There may be a -requirement for subdividing the tract if parcels are developed as separate tracts. - 2 - 6-.28-77 Z -2904-A FACTUAL INFORMATION 1. NEED FOR REZONING: The owner, HUD, and others indicate all local high-rise development of -this type is full and the market can absorb additional units in .integrated development of this type. 2. COMPATIBILITY WITH MUNICIPAL PLAN: A suburban location of this type density is not normally viewed as being consistent with the perceived plan. 3. NEIGHBORHOOD POSITION: Strong opposition -- well organized -- generally in the Leawood Mountain Subdivision and Sheraton Park have been expressed in the past. It is reasonable to assume that it will occur again. 4. EFFECT ON NEIGHBORHOOD: Minimal for high-rise but no transition or open space is now proposed for the "MF '12". This is a radical departure from the previously approved plan which provided significantly less impact. 5. PUBLIC SERVICES: Fire - lies well -within service radius for protection. Sanitation —mostly will be by commercial contractor, not City. Police - no problem for this patrol district due to present level of development. 6. UTILITIES: Sewer - Adequate Water - Adequate 7. EFFECT ON PUBLIC FINANCE: No perceived effect. 8. LEGAL CONSIDERATION/REASONABLENESS: _Appears to be out of line with previously agreed upon plan. 9. TRAFFIC CONSIDERATIONS: Generation of 5,260 vehicle trips per day as proposed will have significant impact on .the level of service on Cantrell. The amount of traffic that could develop from this site at a concentrated point could create a need for a signal on Cantrell. 10. STANDARDS OF QUALITY: Those incorporated within the H.U.D. site development requirements. ANALYSIS: This development proposes a significant increase in overall density --approximately 50% from: 160.0 total allowed with present .zoning (continued) - 3 - 6-28-77 Z -2904-A to: 250 units proposed. This would be a significant impact on traffic, sewer and adjacent land use. A development of the proposed densities would affect the stability of adjacent single-family zoned land to the west fronting Cantrell Rd. The construction of a high-rise in the area would create visual impact over a large area to the south. STAFF RECOMMENDATION/CONDITION OF APPROVAL: The staff would oppose the rezoning of the tracts as filed or any zoning plan introducing signifi- cant increases in overall density. However, we feel a swapping of density could allow the applicant to proceed in the direction he desires on the high-rise while providing maintenance of green space separation to adjacent residences and park. We would recommend that the "E" zoning be permitted as filed and that a reduction to "MF 6" be accomplished on the balance of the apartment request. Further, that the 100 ft. green belt be extended along the west side and retained on .the east and south of the apartment zones. We feel buffering of this nature, when left as undisturbed green belt, is essential. We feel that approval should also be conditioned on limiting access to Cantrell Rd. to one point. PLANNING COMMISSION RECOMMENDATION: AFTER A LENGTHY DISCUSSION OF THE ISSUES AND PRESENTATIONS BY STAFF, OWNERS AND OBJECTORS, THE PLANNING COMMISSION VOTED ON THE PETITION AS FILED. THE APPLICATION WAS DENIED BY A VOTE OF (0 ayes - 9 noes - 1 absent - 1 abstention) (Lynn Wassell abstained). A SUBSTITUTE MOTION WAS PRESENTED IN LINE WITH STAFF RECOM- MENDATION, PLUS A REQUIREMENT THAT THE APPLICANT PRESENT WRITTEN ASSURANCE PROTECTING TREES FROM REMOVAL AND LIMITING DENSITY TO THE SAME AS NOW ALLOWED. THIS MOTION FAILED BY VOTE OF (3 ayes - 6 noes - 1 absent= 1 abstention) (Lynn Wassell abstained). NO ADDITIONAL MOTIONS WERE MADE. "E" PERMITS AN INTOLERABLE 72 APARTMENT UNITS PER ACRE. The undersigned maintain their homes in areas adjacent to said property and hereby strenuously protest the proposed change in the existing zoning,. The existing zoning, granted just two years ago, is ALREADY EXTREMELY DISTASTEFUL AND WAS GRANTED OVER THE JUSTIFIED PROTEST OF MOST OF THE UNDERSIGNED. It is reasonable to assume that it will occur again. 4. EFFECT ON NEIGHBORHOOD: Minimal for high-rise but no transition or open space is now proposed for the "MF 12". This is a radical departure from .the previously approved plan which provided significantly less impact. 5. PUBLIC SERVICES: Fire - lies well -within service radius for protection. Sanitation - mostly will be by commercial contractor, not City. Police - no problem for this patrol district due to present level of development. 6. UTILITIES: Sewer - Adequate Water - Adequate 7. EFFECT ON PUBLIC FINANCE: No perceived -effect. 8. LEGAL CONSIDERATION/REASONABLENESS: Appears to be out -of line with previously agreed upon plan. 9. TRAFFIC CONSIDERATIONS: Generation of 5,260 vehicle trips per day as proposed will have significant impact on the level of service on Cantrell. The amount of traffic that could develop from .this site at a concentrated point could create a need for a signal on Cantrell. 10. STANDARDS OF QUALITY: Those incorporated within the H.U.D. site development requirements. ANALYSIS: This development proposes a significant increase in overall density --approximately 50% from: 160.0 total allowed with present zoning (continued) - 3 - 6-.28-77 Z -2904-A to: 250 units proposed. This would be a significant impact on traffic, sewer and adjacent land use. A development of the proposed densities would affect the stability of adjacent single-family zoned land to the west fronting Cantrell Rd. The construction of a high-rise in the area would create visual impact over a large area to the south. STAFF RECOMMENDATION/CONDITION OF APPROVAL: The staff would oppose the rezoning of the tracts as filed or any zoning plan introducing signifi- cant increases in overall density. However, we feel a swapping of density could allow the applicant to proceed in the direction he desires on the high-rise while providing maintenance of green space separation to adjacent residences and park. We would recommend that the "E" zoning be permitted as filed and that a reduction to "MF 6" be accomplished on the balance of the apartment request. Further, that the 100 ft. green belt be extended along the west side and retained on the east and south of the apartment zones. We feel buffering of this nature, when left as undisturbed green belt, is essential. We feel that approval should also be conditioned on limiting access to Cantrell Rd. to one point. PLANNING COMMISSION RECOMMENDATION: AFTER A LENGTHY DISCUSSION OF THE ISSUES AND PRESENTATIONS BY STAFF, OWNERS AND OBJECTORS, THE PLANNING :COMMIS'SION VOTED ON THE PETITION AS FILED.
