition to or interruption) in the now natural flow of
water would immediately create a serious loss to property
owners. The sewage system that crosses this property often
overflows and spills raw sewage on the ground. The addition
of this number of residential units would overtax an already
inadequate system.
(8) Last, but not iec,st, the immediate and accelerated
devaluation of our pro-oerty.
Conclusion can only be that above detriments can only devalue
the property in the area and ::C:ve all-:Yaperty owners without recourse
to their fair value and anticipated inc:r"ases to property now owned.
We plead that the single family zoning will rer�ai.n in this
area and no further encroachment will be made.

The Staff recommendation was read as follows. "The Staff recommends approval of the
requested "C" zoning. The adjacent apartment usage to the west, the nature of
the terrain, the narrowness of the site, and the fact that the single-family
dwellings to the east are located on long lots and back into the subject property
in our opinion make this property appropriate for "C" -use.'"
Dr. Kenneth G. Jones, 38 Wingate Drive, was present as spokesman for approximately
100 persons in attendance, and also filed a petition having 216 names in opposition
to the rezoning request. He read a prepared statement setting forth their objections
to the proposed apartment development.
Mrs. Thomas H. Bramhall, 5 Patricia Lane, was present stating that she had lived
there for fifteen years, and the proposed development would devalue their property.
Mrs. R. M. Cearley, 43 Wingate Drive, said they had been property owners in this
area for over ten years. She enumerated their reasons for opposition as being
inadequate play area, no effort made to construct the building to blend in with
the surrounding development, overcrowded site, no buffer zone between building
and surrounding property, increased noise, traffic,ilood lights for parking and
swimming area, and depreciated property values. She asked that the property remain
zoned "A" -Single-family.
Mrs. Jim Childers, 40 Wingate Drive, was present and stated that they had lived
there 14 years, and objected to the proposed development for reasons of safety
hazards, both traffic and fire. There is only one entrance from Markham Street
which is 50 feet wide and in case of an emergency this would not be sufficient.
She also emphasized the fact that this site is directly across from Brady
Elementary School.
Mr. Carl S. Rosenbaum, 57 Wingate Drive, adjacent to subject property, was concerned
with the drainage of surface crater and inadequate sewer system which would be
compounded by the addition of an apartment complex, and considered it a health
hazard.
Mr. Doug Halbert, 401 Markwood, said the proposed complex would devalue his property
and other single-family residences in the surrounding area; and that it was the
responsibility of the Planning Commission to protect property owners of Little
Rock in this type of situation.

Dr. Jones, in closing, said that as a property owner it seemed to him that the
whole concept of zoning and planning creates a covenenat between the municipality
and the people who purchase property which slmuld extend over a period of time,
and that any change should benefit those property owners who are established in'
the area, and not only for the benefit of a single developer.
Mr. Donald Kirk, the petitioner, was present and stated that he bought this proper-
ty subject to its being rezoned, and is the onwer of the Plantation House apart-
ments to the west. He plans to construct an apartment complex having 40 units for
one-half the tract which would be townhouse type units to blend with the Plantation
House apartments. in his opinion the 50 foot wide entrance off of Markham Street
was ample and he said there was another entrance in the back of Plantation House.
Mr. Lyon asked Mr. kirk if he could utilize the property for duplex development.
He answered that he did not believe it would work. His plan is to build court
type apartment buildings with a swimming pool in the middle with a drive around
the development, and a screening .fence to insure more privacy for the adjacent
property owners. The project will be privately financed.
A motion was made that the application be denied, which was seconded and passed.
