3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO A CONTRACT WITH JAMES A. ROGERS EXCAVATING,INC.,IN
5 AN AMOUNT NOT TO EXCEED FOUR MILLION, FOUR HUNDRED
6 FORTY THOUSAND, FIVE HUNDRED SEVENTY-FIVE AND 23/100
7 DOLLARS ($4,440,575.23), FOR CITY OF LITTLE ROCK CLASS 1
8 LANDFILL CELL 5 WEST CONSTRUCTION; AND FOR OTHER
9 PURPOSES.

11 WHEREAS,Bids were solicited for improvements for City of Little Rock Class 1 Landfill Cell 5 West
12 Construction, Bid No. 617;and,
13 WHEREAS, James A. Rogers Excavating, Inc., was the lowest responsive, responsible bid meeting
14 specifications.
15 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
16 OF LITTLE ROCK,ARKANSAS:
17 Section 1. The City Manager is hereby authorized to execute an agreement with, James A. Rogers
IS Excavating, Inc., for Little Rock Class 1 Landfill Cell 5 West Construction, in an amount not to exceed
19 Four Million, Four Hundred Forty Thousand, Five Hundred Seventy-Five and 23/100 Dollars
20 ($4,440,575.23),which is the base bid amount of Three Million, Seven Hundred Thousand, Four Hundred
21 Seventy-Nine and 36/100 Dollars($3,700,479.36), plus 20%contingencies.
22 Section 2. Funding for this project is from the Solid Waste Enterprise Fund, Special Capital
23 Improvement Activity No. S40A561.
24 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
25 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
26 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
27 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
28 resolution.
29 Section 4. Repealer. All laws,ordinances, resolutions,or parts of the same,that are inconsistent with
30 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
