d14`,tttttttttttttttt ttE IIHIIiIIIIIl - CitI`o 2019078653 =° PRESENTED.12.06-2019 02.00 13 PM RECORDED:12-06-2019 02:05:04 PM •.; ;+ —i_ In Official Records of Terri Hollingsworth Circuit/County Clerk Ii:=lw, r 4" f ORDINANCE NO. 21,818 PULASKI CO.AR FEE$20.00 2 'f/ P� „,,,„,000NT�I tor-0x% 3 AN OIThINANCE TO APPROVE THE EXCLUSIVE RIGHT-OF-WAY 4 ABANDONMENT FOR AN UNDEVELOPED THIRTY (30)-FOOT 5 UNNAMED RIGHT-OF-WAY NORTH, OF KANIS ROAD, EAST OF 6 EMBASSY SUITES DRIVE,LITTE ROCK,ARKANSAS;AND FOR OTHER 7 PURPOSES. 8 9 WHEREAS, as a result of property acquisitions associated with the Kanis Road Improvement 10 Project, the City of Little Rock, Arkansas ("City") owns the properties to the east and west of the 11 right-of-way; and, 12 WHEREAS, the City, through the Public Works Department and Planning & Development 13 Department, requests exclusive abandonment of the unnamed thirty(30)-foot right-of-way located 14 north of Kanis Road, east of Embassy Suites Drive between Lots 58 and 59, West Highlands(G- 15 23-471)as recorded in Book 1,Page 273 on April 3, 1916,with no retention of any easement rights; 16 and, 17 WHEREAS, all proper statutory procedures for such an abandonment have been met and the 18 issue is ripe for consideration by the Board of Directors. 19 NOW,THEREFORE,BE IT ORDAINDED BY THE BOARD OF DIRECTORS OF THE 20 CITY OF LITTLE ROCK,ARKANSAS: 21 Section 1. After a public hearing concerning the abandonment of the following easements and covenants 22 located north of Kanis Road, east of Embassy Suites Drive between Lots 58 and 59, West Highlands 23 Subdivision(G-23-471)as recorded in Book 1,Page 273 on April 3, 1916,with no retention of any easement 24 rights, was held on December 3, 2019, the Board of Directors concluded it was appropriate to abandon the 25 easements and covenants. 26 Section 2. The abandonment of this easement and covenants is part of Kanis Road Improvement Project 27 and will allow joining and marketing of the property for zone C-3, Single-Family District. 28 Section 3. Severability. In the event any title,section,paragraph, item,sentence,clause,phrase,or word 29 of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication 30 shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the 31 portion so declared or adjudged invalid or unconstitutional were not originally a part of the ordinance.
