3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO AN AGREEMENT WITH AND TO MAKE PAYMENTS TO THE
5 MERCHANTS NATIONAL BONDING COMPANY,IN AN AMOUNT NOT
6 TO EXCEED THE ORIGINAL AWARD AMOUNT OF ONE HUNDRED
7 THOUSAND, SIX HUNDRED TWENTY DOLLARS ($100,620.00), FOR
8 THE COMPLETION OF THE BISCAYNE DRIVE DRAINAGE
9 IMPROVEMENT PROJECT; AND FOR OTHER PURPOSES.

I I WHEREAS, On-Line Construction was awarded a contract for construction the Biscayne Drive
12 Drainage Improvement Project,Resolution No. 14,681 and the City has received notice from the Merchants
13 National Bonding Company that On-Line Construction is now bankrupt and will not be completing the
14 work; and,
15 WHEREAS, It is necessary for the City to enter into an agreement with Merchants National Bonding
16 Company for the completing the work and to make the balance of payments to the bonding company.
17 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
18 OF LITTLE ROCK,ARKANSAS:
19 Section 1. The City Manager is hereby authorized to execute an agreement with Merchants National
20 Bonding Company for the completion of the Biscayne Drive Drainage improvements in an amount not to
21 exceed the original award amount of One Hundred Thousand, Six Hundred Twenty Dollars($100,620.00)
22 and to make payments to the bonding company for work completed.
23 Section 2. Funding for this project is from the°%-Cent Capital Improvement Sales and Compensating
24 Use Tax Funds as authorized by Resolution No. 14,310 and Resolution No. 14,681.
25 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
26 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
27 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
28 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
29 resolution.
30 Section 4. Repealer.All laws, ordinances,resolutions, or parts of the same,that are inconsistent with
31 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
