Kizer, State Aid Engineer, my letter to you dated June 10, 1975, and City Ordinance #12,974 rezoning the above property. This letter sets forth the owner's position with respect to whether or not they should voluntarily donate the right-of-way and provide construction for a road through the above property. The owners do not think it feasible to donate the right-of-way and provide construction for a road on the above property. This property is quite valuable and, considering the property's location and the proposed route of the road through the property, such a road would, in fact, substantially and irreparably restrict the use of the property and, therefore, greatly reduce its value. The owners have recently completed negotiations for the sale of a portion of this property and are proceeding with development plans according to the present zoning classification set forth in Ordinance #12,974. The owners would consider selling the right-of-way to the City as previously set forth in my letter to you dated June 10, 1975. The owner appreciate the interest of the City in the orderly development of the above property and its environs. However, I'm sure the City will appreciate and respect the desire of the owners to maintain and enhance the value of the above property in accordance with their proposed development plans. We are one of the owners of property located within 200 feet of the above property. We have lived there for four years, we bought the property because of it's location and surrounding area which is primarily woods and complete residential area. It is a relatively quiet area away from the hustle and bustle of the city. Now however, Evergreen Properties would like to bring the city to us. This we object to. One just has to look at what has happened to Colony West and the problems of congestion and nuisance value it has created. It is almost impossible to get out of the two subdivisions that were there originally. We would not like that to happen to us. This is only one 20 acre plot, but that would be the wedge to open up the whole area to being rezoned for commercial and Multi -family dwellings. Have you seen how saturated the western area already is of apartments? Just take a ride down Rodney Parham, Reservoir Road and Kanis. Who needs anymore? A good part of Markham is already commercial, also on Kanis around the Baptist Hospital. The area around Birchwood is very nice for residential building, we would all hate to be surrounded by apartments, office buildings and etc. I hope you will take into consideration the people who are already there, have put money into their properties and would like to keep the area residential. The woods are very pretty behind our houses, we have no desire to look down on asphalt parking lots and office buildings or vice versa depending on where your house is. The I -630 -West Markham Street Parkway connection was added to the Federal Aid Secondary System upon request by Pulaski County Judge B. Frank Mackey. The route was subsequently added to the Pulaski Area Transpor- tation Study Network. Subsequent to the time the route was added to the FAS System, Federal regulations prohibit the expenditure of Federal Aid Secondary funds within the urban limits of cities with a population of 5,000 or more. County Judge B. Frank Mackey has requested that we program a State Aid county project to make surveys and plans sufficient to establish the location and right-of-way requirements. We have programmed the project but because of a backlog of prior requests, we have not yet begun work. Under any of the county or city road programs that I am familiar with the acquisition of right-of-way is a local responsibility and not eligible for funding with matching funds. Usually the right-of-way is donated by the property owners in affected areas. The construction of this project is local matter as far as priorities and funding is concerned. The State Highway Department is assisting Pulaski County with engineering services only and does not determine the priorities for the county. Limited State Aid funds may be available for construction purposes but we do not know of any funds available or likely to become available for the acquisition of right-of-way. Mr. James A. It is our feeling that the pro- posed extension is necessary and deesirablo to provide adequate access to subject pt and other property in the area. It has however always been our feeling that the: necessary aright -of - way and c*nstructian would be provided by property mere as is usual --through the subdivision process. .As I am sure you are aware, it is unlikely that the My will be able to finmee such a project itself, and therefore most likely that if the project is to be pursued and mass is to be improved* then the property owners that benefit will most likely have to assist as usual. Therefore, to answer yaw question, the City is still interested in pursuing this project, but not interested in purchasing the necessary property for obvious reasons.
