OF THE CITY OF LITTLE ROCK; AND FOR
OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That the zone classification of the following
described property be changed from R-2 Single Family to PID
Planned Industrial District.
A parcel of land in Section 12, T-1-N, R-13-W at
7305 West 12th Street, Little Rock, Arkansas, being
more particularly described as follows:
Part of Plot 11, Hocott Home Sites Subdivision and
part of the East 1/2 of the NE 1/4 of the NW 1/4 of
the NW 1/4, of Section 12, T-1-N, R-13-W, in Little
Rock, Pulaski County, Arkansas, all of which are
more particularly described as follows, to-wit:

conditioned upon obtaining a final plan approval within the time
specified by Article VII, Section 36, Chapter 36 of the Code of
Ordinances.
SECTION 4. That the map referred in Chapter 36 of the Code
of Ordinances of the City of Little Rock, Arkansas, and
designated district map be and it is hereby amended to the extent
and in the respects necessary to affect and designate the change
provided for in Section 1 hereof.
SECTION 5. That this ORDINANCE shall take effect and be in
full force upon final approval of the plan.

STATEMENT OF PROPOSAL:
The application filed for this property is a proposal to install
state of the art equipment and facilities for a concrete batch
plant. The plant will include higher than standard dust
collectors, and air control requirements. The new plant will be
located in the southeast corner of the property. Attached to the
plant will be 20 by 20 driver rooms and batch office. All parking
and conveyors for stock bins will be at the rear of said property
which would create a large buffer between 12th Street and the
plant.
A. PROPOSAL/REQUEST:
This application was filed for purposes of obtaining
permission to modernize this facility which has been in place
for over 30 years. The existing facility has several problems
relative to dust, noise and such which require modernization.
The current zoning of the property is residential, thereby
making this a nonconforming use. The site was denied
industrial zoning in the mid 1960's. The appropriate
industrial zoning would be I-3 for a full service concrete
batch plant.

The staff would not recommend such a zoning in this area
because it would be spot zoning. The PID will serve the
interest of maintaining the zoning plan in the area, which
provides for a number of parcels as I-2 Light Industrial.
They are currently zoned and occupied. It will, at the same
time, afford the owner the opportunity to upgrade his
facility.
B. EXISTING CONDITIONS:
The site is currently occupied by a concrete batch plant which
has been on the site for a number of years. There are several
structures on the site as well as open storage. Most of the
surface area within the property boundary is gravel or
unpaved. This is a circumstance which will need to be
maintained since the weight of the loaded trucks would
severely damage any attempt at paving in this area.
C. ENGINEERING/UTILITY COMMENTS:
Public Works requests that the owner work with staff to reduce
a site distance problem at the entry from 12th Street. There
is a fence on one side of the drive that provides a dangerous
ingress and egress relationship. Detention and Excavation
Ordinances will apply.
Waste Water Utility reports that easements on the site should
be protected and that contact should be made with the Waste
Water Utility prior to doing any work.
The Little Rock Water Works reports that it has no comment on
this application.
D. ISSUES/LEGAL/TECHNICAL/DESIGN:
1. All weather parking and drives
2. Finished floor elevation for any new buildings
(100 year flood}
E. J..NALYSIS:
Staff analysis reflects very little in the way of the usual
kinds of considerations that are applied on a PID or in fact,
any other PUD application. This site is bordered by existing
built out industrial or heavy commercial activities. The site
has been occupied by this business through several different
ownerships over a long period of time. Staff sees little or
no impact on the adjacent property by allowing this owner to

improve and upgrade. In fact, enclosing existing facilities
to reduce dust, noise etc., we do not see that there will be
any increase traffic impact, lighting or noise upon the
adjacent properties.
F. STAFF RECOMMENDATIONS:
Staff recommends approval of the application subject to the
owner reviewing his options for some type of all weather
surfacing within the compound that will limit dust and
erosion. However, we are not recommending asphalt or concrete
application.
SUBDIVISION COMMITTEE COMMENT: (JANUARY 7, 1993)
The applicant was present. There was a brief discussion of the
proposal. There were no specific comments or recommendations
coming from staff or the Committee other than those in the
discussion outline. After a brief discussion, the item was
forwarded to the full Commission for final approval.
PLANNING COMMISSION ACTION: (JANUARY 26, 1993)
The applicant was present. There were no objectors in attendance.
The staff presented its recommendation of approval. After a brief
discussion, the Commission determined it appropriate to place this
item on the Consent Agenda for approval. A motion to that effect
was made. The motion passed by a vote of 10 ayes, 0 nays and
1 absent.

Planning Commission action on January 26, 1993. The Planning
Commission at this meeting recommended approval of your
application for a PID. This application will be forwarded by
staff to the Board of Directors for ordinance passage. The Board
of Directors meeting on this issue will be held February 16, 1993
at 6:00 p.m. in the Board of Directors' Chambers at City Hall.
Following action by the Board of Directors, you should be
prepared to submit the final copies as necessary with any
revisions of your plan for the final signoff and approval by
staff. This will be required prior to the issuance of any
building permits.

you up date your plant. As you mentioned, the new plant would be much quieter
and a lot less dusty. That would benefit all neighbors. Also you agreed that
you would use the short Vogler Street as an entrance only street, to

Dear Sirs:
We are proposing to install a newer state of the art
Concrete Batch Plant. This plant will include higher than
standard dust collectors than air controllers set.
The new plant will be located in the south east corner
of said property, attached to the plant will be 20' x 20'
drivers room and batch office. All parking and conveyors
for stock bins will be at the rear of said property which
would create a large buffer between 12th Street and our
plant. Also included will be a 60' x 60' maintenance
building to service our equipment in the north west corner;
this building will be constructed of prefabricated steel.
Our interest to develop this site is for the image of a
newer concrete business, to improve our efficiency and
to show a better interest to our business neighbors. Though
the old plant is still capable of producing high yields for
us, we would prefer to invest with our newer system on this
site.

Dear Sirs:
We are proposing to install a newer state of the art
Concrete Batch Plant. This plant will include higher than
standard dust collectors than air controllers set.
The new plant will be located in the south east corner
of said property, attached to the plant will be 20' x 20'
drivers room and batch office. All parking and conveyors
for stock bins will be at the rear of said property which
would create a large buffer between 12th Street and our
plant. Also included will be a 60' x 60' maintenance
building to service our equipment in the north west corner;
this building will be constructed of prefabricated 5teel.
Our interest to develop this site is for the image of a
newer concrete business, to improve our efficiency and
to show a better interest to our business neiqhbors. Though
the old plant is still capable of producing high yields for
us, we would prefer to invest with our newer,system on this
site.
