The property's legal description is a long legal summarized as "Part of the East 150' of the Fowler Block, City of Little Rock, Pulaski County, Arkansas." This multifamily building was built in 1984. The 2006 survey form states: "A standard twentieth century commercial property with minimal traditional details. The origins of many of the building elements, such as roof slope, bay windows, gables porches, and round classical columns are Colonial Revival." It is considered a "Non - Contributing Structure" to the MacArthur Park Historic District. This application is for a fence on the street sides, people and vehicular gates and power closers and openers. On December 21, 2010, a COC was approved and issued to Chuck Heinbockel for a new roof. On February 8, 1984, a COA was approved and issued to Tom Wilkes of Quapaw Realty for new apartments. PROPOSAL AND WRITTEN ANALYSIS OF THE APPLICATION BASED OFF OF INTENT AND GUIDELINES: This application is for the installation of fencing along be a combination of three foot tall metal fences and gates, six foot tall metal fences and gates and some six foot tall wood fencing. The interior property lines (north and west sides) already have a six foot tall wood privacy fence. The additional fencing that is the subject of this application will totally enclose the property. A three foot metal fence will be placed between the buildings and the street on both 7th and Sherman Streets. It will be a Montage Plus fence Genesis style with triad style finials. There will be three man gates at the sidewalks that enter the property (two 7th and Sherman Street frontages. It will at the porches and one between the two buildings. This fence will roughly parallel the street but will have some jogs in the fence to go around existing trees. The fence will be placed at an angle at the street corner for visibility of cars at the intersection. At the driveways, there will be a combination of six foot fences and vehicular gates. The 15 feet wide gate will be placed 27 feet off the property line on the 7th Street entrance and operate as a rolling fence that will roll to the west when opened. The new fence will extend from the wood privacy fence to the building at a corner approximately 11 feet back from the front of the building. One parking space will be left to the outside of the fence. The Sherman Street gate will be a swinging gate angled between 30 and 35 feet off the property line. The 18 feet wide gate will swing toward the street. This fence will extend from the dumpster enclosure fencing to the side of the building just behind the bay window projection. These fences will also be the Montage Plus fence Genesis style with triad style finials. There will be one section of six foot fencing between the two buildings on the 7th Street side with one man gate at the sidewalk. It will be co -planer with the fagade of the western building. The last portion of the proposed fencing is a six foot tall wood fence forming the dumpster enclosure at the Sherman Street driveway. There will be a double gate visible from Sherman Street for access by the refuse hauling company and a single man gate on the west side not visible from the street. There will be gate operator boxes located within the fenced areas to mechanically open and close the gates. The residents will be issued fobs to remotely open the gates. STAFF RECOMMENDATION: Approval with the following conditions: 1. Obtaining a building permit. COMMISSION ACTION: May 14, 2018 Brian Minyard, Staff, made a brief presentation of the item including an email and a phone call that were both in opposition to the item. He reviewed the email that was provided to the commission today from Melissa Wood and it was provided to the applicant. Ed Sergeant, the architect for the project, spoke for the applicant. He believes that the fence is tastefully done and it is pulled back from the street. It will have the quad flare finial instead of the triad finial as shown in the application. He stated that there will be one space outside of the fence for guests. If the fence was moved farther away from the street, additional spaces would be lost. This parking lot has a one way traffic pattern. The applicant and he took a look around the area and some fences were taller than the one they are proposing and he gave examples. The relation to the front of the building is different in this application and he believes that they are in compliance with the guidelines. Commissioner Dick Kelley asked if the Commission approved a fence earlier on this site. Mr. Minyard stated that they did not. There was an item that was withdrawn last year that was similar to this application, but the action was to permit withdrawal. There were no citizens present for citizen comment. Vice Chair Jeremiah Russell made a motion to approve as submitted with staff recommendations. Commissioner Dick Kelly seconded and the motion passed with a vote of 6 ayes, 0 noes, and 1 absent (Frederick). The attached drawing has blue lines to indicate 72 inch tall steel picket fences, and a 15 foot wide gate and an additional 18 foot wide gate for the parking lot as well as a 72 inch tall steel fence with 4 foot wide gate between the two buildings facing 7th Street. The green line indicate 36 inch tall steel fences with 4 foot wide gates. Red lines indicate a 72 inch tall wood dumpster enclosure with dog eared 6 inch picket.
