HomeMy WebLinkAbout21762 �I��I'�I'I'�1�����1!!�I'�!I'�I��II����l� 2019045898 1 ORDINANCE NO.21,76YRESENTED:07-24-201903:11:42PM RECORDED:07-24-201903:16:15pM 2 In Official Records of Terri Hollingsworth CircuitICOUnty Clerk PULASKI CO,AR FEE$20.00 3 AN ORDINANCE TO CREATE THE PERMANENT RIVER MARKET 4 ENTERTAINMENT DISTRICT PURSUANT TO THE ENTERTAINMENT 5 DISTRICT ORDINANCE; AND FOR OTHER PURPOSES. 6 7 WHEREAS, on July 23, 2019, the Board of Directors of the City of Little Rock, Arkansas, passed 8 Little Rock,Ark.,Ordinance No.21,761 ("LRO 21,761")which permitted the creation of an Entertainment 9 District pursuant to Arkansas State Law and City ordinance; and, 10 WHEREAS,it is desired to simultaneously create a Permanent Entertainment District to be known as 11 the River Market Entertainment District. 12 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 13 OF LITTLE ROCK,ARKANSAS: 14 Section 1. Creation and Boundaries of the River Market Entertainment District. 15 (a) The River Market Entertainment District is hereby created by the City of Little Rock as a 16 Permanent Entertainment District and subject to LRO 21,761 and its defined terms. 17 (b) The River Market Entertainment District encompasses all public places lying within 1) 18 Block I of Pope's Addition in the City of Little Rock; and 2) Thirty (30) feet of each side of the 19 centerline of the following blocks of the following streets in the City of Little Rock: 300 - 600 20 blocks of President Clinton Avenue, 100 block of North Rock Street,and 100 block of St.Vincent 21 Plaza,also known as the 100 block of North Commerce Street. 22 (c) The River Market Entertainment District and persons located within its boundaries shall 23 observe the following operational rules, and any violation of them by persons shall be an offense 24 pursuant to Section 1-9: 25 (1)No person shall possess or consume from an Open Alcoholic Beverage Container in 26 the River Market Entertainment District except during the following days and times: 27 (A)December 31St from 8:00 AM to January I`until 2:00 AM; 28 (B)January 1St from 8:00 AM to midnight; 29 (C)February 1411 from 8:00 AM to midnight; -j"E C/ 30 (D)March 17'from 8:00 AM to midnight; 31 (E) July 41'from 8:00 AM to midnight; 0 = 32 (F) December 2411 from 8:00 AM to midnight; 33 (G)All other Fridays from 5:00 PM to midnight; ro1, " "", 10V 34 (H)All other Saturdays from 8:00 AM to midnight; and, tit 111"Ok [Page 1 of 21 1 (I) All other Sundays from 10:00 AM to 7:00 PM. 2 (2) No person shall possess or consume from an Open Alcoholic Beverage Container when 3 within the River Market Entertainment District unless it is within the District's branded 4 container, and, if required in the discretion of the Planning and Development 5 Department Director,he or she possesses a District-approved identification wristband, 6 each item of which shall be approved by the Planning and Development Department 7 Director. An established Neighborhood Association, Merchant Association or other 8 designated organization, as approved or assigned by the Planning and Development 9 Department Director, shall procure the District-approved container called for in this 10 section, and any wristband required by the Planning and Development Department 11 Director, and make (i) exemplars of it or them available to the Little Rock Police 12 Department; and(ii)reasonable supplies of them available for a reasonable cost to all 13 on-premises consumption Alcoholic Beverage Control Division permitted 14 establishments immediately adjoining the district that wish to receive them. 15 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 16 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 17 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 18 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 19 ordinance. 20 Section 3. Repealer.
