HomeMy WebLinkAbout21819 ,,ll«uuamllllll %% (1RCUI7 tly ~����•+ ‘,7; 1 1111111111111111111112°19°78654 .• .1•• Q= PRESENTED:12-06-2019 02.00.13 PM RECORDED:12-062019 02:05:05 PM I,y l '� Z ORDINANCE NO. 21 819�n Official Records of Terri Hollingsworth Circuit/County Clerk 1+'►'� 2�� ,p�,`�,,,,-� P`��� PULASKI CO.AR FEE$20.00 3 rr'AN ORDINANCE TO APPROVE THE EXCLUSIVE RIGHT-OF-WAY 4 ABANDONMENT FOR AN UNDEVELOPED FIFTY (50)-FOOT SCENIC 5 BOULEVARD RIGHT-OF-WAY,LOCATED WITHIN THE PROPERTY AT 6 55 SCENIC BOULEVARD,LITTE ROCK,ARKANSAS;AND FOR OTHER 7 PURPOSES. 8 9 WHEREAS, the right-of-way was never developed as a street and the area of right-of-way is located 10 entirely within the applicant's property; and, 11 WHEREAS,the applicant requests approval of the exclusive abandonment of the undeveloped fifty(50)- 12 foot Scenic Boulevard right-of-way, located within the property located at 55 Scenic Boulevard, Pulaski 13 County Tax Parcel ID 33 LO 120004600 as recorded in Plat Book 4,Page 235 on November 28, 1950,to a point 14 twenty-five(25)feet north of the south boundary of said tract with no retention of any easement rights subject 15 to the specific requested easements being granted to Entergy and Little Rock Water Reclamation Authority; 16 and, 17 WHEREAS,the applicant proposes to develop the entirety of the property as a single home site; and, 18 WHEREAS,all proper statutory procedures for such an abandonment have been met and the issue is ripe 19 for consideration by the Board of Directors. 20 NOW,THEREFORE,BE IT ORDAINDED BY THE BOARD OF DIRECTORS OF THE CITY 21 OF LITTLE ROCK,ARKANSAS: 22 Section 1. After a public hearing concerning the exclusive abandonment of the of the undeveloped fifty 23 (50)-foot Scenic Boulevard right-of-way, located within the property located at 55 Scenic Boulevard,Pulaski 24 County Tax Parcel ID 33L0120004600 as recorded in Plat Book 4,Page 235 on November 28, 1950,with no 25 retention of any easement rights subject to the specific requested easements being granted to Entergy and Little 26 Rock Water Reclamation Authority,was held on December 3,2019,the Board of Directors concluded it was 27 appropriate to abandon the easements and covenants. 28 Section 2. The abandonment of this easement and covenants will allow the applicant to develop the entire 29 property as a single home site. 30 Section 3. Severability. In the event any title,section,paragraph, item,sentence,clause,phrase,or word 31 of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication 32 shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the 33 portion so declared or adjudged invalid or unconstitutional were not originally a part of the ordinance.
